Φ.0544/ΑΣ 10/Μ.5693 Έγκριση του Πρωτοκόλλου της Ογδόης Συνόδου της Μεικτής Ελληνο-σλοβακικής Επιτροπής για Επιστη?μονική και Τεχνολογική Συνεργασία» (Μπρατισλάβα, 22 Νοεμβρίου 2004). ΟΙ ΥΠΟΥΡΓΟΙ ΕΞΩΤΕΡΙΚΩΝ - ΑΝΑΠΤΥΞΗΣ - ΕΘΝΙΚΗΣ ΠΑΙΔΕΙΑΣ ΚΑΙ ΘΡΗΣΚΕΥΜΑΤΩΝ - ΥΓΕΙΑΣ ΚΑΙ ΚΟΙΝΩΝΙΚΗΣ ΑΛΛΗΛΕΓΓΥΗΣ - ΜΕΤΑΦΟΡΩΝ ΚΑΙ ΕΠΙΚΟΙΝΩΝΙΩΝ Έχοντας υπόψη:

1.

Τις διατάξεις της Συμφωνίας Επιστημονικής και Τεχνολογικής Συνεργασίας μεταξύ της Ελληνικής Δημο?κρατίας και της Σοσιαλιστικής Δημοκρατίας της Τσεχο?σλοβακίας Ελλάδας που υπογράφηκε στην Πράγα στις 4 Ιουλίου 1984 και κυρώθηκε με το υπ’ αριθμ. ν. 1661/1986, που δημοσιεύθηκε στο υπ’ αριθμ. 186 Φύλλο της Εφημε?ρίδας της Κυβερνήσεως τεύχος Α, της 28.11.1986.

Το Άρθρο δεύτερο του ως άνω κυρωτικού νόμου σύμφωνα με το οποίο τα σε εκτέλεση της Συμφωνίας Πρωτόκολλα-Πρακτικά που καταρτίζονται από τη Μεικτή Επιτροπή του άρθρου 3 της Συμφωνίας αυτής εγκρίνο?νται με Κοινή Πράξη των αρμοδίων κατά περίπτωση Υπουργών.

Την από 13.6.1995 Υπουργική Ανακοίνωση που δημο?σιεύθηκε στο υπ’ αριθμ. 138 Φύλλο της Εφημερίδας της Κυβερνήσεως Α, της 29.6.1995 με την οποία επιβεβαιώνε?ται το συμβατικό καθεστώς μεταξύ της χώρας μας και της Σλοβακίας, όπως τούτο συμφωνήθηκε στη Μπρατισλάβα στις 13.1.1995 και 2.6.1995.

Το άρθρο 29 Α του ν. 1558/1985 (ΦΕΚ Α~ 137) όπως προστέθηκε με το άρθρο 27 του ν. 2081/1992 (ΦΕΚ Α~ 154) και τροποποιήθηκε με το άρθρο 1 παράγραφος 2 α του ν. 2469/1997 (ΦΕΚ Α~ 38).

Το γεγονός ότι εκ της εφαρμογής των διατάξεων του υπό έγκριση Πρωτοκόλλου δεν προκαλείται πρόσθετη δαπάνη πλέον αυτής που προκύπτει από τις βασικές δια?τάξεις της Συμφωνίας και που είχε εκτιμηθεί στην Έκθεση του Γενικού Λογιστηρίου του Κράτους.

Το περιεχόμενο του υπό έγκριση Πρωτοκόλλου, απο?φασίζουμε: Εγκρίνουμε ως έχει και στο σύνολό του το Πρωτό?κολλο της Ογδόης Συνόδου της Μεικτής Ελληνο-σλο?βακικής Επιτροπής για Επιστημονική και Τεχνολογική Συνεργασία που υπογράφηκε στη Μπρατισλάβα στις 22 Νοεμβρίου 2004 το κείμενο του οποίου σε πρωτότυ?πο στην αγγλική γλώσσα και σε μετάφραση στην ελλη?νική έχει ως εξής: PROTOCOL ON THE EIGHT SESSION OF THE GREEK - SLOVAK JOINT COMMISSION FOR SCIENTIFIC AND TECHNOLOGICAL COOPERATION Bratislava, 22 November, 2004 On the basis of the intergovernmental Agreement be?tween both countries, on November 22, 2004, the dele?gation of the Hellenic Republic and the delegation of the Slovak Republic, held their 8thSession of the Greek - Slovak Joint Commission on Scientific- Technological Cooper?ation in Bratislava, in order to establish the Bilateral Coop?eration Working Programme on Science and Technology for the years 2005-2006. The delegation of the Hellenic Republic was headed by His Excellency Mr. Efstathios Daras, Ambassador of the Hellenic Republic to Slovakia. The delegation of the Slovak Republic was headed by Dr. Peter Magdolen, the Director General of the Division of Sci?ence and Technology, Ministry of Education of the Slovak Republic. The list of the members of both delegations is included in Annex 1 of the Protocol and make an integral part of it. The Joint Commission considered the following Agenda (Annex 2):

1.

Exchange of information on the current situation and basic governmental policy on science and technology in the two countries;

2.

Review of the Working Programme adopted in the 7th Meeting of the Joint Commission (in Athens, during July 5.6., 2001)

3.

Adoption of the Working Programme for the years 2005-2006; Selection and approval of the submitted joint project proposals for the Science and Technology Pro?gramme for 2005-2006 (Annex 3);

4.

Financial provisions and administrative procedures;

5.

Miscelaneous; Future Activities; Date and place of the 9th Joint Commission Meeting. 1223 The Head of the Slovak delegation welcomed the Greek delegation and expressed his satisfaction with the progress made in the Greek - Slovak Cooperation in the period 2001-2004. He presented also the brief overview of the Slovak S&T (R&D) system and informed about the preparation of the new Operational Programme 2005-2006. He also empha?sized the importance of the cooperation between scien?tists and researchers of different countries and the role of such cooperation within the enlarged European Union, member of which is the Slovak Republic since May 1, 2004. The Greek delegation expressed his gratitude to the Slovak Side for the warm reception and excellent organization of the Joint Commission meeting. He presented his satisfaction on the present scientific and technological cooperation from the both, bilateral and multilateral points of view. The two Parties exchanged information on scientific and technological policies and priorities, as well as of content and directions of mutual international scientific and tech?nological cooperation. The two Parties put particular em?phasis on the role of international cooperation for further development of the science and technology system in their countries. They expressed their confidence that the imple?mentation of the Bilateral Programme will further con?tribute to the development of beneficial links between sci?entific institutions and scientists of both countries, and will enable them to use their scientific potential more efficient?ly and fruitfully in joint projects. The two Parties also agreed to pay serious attention to extending the cooperation in international and European multilateral research and development programmes, and more specifically the European Union’s Framework Pro?grammes, COST, EUREKA, as well as in all other initiatives. Ad.2. Review of the Working Programme, adopted during the 7th Meeting of the Joint Commission (in Athens, during July 5 and 6, 2001). The Joint Commission noted that between July 2001 and November 2004, the Scientific and Technological Cooper?ation between the two countries has become broader and more intensive. On the basis of the Call for proposals adopted on the 7th Session of the Joint Commission for S&T Cooperation held in Athens during 5.-6.July, 2001, a total number of 15 joint projects were adopted and includ?ed in the previous Protocol in the framework of which groups of Slovak and Greek scientists visited the partner country. Both partners reviewed the implementation of the 15 pro?jects of the previous Protocol and noted that the majority of the projects have successfully reached most of their aims. In the framework of these projects and apart from the sci?entific exchanges, common articles and studies were also published in international journals. Ad. 3. Adoption of the Working Programme for the years 2005-2006. Both sides issued a Call for Proposals in October 2003. Working from the list of the total number of 30 eligible joint project proposals, submitted to the both sides (show?ing a significant increase in comparison with the previous Call), an evaluation followed, by experts from both coun?tries on the basis of their scientific merits and the national priorities of the two Parties. The Joint Commission discussed the list of jointly sub?mitted proposals together with the output of the evaluation and approved the Working Programme for the years 20052006 in the following areas: - Health Sciences - New Materials - Transport Networks and Telecommunications The List of the approved 17 projects is attached in Annex 3 of this Protocol and makes an integral part of it. Both Parties decided to support projects coming from academies, universities, research centers and private and public companies, as well as, to encourage and facilitate bilateral agreements between institutions in the both coun?tries. The two Parties realized that (as well as under the pre?vious Call) up to now still very few private enterprises par?ticipated in the bilateral cooperation. Both Parties therefore agreed to make more effort to en?courage the participation of private enterprises and espe?cially SMEs in the future. The two parties agreed that this Programme should be used in order to promote and facilitate further scientific co?operation within the research and development possibili?ties, offered by the European union and other internation?al organizations. Ad. 4. Administrative procedures and financial condi?tions of the cooperation 4.1 Administrative procedures of the cooperation The administration of the bilateral projects adopted un?der this document and all procedures involved in their im?plementation will be entrusted from the both Parties to the scientific and research institutions in the Hellenic Republic and in the Slovak Republic which participate in these pro?jects. The project leaders of the cooperating research teams should present annually to the competent authorities of the respective national Parties a report dealing with the joint work performed under the. project during the given year and a financial report concerning the use of the support re?ceived. Upon the termination of the project, a final report of the results achieved should be submitted to the responsible bodies for the coordination of the implementation of the present Programme. Decisions regarding the publication of the achievemen?ts of the joint work and of the possible registration of the in?tellectual property rights (patents, utility models, industrial design, etc.) shall be made in conformity with the laws and regulations valid in the two countries, and on the basis of the mutual agreement reached, in due time, by the partici?pating institutions. Any matter that might arise during the implementation of this Programme shall be resolved by written procedure be?tween the two Parties. 4.2. Financial Conditions of the Cooperation Financial support for the approved projects will be granted under the Programme, to cover mainly traveling and daily allowances for short-term visits, as well as long term visits up to three months, on the reciprocal basis. Concerning the short-term visits, the Parties agree to al?locate the equivalent of up to two visits per year per project, 1224 ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ (ΤΕΥΧΟΣ ΠΡΩΤΟ) countries. The receiving Party will cover the costs of internal travels necessary for the implementation of the approved cooper?ation projects. The receiving Party will provide: In case of short term visits (10 days max.): In the Hellenic Republic: Daily Allowance of EUR 100 In the Slovak Republic. SKK 790 - per day (cca EUR 20), plus costs of accom?modation In case of long-term visits (up to the 3 months): In the Hellenic Republic: A monthly allowance of EUR 1000. In the Slovak Republic SKK 6 000.- monthly (cca EUR 150), plus costs of ac?commodation Both Sides agreed the sending Party is responsible for the emergency health insurance of its scientists, including the medical care. Implementation of the Working Programme: The both Parties stated that the administration of bilater?al projects adopted under the Protocol as well as the pro?cedures involved in their implementation will be entrusted respectively to the Greek and the Slovak institutions which are involved in these bilateral projects. The coordination of the cooperation and the implemen?tation of the Programme is entrusted to the Ministry of De?velopment, General Secretariat for Research and Technol?ogy of the Hellenic Republic and to the-Ministry of Ed?ucation of the Slovak Republic. Upon conclusion of projects, a final report on the results achieved should be ν submitted. These reports will be evaluated and taken into consideration during the next op?erational meeting. The evaluation will be made on the ba?sis of how well the aims, set forth by the project proposals, have been achieved. Ad. 5. Miscellaneous and Future Activities The two Parties agreed to held the 9th Session of the Joint Commission during the second half of 2006, or in the first half of 2007 in Athens. The two Parties will mutually agree the exact date of the next session of the Joint Commission for S&T Cooperation. Signed in Bratislava, on November 22, 2004 in two copies, in English language, both copies being equally au?thentic. H.E. ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ (ΤΕΥΧΟΣ ΠΡΩΤΟ) 1225 Μπρατισλάβα, 22 Νοεμβρίου 2004 Βάσει της διακυβερνητικής Συμφωνίας μεταξύ των δύο χωρών, στις 22 Νοεμβρίου 2004 η αντιπροσωπεία της Ελ?ληνικής Δημοκρατίας και η αντιπροσωπεία της Δημοκρα?τίας της Σλοβακίας πραγματοποίησαν την 8η Σύνοδο της Ελληνο-Σλοβακικής Μικτής Επιτροπής για Επιστημονική και Τεχνολογική Συνεργασία στην Μπρατισλάβα, προκει?μένου να διαμορφώσουν το Πρόγραμμα Εργασίας Διμε?ρούς Συνεργασίας για τις Επιστήμες και την Τεχνολογία για τα έτη 2005-2006. Της αντιπροσωπείας της Ελληνικής Δημοκρατίας προΐστατο η Αυτού Εξοχότης ο Κος Ευστάθιος Δάρας, Πρέσβης της Ελληνικής Δημοκρατίας στη Σλοβακία. Της αντιπροσωπείας της Δημοκρατίας της Σλοβακίας προίστατο ο Δρ.Peter Magdolen, Γενικός Γραμματέας του Τομέα Επιστημών και Τεχνολογίας του Υπουργείου Παιδείας της Δημοκρατίας της Σλοβακίας. Ο κατάλογος των μελών των δύο αντιπροσωπειών περι?λαμβάνεται στο Παράρτημα 1 του Πρωτοκόλλου και απο?τελεί αναπόσπαστο τμήμα του. Η Μικτή Επιτροπή εξέτασε τα ακόλουθα θέματα που πε?ριλαμβάνονταν στην Ημερήσια Διάταξη (Παράρτημα 2):

Ανταλλαγή πληροφοριών σχετικά με την τρέχουσα κατάσταση και την βασική κυβερνητική πολιτική σε θέμα?τα επιστημών και τεχνολογίας στις δύο χώρες,

2.

Ανασκόπηση του Προγράμματος Εργασίας που είχε υιοθετηθεί κατά την 7η Σύνοδο της Μικτής Επιτροπής (που είχε λάβει χώρα στην Αθήνα στις 5-6 Ιουλίου 2001),

3.

Υιοθέτηση του Προγράμματος Εργασίας για τα έτη 2005-2006. Επιλογή και έγκριση των υποβληθέντων προ?τάσεων για κοινά προγράμματα για το Πρόγραμμα Επι?στημών και Τεχνολογίας για το 2005-2006 (Παράρτημα 3),

Οικονομικές διατάξεις και διοικητικές διαδικασίες,
