Φ. 0544/ΑΣ 351/Μ. 5621 Έγκριση του Προγράμματος Συνεργασίας για τον Πολιτι?σμό, την Εκπαίδευση και άλλους σχετιζόμενους τομείς μεταξύ των Κυβερνήσεως της Ελληνικής Δημοκρατίας και της Δημοκρατίας της Πολωνίας. (Βαρσοβία, 15 Ια?νουαρίου 2004). ΟΙ ΥΠΟΥΡΓΟΙ ΕΞΩΤΕΡΙΚΩΝ - ΕΘΝΙΚΗΣ ΠΑΙΔΕΙΑΣ ΚΑΙ ΘΡΗΣΚΕΥΜΑΤΩΝ - ΠΟΛΙΤΙΣΜΟΥ - ΕΠΙΚΡΑΤΕΙΑΣ Έχοντας υπόψη τις διατάξεις:
Τις διατάξεις του άρθρου 4 της Συμφωνίας μεταξύ των Κυβερνήσεων της Ελληνικής Δημοκρατίας και της Λαϊκής Δημοκρατίας της Πολωνίας για Μορφωτική και Επιστημονική Συνεργασία που υπογράφηκε στην Αθήνα την 31η Μαρτίου 1976 (Ν. 594/1977 ΦΕΚ 157/Α~/7.6.1977), βάσει του οποίου συνιστάται Μεικτή Ελληνοπολωνική Επιτροπή.
Τις διατάξεις του άρθρου 29Α~ του Νόμου 1558/1985 Α~/137 που προστέθηκε με το άρθρο 27 του Νόμου 2081/1992 Α~ 154 και τροποποιήθηκε με το άρθρο 1 πα?ράγρ. 2α του Νόμου 2469/1997 Α~ 38.
Το γεγονός ότι εκ της εφαρμογής των διατάξεων του υπό έγκριση Προγράμματος δεν προκαλείται πρόσθετη δαπάνη πλέον αυτής η οποία προκύπτει από τις βασικές διατάξεις της Συμφωνίας και που έχει εκτιμηθεί στην Έκ?θεση του Γενικού Λογιστηρίου του Κράτους.
Την 33/23.3.2004 απόφαση του Πρωθυπουργού και Υπουργού Πολιτισμού για ανάθεση αρμοδιοτήτων στην Αναπληρωτή Υπουργό Πολιτισμού (ΦΕΚ 527/2004 τ. Β~).
Το περιεχόμενο του υπό έγκριση Προγράμματος, αποφασίζουμε: Εγκρίνουμε ως έχει και στο σύνολό του, το Πρόγραμμα Συνεργασίας για τον Πολιτισμό, την Εκπαίδευση και άλ?λους σχετιζόμενους τομείς μεταξύ των Κυβερνήσεων της Ελληνικής Δημοκρατίας και της Δημοκρατίας της Πολω?νίας που υπεγράφη στη Βαρσοβία την 15 Ιανουαρίου 2004 το κείμενο του οποίου σε πρωτότυπο στην αγγλική και σε μετάφραση στην ελληνική έχει ως εξής: Programme of Co-operation in Culture, Education and Related Fields between the Government of the Hellenic Republic and the Government of the Republic of Poland Pursuant to article 4 of the Agreement between the Gov?ernment of the Hellenic Republic and the Government of the Polish People's Republic on Cultural and Scientific Co?operation, signed in Athens on March 31st, 1976, the Greek-Polish Mixed Commission, representing the min?istries of both countries, hereafter referred to as the Parties, deliberated in Warsaw on January 13th - 15 th, 2004. The composition of the Commission is given in the attached Annex. The Commission agreed on the following Programme of Greek-Polish co-operation in culture, education and re?lated fields, for the years 2004-2007. I. CULTURE AND ART Article 1 The Parties shall encourage the contacts and activity of the National Committees for the Cultural Olympiad, which will accompany the Summer Olympic Games in Athens, in 2004. Article 2 The Parties shall encourage direct contacts between the writers' associations of the two countries, to promote de?velopment of collaboration in areas of mutual interest, in particular through an exchange of writers and translators, and organization of conferences. Article 3 Each Party shall devote a special edition of a literary jour?nal to the contemporary or children's literature of the other Side. Article 4 During the validity of this Programme the Parties shall en?courage an exchange of outstanding representatives of the literary communities of the two countries (1 on each Side) for a period of 7 days, to share experiences. Article 5 The Parties shall encourage activities to publish an an?5193 The Parties shall encourage their theatrical, musical and folk ensembles, including amateur groups, to participate in festivals and cultural events organized by the other Side. Article 7 During the validity of this Programme the Parties shall delegate 2 observers each, for a period of 7 days in the case of each visit, to important artistic festivals organized by the other Side. The particulars shall be arranged direct?ly between the interested ministries and institutions. Article 8 The Parties shall encourage co-operation and bilateral cultural undertakings in the framework of their contacts with international cultural organizations. Article 9 The Parties shall ensure the protection of copyrights in compliance with the international conventions to which they are parties. Article 10 The Parties shall encourage direct co-operation between associations and unions in the realm of plastic arts, theatre, music and other arts. Article 11 During the validity of this Programme the Parties shall exchange one exhibition each of old, modern or folk art. The particulars shall be arranged between the interested ministries or institutions. Article 12 The Parties shall encourage the organization of film days, on a reciprocal basis. Article 13 The Parties shall encourage direct co-operation in the field of cinematography, for the purpose of film production and exchange of film-making services, as well as exchange of films on commercial and non-commercial basis. Article 14 The Parties shall exchange invitations to international film festivals organized in their countries, in accordance with the rules of those festivals. Article 15 The Parties shall encourage direct co-operation between state film archives and film libraries of the two countries, through an exchange of information and audio-video materials. Article 16 The Parties shall co-operate to prevent illegal import, ex?port and transfer of cultural values constituting their nation?al heritage, in compliance with the regulations in force in each country, and in accordance with the relevant inter?national conventions. Article 17 The Parties shall encourage the activities of the Polish Ar?chaeological Institute in Athens, established in 1995 by de?cision of the Institute of Archaeology and Ethnology of the Polish Academy of Sciences and Warsaw University, in co?operation with the Ministry of Culture of the Hellenic Re?public. Article 18 During the validity of this Programme the Parties shall exchange 2 archaeologists, each for a period of up to 7 days, to become acquainted with museum management and other matters within their competency, and to study cultural monuments and archaeological sites in the other country. Article 19 During the validity of this Programme the Parties shall exchange 2 conservators each, specialized in the resto?ration of ancient or modern art monuments, or the resto?ration of folk art, for a period of up to 7 days each, to study issues within their domain. Article 20 The Parties shall encourage the exchange of publi?cations in the field of archaeology and monuments con?servation, conducted through the relevant institutions of the two countries. II. EDUCATION Article 21 The Parties shall encourage co-operation between high?er artistic schools of the two countries. The details of co-op?eration shall be arranged directly between the interested institutions. Article 22 The Parties shall continue to encourage the direct co-op?eration between the scientific-research institutes of the Polish Academy of Sciences and the Athens Academy and Greek research institutes, for the purpose of joint research, consultations, and exchange of experience and scientific staff. Article 23 The Parties shall encourage direct co-operation between the institutions of higher education of the two countries in the following fields: - joint scientific research, - exchange of scientific and didactical staff to deliver lec?tures and to participate in congresses and symposia, - exchange of scientific information and publications. Article 24 The Parties shall encourage the exchange of information and documents, in order to facilitate recognition by the rel?evant authorities of the two countries of school certificates, and equivalence of diplomas of the institutions of higher education as well as equivalence of diplomas of scientific degrees, granted by the authorized institutions of the oth?er country, according to the rules and regulations of each country. 5194 ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ (ΤΕΥΧΟΣ ΠΡΩΤΟ) a) 5 academic teachers of the institutions of higher ed?ucation for a period of up to 7 days in the case of each visit, for the purpose of exchanging experiences, delivering lec?tures, participating in congresses and seminars, etc. b) 5 scientists and researchers for a period of up to 7 days in the case of each visit, to conduct research and to exchange information. Article 26 The Parties shall grant each other, annually, 30 scholar?ship months of post-graduate or research scholarships, with each one not exceeding 10 months. The Parties shall grant each other, annually, 2 one-mon?th scholarships for participants in summer courses of the culture and language of the other country. Article 27 The Parties shall co-operate for the objective presen?tation of the history and geography of the other country in the school textbooks (primary and secondary level), ac?cording to the spirit and scope of the United Nations Ed?ucational, Scientific and Cultural Organization (UNESCO) and the Council of Europe. Article 28 The Parties express their interest in establishing co-op?eration concerning the Greek and Byzantine heritage in world culture, among others in Central Europe and Poland. Article 29 In the interest of Polish and Greek youth, the Parties shall support co-operation between the youth institutions and organizations of the two countries, in the sphere of cultur?al and social activity. The Parties shall exchange information, experiences and experts in key areas pertaining to youth. The Parties shall also encourage co-operation in this sphere conducted on the basis of direct agreements between the interested in?stitutions. Article 30 The Greek Party informs that the Ministry of Education, in order to develop a common certificate for language learn?ing in Greece and other European countries, has created an examination system for the knowledge evaluation and certification of modern languages, that leads to the State Certificate of Language Learning. Article 31 The Polish Party informs that the state system of certifi?cation of the Polish language as a foreign language has been established in the Republic of Poland. III. LIBRARIES AND ARCHIVES Article 32 The National Library in Warsaw and the National Library of Greece in Athens shall exchange books, microfilms, printed matter and such materials as reproductions of documents and manuscripts, as well as bibliographic data, various pe?riodical publications and reviews, in accordance with the in?terests of each library and the legislation of each country. Article 33 The Head Office of State Archives of the Republic of Poland and the relevant Greek institutions shall conduct, according to the legislation of each country, an exchange of scientific publications and information, in accordance with the interests of both countries. In order to supplement and complete their collections, the Parties shall register archive materials concerning the history of Poland and Greece in their collections, and shall also microfilm and exchange such materials. Article 34 During the validity of this Programme the Parties shall exchange: a) 1 librarian each for a stay of up to 10 days to become acquainted with the system of library organization, b) 1 archivist each for a stay of up to 10 days to become ac?quainted with issues within his/her competency, in accor?dance with the relevant legal regulations of each country. IV. MASS MEDIA Article 35 The Parties shall encourage direct co-operation in the field of radio and television broadcasting. The relevant ra?dio and television institutions of the two countries shall examine the possibility of concluding a direct co-operation agreement. Article 36 The Parties shall encourage the co-operation between the Polish Press Agency (PAP) and the Athens News Agen?cy (ANA). Article 37 The Parties shall encourage direct co-operation between the journalists' associations of the two countries. V. OTHER FIELDS OF COOPERATION Article 38 The Parties shall encourage co-operation in the field of sports, conducted on the basis of direct protocols between the relevant sports institutions of the two Parties. Article 39 The Parties shall encourage co-operation between the national committees of the United Nations Educational, Scientific and Cultural Organization (UNESCO) of the two countries. VI. MISCELLANEOUS Article 40 The forms of exchange and co-operation envisaged in this Programme shall not prejudice other forms of co-op?eration agreed upon by the Parties. VII. GENERAL PROVISIONS Article 41 Exchange of persons The sending Party shall determine the candidates for ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ (ΤΕΥΧΟΣ ΠΡΩΤΟ) 5195 language of the receiving country), proposed working pro?gramme, duration of stay, and any other useful infor?mation. The receiving Party shall notify the sending Party of its decision at least a month before the proposed visit. Upon obtaining the consent of the receiving Party, the sending Party shall provide the exact date of arrival not lat?er than 15 days before that date. The persons taking part in the exchange under this Pro?gramme shall have a good command of the language of the receiving country, or - either of English or French. Article 42 Scholarships The receiving Party shall announce the offered scholar?ships by January 31st of each year at the latest. The send?ing Party shall convey to the receiving Party the documen?ts of the candidates by March 31st of each year at the lat?est. The documents of the candidates should be in English and shall include: - professional CV, - authenticated copies of higher study diplomas or cer?tificates of scientific degrees, - programme of planned research or internship, - health certificate. The receiving Party shall inform the sending Party of its decision concerning the choice of scholarship candidates by May 31st of each year. The scholarship grantees shall have a good command of the language of the receiving country, or - either of English or French. The candidates for post-graduate studies in Greece should speak the Greek language and have been ac?cepted in a post -graduate studies programme. Article 43 Summer courses The sending Party will forward to the receiving Party the candidates/ files not later than March 31st. The receiving Party will announce its final acceptance of the candidates not later than May 31st. Article 44 Exchange of exhibitions The sending Party shall inform the receiving Party about the proposed subject of the exhibition and other partic?ulars, at least 12 months before the opening date. In order to permit suitable preparations for the exhibition, the sending Party shall convey the basic technical data concerning the planned exhibition, and the materials needed for publication of the catalogue (introduction, list of exhibits, photos etc.), at least 3 months before the open?ing. The exhibits shall be expected to reach their destination at least 15 days prior to the opening. VIII. FINANCIAL PROVISIONS Article 45 Exchange of persons The sending Party shall ensure that the persons partici?pating in the exchange provided by the present Pro?gramme have insurance to cover the expenses of the med?ical assistance in case of sudden illness or accident, unless they are authorized to free health services on the basis of separate regulations of the receiving country.
Short stays (up to 30 days): The sending Party will cover the roundtrip between the two capitals. 1) The Polish Side as the receiving Party shall provide: - free accommodation, or accommodation allowance not exceeding 157 PLN per day, - per diems not exceeding 105 PLN, - costs of travel on the territory of Poland, as envisaged by the programme of the visit. 2) The Greek Side as the receiving Party shall provide: a) Ministry of Education: - 90 =C per day for room and board, - travel costs on the Greek territory, according to the pro?gramme of stay, - cost of a one day visit to archaeological or historical sites. b) Ministry of Culture: - 90 =C per day for room and board, - 90 =C per visit to cover travel costs within Greece. The Parties shall have the right to adjust the value of the per diems and monthly scholarship rates to changes in living costs.
Scholarships 1) The Polish Side as the receiving Party shall provide exemption from tuition fees and scholarship funds to cov?er room and board, as follows: a) for the participants of the research trips, doctoral studies, post-diploma studies, studies qualifying for as?sistant-professorship, and of scientific, artistic or special?ization practices, special studies or courses, as well as for the participants of the professional practices - 1200 PLN per month, b) for the participants of the research studies, post-diplo?ma studies, scientific practices, artistic or other practices, who have a degree equivalent to the Polish associate pro?fessor - 1450 PLN per month. 2) The Greek Side as the receiving Party shall provide: a) a monthly allowance of 440 =C for postgraduate stu?dents or researchers commencing upon student's arrival in Greece and covering the duration of the scholarship; b) a lump sum of 59 =C upon arrival for accommodation cost for those settling in Athens or 88 =C for those settling in the provinces. Students, whose scholarship has been renewed, shall not be entitled to this sum; c) exemption from tuition fees; d) travelling expenses within the Greek territory, accord?ing to the approved study programme of postgraduate stu?dents or researchers, of up to the sum of 88 =C . 3) The costs of international travels will not be covered by the Parties, subject to internal regulations.
