As regards Annex IV of the Agreement: i) With reference to paragraph 2, the two Harris VP?100B transmitters still to be delivered will be installed at the following sites: one transmitter will be installed at the ERT facility in Corfu and the other unit will be in?stalled at the ERT facility in Malgara, near Thessa?loniki. ERT will make all the necessary electrical, structural and mechanical ;nodification to the sites so that the representatives of Harris Corporation can perform their standard transmitter installation at these two sites. ERT has agreed that the Corfd site will be ready for installation by June 30, 2001 and the Malgara site will be ready for installation by Septem?ber 30, 2001. ii) Paragraph 3 is replaced as follows: «The Govern?ment of the United States through the International Broadcast Bureau (IBB) shall make a cash payment to the Government of the Hellenic Republic, through ERT, in the amount of US $ 425,000. This cash payment will be made by December 30,2002.» iii) Paragraph 4 replaced as follows: «The Government of the United States through the International Broadcast Bureau (IBB) shall make a cash payment to the Govern?ment of the Hellenic Republic, through ERT, in the amount of US $ 800,000. This cash payment will be made by December 30,2001.» iv) With reference to paragraph 5, the following ar?rangements are made: IBB will take prompt action to ship to ERT the remaining 42 FM transmitters. In addi?tion, IBB has agreed to make a cash payment to ERT in the amount of US $100,000 to pay for voltage conver?sions, acquisition of Yoltmeters and for making fre?quency changes for transmitters set at mid-band. This payment will be completed by July 31,2001.

As regards Annex V, paragraph B is replaced in its entirety as follows: 3549 Satellite Earth Stations equipped with 2 ports, auto tracking, auto deicing and redundant LNAs. Each earth station shall be capable of uplinking one digital TV MCPC Carrier with uplink chain redundancy. The uplink chain includes digital QPSK modulators, LNR upcon?verters and 1.7kW CPI high power amplifiers. ERT may option to change one of the 4.8m Antennas to a 3.8 me?ter Dual-Offset Antenna within 60 days of signing this agreement. All equipment will be CE complaint.

The transmit frequency of the earth stations shall be in the range of 17.3 - 18.4 GHz and the receive frequen?cy shall be in the range of 10.95 - 12.75 GHz.

ΙΒB shall purchase for ERT, two Tandberg MPEG 2/DVB compliant Digital TV 4:2:2 Hybrid Encoder system with a 5+1 encoder redundancy configuration, and equipped with Statistical Multiplexer for installation in Athens, Greece per ERT’s request. The input inter?face to the Encoder system shall be a digital interface. One of the two Encoder systems shall have the Condi?tional Access encryption scheme as provided by NDS.

ΙΒΒ shall provide all necessary cabling, connectors and racks for this installation, and one HP Spectrum An?alyzer as test equipment(suitable for operation in the L Band through KU Band). For the receive chain IBB shall provide four 4:2:2 compression compatible IRDs and six standard IRDs.

EBB shall provide spare parts for a two-year oper?ation.

ERT, at its own cost, will provide a sheltered room to house the high power amplifiers within 30meters of the antenna pads, accordance to space, power and cooling requirements provided to ERT. These require?ments will be provided by IBB to ERT within thirty days of both parties signing this agreement. If one shelter cannot be co-located to support both antennas, then ERT will provide two separate shelters.

ERT, at its own cost, will be responsible for all site modifications necessary to facilitate the installation of the earth stations, including cable trays and conduits both inside the facility and outside, from the facility to the shelter and from the shelter to the antenna pad.

ERT will prepare the site and place antenna con?crete pads according to Vertex specification that will be submitted to ERT.

The power configuration of all equipment shall be 220 Volts Single Phase and/or 380 Volts 3 Phase at 50 Hz.

IBB will use its best effors to complete the pro?curement, installation and commissioning of the two satellite earth stations within 18 months of both parties signing this agreement, with the earliest installation date being April 1, 2002. To this end IBB will provide a detailed schedule, including ERT milestones, to en?sure successful completion.

The above provisions fully satisfy ERTs satellite earth stations requirements under Annex V.» If the foregoing is acceptable to the Government of the United States of America, this note, together with the af?firmative note in reply, shall constitute an agreement be?tween the two Governments that shall enter into force on the date of receipt of the second note. Athens, 24 April 2001 Το: The Embassy of the United States - of America In town EMBASSY OF THE UNITED STATES OF AMERICA NO. 146/PA/01 The Embassy of the United States of America presen?ts its compliments to the Ministry of Foreign Affairs and has the honor to refer to the Ministry’s Verbal Note No.2203.112/ AS 286, concerning the consultations which took place in Athens on January 17-18 and February 28 to March 1, 2001 on pending issues re?lating to Annexes IV and V of the Agreement between the Government of the United States of America and the Government of the Hellenic Republic for the Operation of Re-Broadcasting Stations in Greece, signed on May 16, 1996. At the conclusion of these consultations and in a spir?it of mutual understanding, the representatives of both countries agreed to the following:

As compensation to the Government of the Hel?lenic Republic for the authorization contained in this An?nex, the Government of the United States of America Satellite Earth Stations equipped with 2 ports, auto tracking, auto deicing and redundant LNAs. Each earth station shall be capable of uplinking one digital TV MCPC Carrier with uplink chain redundancy. The uplink chain includes digital QPSK modulators, LNR upcon?verters and 1.7kW CPI high power amplifiers. ERT may opt to change one of the 4.8m Antennas to a 3.8 meter Dual-Offset Antenna within 60 days of signing this agreement. All equipment will be CE compliant.

The transmit frequency of the earth stations shall be in the range of 17.3-18.4 GHz and the receive frequen?cy shall be in the range of 10.95-12.75 GHz.

Athens, April 27, 2001 Embassy of the United States of America -ΡΗΜΑΤΙΚΗ ΔΙΑΚΟΙΝΩΣΗ Το Υπουργείο Εξωτερικών της Ελληνικής Δημοκρα?τίας υποβάλλει τα σέβη του στην Πρεσβεία των Ηνω?μένων Πολιτειών της Αμερικής και έχει την τιμή να αναφερθεί στις διαβουλεύσεις, οι οποίες διεξήχθη?σαν στην Αθήνα στις 17 με 18 Ιανουαρίου και στις 28 Φεβρουαρίου με 1 Μαρτίου 2001 σχετικά με εκκρεμή θέματα τα οποία αφορούν την εφαρμογή των Παραρ?τημάτων IV και V της Συμφωνίας μεταξύ της Κυβέρ?νησης των Ηνωμένων Πολιτειών της Αμερικής και της Κυβέρνησης της Ελληνικής Δημοκρατίας για τη Λει?τουργία Σταθμών Αναμετάδοσης στην Ελλάδα, η οποία υπεγράφη στις 16 Μαΐου 1996. Στο τέλος των συναντήσεων αυτών και μέσα σε πνεύ?ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ (ΤΕΥΧΟΣ ΠΡΩΤΟ) 3551 i) Αναφορικά με την παράγραφο 2, οι δύο πομποί Harris VP - 100Β που απομένουν να παραδοθούν θα εγκατασταθούν στους ακόλουθους χώρους: ένας πο?μπός θα εγκατασταθεί στις εγκαταστάσεις της ΕΡΤ στην Κέρκυρα και η άλλη μονάδα θα εγκατασταθεί στις εγκαταστάσεις της ΕΡΤ στα Μάλγαρα, κοντά στη Θεσ?σαλονίκη. Η ΕΡΤ θα εκτελέσει όλες τις αναγκαίες ηλε?κτρικές, δομικές και μηχανικές τροποποιήσεις στους χώρους, ώστε να μπορέσουν οι αντιπρόσωποι της Har?ris Corporation να εκτελέσουν την τυποποιημένη εγκα?τάσταση πομπού στους δύο αυτούς χώρους. Η ΕΡΤ έχει συμφωνήσει να είναι έτοιμος για εγκατάσταση ο χώρος στην Κέρκυρα μέχρι τις 30 Ιουνίου 2001 και ο χώρος στα Μάλγαρα μέχρι τις 30 Σεπτεμβρίου 2001. ii) Η παράγραφος 3 αντικαθίσταται ως εξής: «Η Κυ?βέρνηση των Ηνωμένων Πολιτειών της Αμερικής, μέ?σω του Διεθνούς Ραδιοτηλεοπτικού Γραφείου, θα πλη?ρώσει σε μετρητά στην Κυβέρνηση της Ελληνικής Δη?μοκρατίας, μέσω της ΕΡΤ, το ποσό των 425.000 δολαρίων ΗΠΑ. Αυτή η πληρωμή σε μετρητά θα γίνει μέχρι τις 30 Δεκεμβρίου 2002.» iii) Η παράγραφος 4 αντικαθίσταται ως εξής: «Η Κυ?βέρνηση των Ηνωμένων Πολιτειών της Αμερικής, μέ?σω του Διεθνούς Ραδιοτηλεοπτικού Γραφείου, θα πλη?ρώσει σε μετρητά στην Κυβέρνηση της Ελληνικής Δη?μοκρατίας, μέσω της ΕΡΤ, το ποσό των 800.000 δολαρίων HΠΑ. Αυτή η πληρωμή σε μετρητά θα γίνει μέχρι τις 30 Δεκεμβρίου 2001.» iv) Αναφορικά με την παράγραφο 5, γίνεται η εξής ρύθμιση: Το Διεθνές Ραδιοτηλεοπτικό Γραφείο θα ενεργήσει άμεσα ώστε να αποστείλει στην ΕΡΤ τους υπόλοιπους 42 πομπούς FM. Επιπλέον, το Διεθνές Ρα?διοτηλεοπτικό Γραφείο έχει συμφωνήσει να πληρώσει σε μετρητά στην ΕΡΤ το ποσό των 100.000 δολαρίων ΗΠΑ προκειμένου αυτή να πληρώσει για μετατροπές τάσης, απόκτηση βολτομέτρων και την πραγματοποί?ηση αλλαγών συχνοτήτων για πομπούς που εκπέ?μπουν στο μεσαίο φάσμα της δέσμης συχνοτήτων. Αυ?τή η πληρωμή θα έχει ολοκληρωθεί μέχρι τις 31 Ιουλί?ου 2001.

Όσον αφορά το Παράρτημα V, η παράγραφος Β αντικαθίσταται στο σύνολό της ως εξής: «Β. Ως αντάλλαγμα προς την Κυβέρνηση της Ελληνι?κής Δημοκρατίας για την εξουσιοδότηση που περιέχε?ται στο παρόν Παράρτημα, η Κυβέρνηση των Ηνωμέ?νων Πολιτειών της Αμερικής συμφωνεί τα εξής:

Το Διεθνές Ραδιοτηλεοπτικό Γραφείο θα παράσχει δύο Επίγειους Δορυφορικούς Σταθμούς Vertex Turn Key Tx / Rx των 4,8 μέτρων εξοπλισμένους με 2 θύρες, αυτοϊχνηλασία, αυτοαποπάγωση και πλεονάζοντα LNA. Κάθε επίγειος σταθμός θα μπορεί να κάνει άνω ζεύξη ενός ψηφιακού τηλεοπτικού φορέα MCPC με πλεόνασμα αλυσίδας άνω ζεύξεων. Η αλυσίδα άνω ζεύξεων περιλαμβάνει ψηφιακούς διαμορφωτές QP?SK, επαυξητές LNR και ενισχυτές μεγάλης ισχύος CPI 1,7 kW. H EPT μπορεί να επιλέξει να αλλάξει μία από τις είναι στο φάσμα των 17,3 - 18,4 GHz και η συχνότητα λήψης θα είναι στο φάσμα των 10,95 - 12,75 GHz. Όλος ο εξοπλισμός θα είναι σύμμορφος με CE.

Το Διεθνές Ραδιοτηλεοπτικό Γραφείο θα αγορά?σει για την EPT δύο συστήματα Υβριδικού Κωδικο?ποιητή Ψηφιακής Τηλεόρασης 4:2:2 Tandberg σύμ?μορφα με Μ PEG 2 / DVB, με διαμόρφωση πλεονα?σμού κωδικοποιητή 5 + 1 και εξοπλισμένα με Στατιστικό Πολυπλέκτη για εγκατάσταση στην Αθήνα της Ελλάδας κατόπιν αιτήματος της EPT. H διασύν?δεση εισαγωγής του συστήματος Κωδικοποιητή θα είναι ψηφιακή. Ένα από τα δύο συστήματα Κωδικο?ποιητή θα διαθέτει το πρόγραμμα κρυπτογράφησης με υπό όρους πρόσβαση που προβλέπεται από την NDS.
