ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ

ΟΙ ΥΠΟΥΡΓΟΙ ΕΞΩΤΕΡΙΚΩΝ – ΑΝΑΠΤΥΞΗΣ – ΠΕΡΙΒΑΛΛΟΝΤΟΣ, ΧΩΡΟΤΑΞΙΑΣ ΚΑΙ ΔΗΜΟΣΙΩΝ ΕΡΓΩΝ − ΑΓΡΟΤΙΚΗΣ ΑΝΑΠΤΥΞΗΣ ΚΑΙ ΤΡΟΦΙΜΩΝ − ΑΝ. ΠΟΛΙΤΙΣΜΟΥ − ΜΕΤΑΦΟΡΩΝ ΚΑΙ ΕΠΙΚΟΙΝΩΝΙΩΝ Έχοντας υπ’ όψιν:

1.

Τις διατάξεις της Συμφωνίας επιστημονικής και τεχνολογικής συνεργασίας μεταξύ της Ελληνικής Δημοκρατίας και της Λαϊκής Δημοκρατίας της Κίνας η οποία υπογράφηκε στις 15 Νοεμβρίου 1979 και κυρώθηκε με τον υπ’ αριθμ. 1097/1980 νόμο, που δημοσιεύθηκε στο υπ’ αριθμ. 285 Φύλλο της Εφημερίδος της Κυβέρνησης τεύχος Α΄, της 17ης Δεκεμβρίου 1980.

Το άρθρο δεύτερο του ως άνω κυρωτικού νόμου σύμφωνα με το οποίο τα Πρωτόκολλα−Πρακτικά της Συνδιάσκεψης Εργασίας του άρθρου 6 παράγραφος 3 της Συμφωνίας θα εγκρίνονται με κοινή πράξη των αρμοδίων κατά περίπτωση Υπουργών.

Τις διατάξεις του άρθρου 90 της Κωδικοποίησης της νομοθεσίας για την Κυβέρνηση και τα κυβερνητικά όργανα (π.δ. 63 − ΦΕΚ 98/Α/22.4.2005).

Την υπ’ αριθμ. 33/24.3.2004 απόφαση του Πρωθυπουργού και Υπουργού Πολιτισμού με την οποία ανατέθηκε η άσκηση αρμοδιοτήτων στην Αναπληρωτή Υπουργό Πολιτισμού Φ. Πάλλη − Πετραλιά και στους Υφυπουργούς Γ. Ορφανό και Π. Τατούλη (ΦΕΚ 527/ 24.3.2004, Τεύχος Β΄ και 558/2.4.2004, Τεύχος Β΄).

Το γεγονός ότι εκ της εφαρμογής των διατάξεων του υπό έγκριση Πρωτοκόλλου δεν προκαλείται πρόσθετη δαπάνη σε βάρος του Κρατικού Προϋπολογισμού πλέον αυτής που προκύπτει από τις βασικές διατάξεις της Συμφωνίας και που είχε εκτιμηθεί στην Έκθεση του Γενικού Λογιστηρίου του Κράτους.

Το περιεχόμενο του υπό έγκριση Πρωτοκόλλου, αποφασίζουμε: Εγκρίνουμε ως έχει και στο σύνολο του το Πρωτόκολλο της 10ης Συνόδου της Μικτής Επιτροπής Συνεργασίας Ε & Τ μεταξύ της Ελληνικής Δημοκρατίας και της Λαϊκής Δημοκρατίας της Κίνας που υπεγράφη στο Πεκίνο στις 27 Μαΐου 2005, το κείμενο του οποίου σε πρωτότυπο στην αγγλική γλώσσα και σε μετάφραση στην ελληνική έχει ως εξής: THE JOINT S&T COOPERATION COMMITTEE between THE HELLENIC REPUBLIC and THE PEOPLE’S REPUBLIC OF CHINA In accordance with the Agreement on S&T Cooperation signed in Beijing on November 15, 1979 between the Government of the Hellenic Republic and the Government of the People’s Republic of China, the Greek − Chinese Joint Committee held its 10th Session in Beijing on the 27th of May, 2005. The Chinese Delegation was headed by Mr, MENG Shuguang, Minister Counsellor of Ministry of Science and Technology of China. The Greek Delegation was headed by Prof. Ioannis A. Tsoukalas, Secretary General for Research and Technology, Ministry of Development. The composition of both Delegations is enclosed in Annex I. The Joint Committee held its meeting according to the following agenda: I. Information on the actual situation of the national R&D system by both sides II. Science and Technology for the Olympic Games. III. Joint participation in EU’s 6th and 7th Framework Program. IV. Review of the implementation of the working program adopted by the 9th session of the Joint Committee V. Future activities and follow−up actions in Renewable Energy and Biotechnology for Agriculture VI. Adoption of the working program for S&T Cooperation for the period 2005 – 2007 VII. Financial provisions and administrative procedures VIII. Next call for proposals IX. Setting the dates for the next session of the Joint S&T Committee

Information on the actual situation of the national R&D system by both Parties Both sides presented a brief outline of their Scientific & Technological policy. Two sides agreed to focus their future scientific and technological cooperation in specific priority areas such as: − Renewable energy sources and energy saving − Agricultural Biotechnology − Environment − Agriculture with emphasis on applications of new technologies in agriculture and on farm management and farming techniques − Transport and Communication The two sides expressed their concern on the efficiency of the dissemination and exploitation of research results. The Greek side gave information on the measures for the Research & Technological Development within the Operational Program for Competitiveness 2000 – 2006. The Chinese side introduced the National Programs on Scientific Research and Technological Development for the next five years and the National Long and Medium Plan for S&T Development which is in process of establish.

Science and Technology for the Olympic Games Both sides discussed S&T matters that concern the organization of Olympics 2004 and 2008 for both Countries. Two Workshops for S&T for the Olympics had been decided during the 9th session of the Joint Committee to encourage cooperation and exchanges of best practice and know −how. The first Workshop already held in Athens, 29.3.2004−1.4.2004 accomplished its goals, while the second organization in Beijing will be held on 27.5.2005 where there will be visits of the Greek Delegation to Olympic command center of Public Security and First Aid Center. *Furthermore, parallel to the Joint Committee Meeting, the organization of a specific Research Topics Meeting, has been bilaterally agreed to be held in Beijing and Shanghai (28−30/5/05) among Chinese experts and the Greek experts delegation in three fields of science such as Biochemistry, Information Technologies and aspects of technological development in clothes textiles and fibres in order for both parts of scientists to exchange know how and specific practices. Moreover, for this reason, the Greek Delegation will visit Academic Institutes and Research Centers.

Joint Participation in EU’s 6th and 7th Framework Program Two sides shared the view that the 6th and 7th EU Framework Programme, EUREKA, COST, etc., provide new cooperation platforms. As the follow−up of 1999 ASEM S+T Ministerial Meeting, aquaculture project submitted to FP6 was highlighted as a good example. Two sides will concentrate on further extending their cooperation within these frameworks. Two workshops to stimulate joint application for FP6 have been already held in China 23−29.11.2003 focusing on agriculture and food and 1823.10.2004 in Greece focusing on environment. Both workshops were successfully implemented.

Review of the implementation of the working program adopted by the 9th Session of the Joint Committee The Joint Committee stated that, in the period 2003 – 2005 the scientific and technological relations between the two countries have become broader and more intensive. The 25 projects included in the previous Protocol provided a solid basis for the cooperation. The two sides presented a report concerning the status of the implementation of these 25 projects that are successfully reaching the end.

Future activities and follow –up actions in Biotechnology for Agriculture and Renewable Energy Source focusing in Solar Energy The members of the delegations discussed and decided the following two Workshops to be organized in Athens and in Beijing on Biotechnology for Agriculture.

Adoption of the working program for S&T Cooperation for the period 2005 – 2007 Both sides agreed to approve a Working Program for 2005 – 2007, covering the following major areas:

Renewable Energy Sources

3.

Information and Communication Technologies

4.

Environmental Technologies and Design

5.

Geophysics and Seismology

6.

Meteorology Following the call for proposals launched on September The project proposals submitted to the implementing agencies were reviewed by both sides. Based on their scientific merit and the national priorities, the Joint Committee selected and approved 20 projects listed in Annex III for implementation in the next two years.

7.

Financial provisions and administrative procedures Financial conditions on S & T co−operation Under the Working Program financial support shall be granted for approved projects to cover travel expenses and daily subsidence allowances. The sending side will cover international travel costs between locations of the implementing institutions. The receiving side shall cover the cost of internal travel within the host country, necessary for the implementation of the approved cooperation project. Moreover, the Greek side (GSRT) will support longterm visits (up to 3 months) granted to Chinese or Greek young scientists working under the framework of these projects as well as consumables, publishing expenses and small equipment. The receiving side will provide: China: − in case of short-term visits (up to 15 days) The Chinese side will cover accommodation and living expenses − in case of long-term visits (up to 3 months) The Chinese side will provide appropriate accommodation and living expenses Greece: − in case of short−term visits (up to 10 days) 100 euros per day for living expenses and for accommodation − in case of long−term visits (up to 3 months) 1000 euros/month (lodging cost is included) Administrative procedures Researchers from both sides are required to submit to both Executive Agencies (MOST and GSRT) a comprehensive yearly report outlining the joint work performed in the project. Upon termination of each project a final report on the results achieved, will be submitted to both Executive Agencies. The Joint Committee will assess the reports during the forthcoming session (the major focus of the evaluation will be the extent to which the aims set forth in the project have been achieved). Decisions related to the publication of project achievements and the possible registration of intellectual property rights (patterns, utility models, industrial designs, etc.) shall be taken in accordance with the laws and regulations of both countries, on the basis of mutual agreements reached in due time by the participating institutes.

Next Call for Proposals Both sides decided to launch the next joint call for proposals on the forth trimester of 2006. The two sides also agreed to regularly inform each other about scientific and technological events and to mutually facilitate the participation of scientists, researchers and experts of each country in such events.

Setting the dates for the next session of the Joint S&T Committee Both sides agreed to hold the next Joint Greek−Chinese Committee on S&T Cooperation in Athens, during the second trimester of the year 2007. The present Protocol was prepared and signed in Beijing on the 27th of May 2005 in two copies, both in English language.
