του άρθρου 8 της Συμφωνίας οικονομικής και τεχνι?κής συνεργασίας μεταξύ των Κυβερνήσεων της Ελληνι?κής Δημοκρατίας και της Αραβικής Δημοκρατίας της Αι?γύπτου που υπογράφηκε στο Κάιρο στις 24 Φεβρουαρίου 1968 και κυρώθηκε με τον υπ’ αριθ. 1715/1987 Νόμο που δημοσιεύθηκε στο υπ’ αριθ. 117 Φύλλο της Εφημερίδος της Κυβερνήσεως τεύχος Α’ της 8ης Ιουλίου 1987, δια του οποίου συνιστάται Κοινή Διυπουργική Επιτροπή προκει?μένου να διευκολυνθεί η εφαρμογή της Συμφωνίας και εξευρεθούν οι κατάλληλοι τρόποι και τα μέσα για την ανά?πτυξη της οικονομικής, επιστημονικής και τεχνικής συ?νεργασίας μεταξύ των δύο χωρών,

του δευτέρου άρθρου του νόμου 1715/1987 βάσει του οποίου τα Πρωτόκολλα - Πρακτικά που υπογράφο?νται από την Μικτή Επιτροπή του άρθρου 8 της Συμφω?νίας, θα εγκρίνονται με κοινή πράξη των αρμοδίων κατά περίπτωση Υπουργών,

το περιεχόμενο του υπό έγκριση Πρωτοκόλλου,

του Ν.1558/1985 (ΦΕΚ 137Α΄) όπως τροποποιήθηκε και συμπληρώθηκε με το Ν. 2081/1992 (ΦΕΚ 89Α΄) και αντι?καταστάθηκε με το άρθρο 1 παρ. 2α του Ν. 2469/1997 (ΦΕΚ 38Α) και το γεγονός ότι από τις διατάξεις της από?φασης δεν προκαλείται δαπάνη του Κρατικού Προϋπολο?γισμού, αποφασίζουμε: Εγκρίνουμε ως έχει και στο σύνολό του το Πρωτόκολλο της 5ης Συνόδου της Μικτής Ελληνο-Αιγυπτιακής Διϋ?πουργικής Επιτροπής οικονομικής και τεχνολογικής συ?νεργασίας που υπογράφηκε στην Αθήνα στις 16.2.2000 του οποίου το κείμενο σε πρωτότυπο στην αγγλική γλώσ?σα και σε μετάφραση στην ελληνική έχει ως εξής: Αθήνα, 30 Ιανουαρίου 2001 ΟΙ ΥΠΟΥΡΓΟΙ ΕΘΝΙΚΗΣ ΟΙΚΟΝΟΜΙΑΣ ΕΞΩΤΕΡΙΚΩΝ ΚΑΙ ΟΙΚΟΝΟΜΙΚΩΝ Γ. ΠΑΠΟΥΤΣΗΣ -PROTOCOL OF THE FIFTH SESSION OF THE JOINT MINISTERIAL COMMITTEE ON ECONOMIC AND TECHNICAL COOPERATION BETWEEN THE HELLENIC REPUBLIC AND THE ARAB REPUBLIC OF EGYPT The fifth session of the Hellenic-Egyptian Joint Com?mittee, on the basis of Article 8 of the Agreement for Eco?1039 ΠΕΡΙΕΧΟΜΕΝΑ ΑΠΟΦΑΣΕΙΣ The Hellenic Republic was headed by H.E Ms. Rodoula Zissis, Deputy Minister of National Economy. The Egyptian Delegation was headed by H.E Am?bassador Rafik Salah El Din, Advisor to the Minister of Plan?ning and International Cooperation. The lists of the members of the two Delegations are attached herewith as Annexes I and II. The discussions took place in a friendly and warm atmo?sphere inspired by the excellent political and traditional ties existing between the people of both countries. Within this context, the Hellenic and Egyptian Delegations assured their common will to further promote and extend their co?operation on the basis of mutual economic and commer?cial benefit. To this end, the two Delegations after having agreed upon the proposed agenda, exchanged infor?mation on respective economic policies of their govern?ments and proceeded to a review of the bilateral collabo?ration achieved up to now. Having discussed various issues concerning matters of mutual interest, they concluded to the following: • Economic and Commercial Cooperation The two sides exchanged extensively, views on the evo?lution of trade cooperation between the two parties and noted that there are significant opportunities for further de?velopment of their bilateral economic relations. They also agreed to make every possible effort to improve and inten?sify business promoting programs in order to increase the volume of trade. For this to be achieved, the following were decided as a first step: - to promote the exchange of information on trade, - to encourage companies from the private sector to par?ticipate in business delegations through the correspond?ing authorities (Chambers of Commerce, etc.), specialized business trips and seminars in both countries. To this end both sides reiterated their readiness to undertaking the due efforts, - to mutually participate to International Trade Fairs in Cairo and Thessaloniki, - to work towards the promotion of Greek investments in Egypt. Both sides referred to the importance of the existing co?operation in the Banking Sector - and the activities developed by the National Bank of Greece in Cairo and agreed to encourage the further de?velopment of these activities in Egypt. • Industry and SME’s Both sides agreed to promote the collaboration among them at industrial sectors of specific interest such as: food, construction material, cement, oil pipes, shipbuilding (constructing and repairing of ships), metalworking, fertil?izers, paints, marbles, cosmetics, medical equipment, pharmaceuticals, cooling and solar systems. This collaboration includes special treatment for propos?als of joint - ventures and investments on the above in?dustrial sectors and close cooperation in the field of train?ing and transfer of technology. The Greek side interested in the Egyptian program for privatization underlined the interest of the Greek compa?nies to participate in the acquisition of some Egyptian com?panies in various sectors. The two sides emphasized the importance of their inter?est in the development of entrepreneurial cooperation among Small and Medium Enterprises. The Egyptian side expressed its satisfaction for the train?ing courses offered to high officials from the public sector and enterprises of the Egyptian SME sector by Hellenic Or?ganization of Small and Medium Sized Enterprises and handicraft (EOMMEX), during the past three years. Both sides agreed to continue implementing the action described in the Cooperation Protocol between EOMMEX and the Social Fund for Development for the mutual bene?fit of the SME’s of both Countries. • Energy In the energy sector both sides agreed to cooperate on relevant issues. More specifically: - In the sector of Electricity, Public Power Corporation of the Hellenic Republic would like to continue and develop the cooperation with the Egyptian Electricity Authority of the Egyptian Republic in the following main areas: - Studies, Research and Development - Rural Electrification - Personnel training in the Electivity sector Furthermore the two sides agreed on the following is?sues: - need of a fruitful cooperation on Renewable Energy Sources, Energy Saving, Rational Use of Energy in the sec?tors of research, technical support and dissemination of in?formation, - development of public awareness programs on Re?newable Energy Sources as well as programs of education and training of experts and technicians on relevant matters, - establishment of pilot projects concerning the use of so?lar energy, the exploitation of the wind energy potential for both countries and the implementation of energy efficien?cy methods. • Research and Technology Both parties confirmed their willingness to effect and pro?mote cooperation in the field of science and technology. Agreeing on the general principles of an Agreement on Sci?entific and Technological Cooperation, they have ex?pressed their intention to accelerate the relevant proce?dures in order to conclude this agreement promptly in the very near future. • Shipping The two parties referred to the Agreement they had signed on 18th April 1981 on Shipping and Maritime Trans?port, and stressed the need for further promotion of the co?operation in this field. The two sides preferred to continue the exchange of views for the improvement of the existing maritime agreement and the protocol annexed to it instead of discussing a new one, through diplomatic channels. • Scientific and Technical Cooperation in the sectors of Agriculture and Fishery Both sides expressed their wish to enhance their coop?eration in the following fields: 1040 ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ (ΤΕΥΧΟΣ ΠΡΩΤΟ) amounting to 30 million Drachmas, will be covered by the Greek side in the frame work of Official Development As?sistance. The joint program will be carried out by various research boards in Greece and Egypt. - Exchange of experts and joint research projects in the field of genetic (experience) engineering. - Exchange of experience and training in the field of lab?oratory analysis for food and fodder. - Joint research project in the field of cotton physiology and its agricultural treatment. - Joint research projects, exchange of experts and / or short training courses in the field of the food - processing. Necessary financing will be covered either by govern?ments or by European funds, when available. The Greek side expressed their wish to be notified by the Egyptian side, as it concerns the latter’s priorities. ii) Fishery Both sides expressed their willingness to enhance coop?eration in the field of sponge and coastal fishing taking in?to consideration the results of the joint research program implemented by both sides in 1997. The Greek side expressed its concern about Decree No 250, banning the imports of milk / dairy products, given that Greek products are dioxin free and called for its replace?ment by an import regime based on health certificates. • Tourism The two sides expressed their will to promote closer co?operation in the tourism sector. To this end they will encourage travel agencies in both countries to arrange joint tourist programs and work out a plan for joint promotion aiming at increasing tourist traffic between the two countries and attracting tourists from third countries. Moreover the Greek side stated its intention to organize a seminar for Egyptian personnel working in hotels and restaurants, during the year 2000. • Labor Force On this issue, the two parties expressed their satisfaction for the good relations that govern this sector and reached the conclusion that they should convene a Mixed Com?mittee of experts to further discuss ways of improving the current status within the a spirit of good will and pursuant to the relevant laws of both countries. • Issues of Mass Media Both sides agreed to continue and accelerate their ef?forts to promote cooperation in all fields of mutual interests, particularly: - exchange visit of journalists, - exchange news items between the Athens New Agency (A.P.E.) and the National Egyptian New Agency (ΜΕΝΑ), - cooperation between the Greek and Egyptian Radio and Television. • Specific Issues - Indemnification of Greek Interests The Greek side proposed the convening of the Mixed Commission provided for in article 9 of the «Agreement be?tween the Kingdom of Greece and the Arab Republic of Egypt on the compensation of the Greek interests» of 1966, in order to examine questions relating to the implemen?tation of its provisions. Details, relating to time, place, agenda of the meeting of the said Mixed Commission shall be dealt through diplo?matic channels. - Imaret and Mohamed Ali House The two sides discussed the issue of Imaret and Mo?hamed Ali house in Kavala. The Greek side expressed con?cern to the fact that he two monuments are deteriorating to the point of danger to human life and requested the Egyp?tian side to take immediate and prompt action to perform necessary repairs. The Greek side also pointed to the need of obtaining - a priori - the appropriate approval by the Greek Ministry of Culture responsible for all monuments existing in Greece. On the other hand the Prefecture informed the Egyptian side of a pending case in front of Greek Courts concerning the danger posed by the condition of the monument. The Egyptian side promised to take necessary action. - Cement case Regarding the outstanding value of 49,080 metric tons of cement (US $ 1,914,120) that Middle East Cement Ship?ping and Handling Co. S.A, has delivered to the customers of the Egyptian Cement Office (representing the Egyptian Ministry of Housing) between January 1986 till May 5th 1986, the Greek side requested immediate settlement. The Egyptian side promised to pursue this matter with the Ministry of Housing for the prompt implementation of the Court’s Awarded amount as above. Middle East Cement Shipping and Handling Co. S.A. (MEC) a company under the Egyptian Investment Law 43/74 have other claims of more than US $ 15 million, founded on actions taken by Egyptian Governmental Au?thorities or Agencies in defiance of investment Law Provi?sions. These claims are, at the request of MEC, to be resolved by the Arbitral Tribunal formed in accordance with ICSID - rules (International Centre for Solving Investment Disputes). ‘ The Greek and Egyptian sides have promised to work closely towards an amicable settlement, if possible, for the dispute between Middle East Shipping and Handling Co. S.A. and the Egyptian State. The two delegations concluded the meetings in a friend?ly atmosphere and it was agreed that both sides would work towards the materialization of the discussed subjec?ts to the best interest of Egypt and Greece. It was also agreed that the Sixth Session of the Hellenic - Egyptian Joint Ministerial Committee on Economic and Technical Cooperation will be held in Cairo at a date to be arranged through the appropriate diplomatic channels.
