Ο ΥΠΟΥΡΓΟΣ ΕΞΩΤΕΡΙΚΩΝ Έχοντας υπόψη: Την διάταξη του άρθρου 1 του Α.Ν. της 3/10.8.1967 «Πε?ρί εφαρμογής αποφάσεων του Συμβουλίου Ασφαλείας των Ηνωμένων Εθνών και περί εγκρίσεως και εφαρμογής συστάσεων του Συμβουλίου Ασφαλείας και της Γενικής Συνελεύσεως» όπως τροποποιήθηκε με το άρθρο 39 του Ν.2145/1993 (ΦΕΚ Α' 88/28.5.93). Προβαίνουμε στη δημοσίευση της απόφασης 1352 (2001) του Συμβουλίου Ασφαλείας του Οργανισμού Ηνω?μένων Εθνών η οποία είναι, δυνάμει του άρθρου 25 του Χάρτη των Ηνωμένων Εθνών που κυρώθηκε με τον Α.Ν.585/1945, υποχρεωτικός για τα κράτη-μέλη του Ορ?γανισμού, και παραγγέλλουμε την αυστηρή τήρηση και συμμόρφωση προς τις διατάξεις της απόφασης αυτής Κατωτέρω παρατίθεται το κείμενο της απόφασης στην αγγλική γλώσσα και σε ελληνική μετάφραση Resolution 1352 (2001) Adopted by the Security Council at its 4324th meeting, on 1 June 2001 The Security Council, Recalling its previous relevant resolutions, including its resolutions 986 (1995) of 14 April 1995, 1284 (1999) of 17 December 1999 and 1330 (2000) of 5 December 2000, Convinced of the need, as a temporary measure, to provide for the civilian needs of the Iraqi people until the ful?filment by the Government of Iraq of the relevant reso?lutions, including notably resolutions 687 (1991) of 3 April 1991 and 1284 (1999), allows the Council to take further ac?tion with regard to the prohibitions referred to in resolution 661 (1990) of 6 August 1990, in accordance with the provi?sions of those resolutions, Recalling the Memorandum of Understanding between the United Nations and the Government of Iraq of 20 May 1996 (S/1996/356), Determined to improve the humanitarian situation in Iraq, Reaffirming the commitment of all Member States to the sovereignty and territorial integrity of Iraq, Acting under Chapter VII of the Charter of the United Nations,

1.

Decides to extend the provisions of resolution 1330 (2000) until 3 July 2001;

2.

Expresses its intention to consider new arrangements for the sale or supply of commodities and products to Iraq and for the facilitation of civilian trade and economic coop?eration with Iraq in civilian sectors, based on the following principles; (a) that such new arrangements will improve significant?ly the flow of commodities and products to Iraq, other than commodities and products referred to in paragraph 24 of resolution 687 (1991), and subject to review by the Com?mittee established by resolution 661 (1990) of the pro?posed sale or supply to Iraq of commodities and products on a Goods Review List to be elaborated by the Council; (b) that such new arrangements will improve the controls to prevent the sale or supply of items prohibited or unau?thorized by the Council, in the categories referred to in paragraph 2 (a) above, and to prevent the flow of revenues to Iraq outside the escrow account established pursuant to paragraph 7 of resolution 986 (1995) from the export of petroleum and petroleum products from Iraq, and also ex?presses its intention to adopt and implement such new ar?rangements, and provisions on various related issues un?der discussion in the Council, for a period of 190 days be?ginning at 00.01 hours on 4 July 2001;

Decides to remain seized of the matter. 4161 ΠΕΡΙΕΧΟΜΕΝΑ AΠΟΦΑΣΕΙΣ Το Συμβούλιο Ασφαλείας, Υπενθυμίζοντας τις προηγούμενες σχετικές αποφάσεις του, συμπεριλαμβανομένης της από 14 Απριλίου 1995 απόφασης 986 (1995), της από 17 Δεκεμβρίου 1999 από?φασης 1284 (1999) και της από 5 Δεκεμβρίου 2000 από?φασης 1330 (2000). Πεπεισμένο για την ανάγκη, ως προσωρινό μέτρο, να αντιμετωπίσει τις μη-στρατιωτικές ανάγκες του Ιρακινού λαού, μέχρι την εκτέλεση των σχετικών αποφάσεων από την Κυβέρνηση του Ιράκ, συμπεριλαμβανομένων ιδίως των αποφάσεων 687 (1991) από 3 Απριλίου 1991 και 1284 (1999), επιτρέπει στο Συμβούλιο να λάβει περαιτέρω μέ?τρα σε σχέση με τις απαγορεύσεις που αναφέρονται στην απόφαση 661 (1990) της από 6 Αυγούστου 1990, σύμφω?να με τις διατάξεις αυτών των αποφάσεων, Υπενθυμίζοντας το Μνημόνιο Συνεννοήσεως της 20ης Μαίου 1996 (S/1996/356) μεταξύ των Ηνωμένων Εθνών και της Κυβέρνησης του Ιράκ, Αποφασισμένο να βελτιώσει την ανθρωπιστική κατά?σταση στο Ιράκ, Επαναεπιβεβαιώνοντας την προσήλωση όλων των Κρα?τών-Μελών στην κυριαρχία και την εδαφική ακεραιότητα του Ιράκ, Ενεργώντας βάσει του Κεφαλαίου VII του Χάρτη των Ηνωμένων Εθνών,

1.

Αποφασίζει να παρατείνει την ισχύ των διατάξεων της απόφασης 1330 (2000) έως την 3η Ιουλίου 2001,

2.

Εκφράζει την πρόθεσή του να εξετάσει νέες διευθετή?σεις για την πώληση ή προμήθεια αγαθών και προϊόντων στο Ιράκ και για την διευκόλυνση του μη - στρατιωτικού εμπορίου και της οικονομικής συνεργασίας με το Ιράκ σε μη - στρατιωτικούς τομείς, στην βάση των ακολούθων αρχών, (α) ότι αυτές οι νέες διευθετήσεις θα βελτιώσουν σημα?ντικά την ροή των αγαθών και προϊόντων στο Ιράκ, πέραν των αγαθών και των προϊόντων που αναφέρονται στην πα?ράγραφο 24 της απόφασης 687 (1991), υπό την προϋπό?θεση ότι θα υπόκεινται σε επανεξέταση από την Επιτροπή που έχει συσταθεί με την απόφαση 661 (1990)οι προτει?νόμενες πωλήσεις ή προμήθειες του Ιράκ με αγαθά και προϊόντα βάσει ενός Καταλόγου Επανεξέτασης Αγαθών που θα καταρτίσει το Συμβούλιο, (β) ότι αυτές οι νέες διευθετήσεις θα βελτιώσουν τους ελέγχους που εμποδίζουν την πώληση ή προμήθεια ειδών που απαγορεύονται ή δεν έχουν εγκριθεί από το Συμβού?λιο, στις κατηγορίες που αναφέρονται στην παράγραφο 2 (α) ανωτέρω, και θα εμποδίζουν την ροή εσόδων στο Ιράκ από την εξαγωγή πετρελαίου και πετρελαϊκών προϊόντων από το Ιράκ, εκτός από τον μεσεγγυητικό λογαριασμό που έχει συσταθεί σε συνέχεια της παραγράφου 7 της απόφα?σης 986 (1995), και επίσης εκφράζει την πρόθεσή του να υιοθετήσει και να εφαρμόσει αυτές τις νέες διευθετήσεις, και διατάξεις σε διάφορα σχετικά θέματα που βρίσκονται υπό εξέταση ενώπιον του Συμβουλίου, για μια περίοδο 190 ημερών με έναρξη στις 00.01 της 4ης Ιουλίου 2001.

Αποφασίζει να συνεχίσει να επιλαμβάνεται του ζητή?ματος. Αθήνα, 4 Δεκεμβρίου 2001 Ο ΥΠΟΥΡΓΟΣ ΓΕΩΡΓΙΟΣ ΠΑΠΑΝΔΡΕΟΥ Αριθ. Ο ΥΠΟΥΡΓΟΣ ΕΞΩΤΕΡΙΚΩΝ Έχοντας υπόψη: Την διάταξη του άρθρου 1 του Α.Ν. 92 της 3/10.8.67 «πε?ρί εφαρμογής αποφάσεων του Συμβουλίου Ασφαλείας των Ηνωμένων Εθνών και περί εγκρίσεως και εφαρμογής συστάσεων του Συμβουλίου Ασφαλείας και της Γενικής Συνελεύσεως», Προβαίνουμε στην δημοσίευση της αποφάσεως 1330(2000) του Συμβουλίου Ασφαλείας των Ηνωμένων Εθνών η οποία είναι, δυνάμει του άρθρου 25 του Χάρτη αγγλική γλώσσα και σε ελληνική μετάφραση. Resolution 1330 (2000) Adopted by the Security Council at its 4241st meeting, on 5 December 2000 The Security Council, Recalling its previous relevant resolutions and in partic?ular its resolutions 986 (1995) of 14 April 1995, 1111 (1997) of 4 June 1997, 1129 (1997) of 12 September 1997, 1143 (1997) of 4 December 1997, 1153 (1998) of 20 February 1998, 1175 (1998) of 19 June 1998, 1210 (1998) of 24 November 1998, 1242 (1999) of 21 May 1999, 1266 (1999) of 4 October 1999, 1275 (1999) of 19 November 1999, 1280 (1999) of 3 December 1999, 1281 (1999) of 10 December 1999, 1284 (1999) of 17 December 1999, 1293 (2000) of 31 March 2000 and 1302 (2000) of 8 June 2000, Convinced of the need as a temporary measure to con?tinue to provide for the humanitarian needs of the Iraqi peo?ple until the fulfilment by the Government of Iraq of the rel?evant resolutions, including notably resolution 687 (1991) of 3 April 1991, allows the Council to take further action with regard to the prohibitions referred to in resolution 661 (1990) of 6 August 1990, in accordance with the provisions of those resolutions, Convinced also of the need for equitable distribution of humanitarian supplies to all segments of the Iraqi pop?ulation throughout the country, Determined to improve the humanitarian situation in Iraq, Reaffirming the commitment of all Member States to the sovereignty and territorial integrity of Iraq, Acting under Chapter VII of the Charter of the United Nations,

1.

Decides that the provisions of resolution 986 (1995), except those contained in paragraphs 4, 11 and 12 and subject to paragraph 15 of resolution 1284 (1999), shall re?main in force for a new period of 180 days beginning at 00.01 hours, Eastern Standard Time, on 6 December 2000;

2.

Further decides that from the sum produced from the import by States of petroleum and petroleum products originating in Iraq, including financial and other essential transactions related thereto, in the 180-day period referred to in paragraph 1 above, the amounts recommended by the Secretary-General in his report of 1 February 1998 (S/1998/90) for the food/nutrition and health sectors 4162 ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ (ΤΕΥΧΟΣ ΠΡΩΤΟ) shall be used for the purposes referred to in paragraph 8 (b) of resolution 986 (1995);

Requests the Secretary-General to continue to take the actions necessary to ensure the effective and efficient implementation of this resolution, and to continue to en?hance as necessary the United Nations observation pro?cess in Iraq including, within 90 days of the adoption of this resolution, to complete the recruitment and placement in Iraq of a sufficient number of observers, in particular the re?cruitment of the number of observers agreed between the Secretary-General and the Government of Iraq, in such a way as to provide the required assurance to the Council that the goods produced in accordance with this resolution are distributed equitably and that all supplies authorized for procurement, including dual usage items and spare parts, are utilized for the purpose for which they have been authorized, including in the housing sector and related in?frastructure development;

Decides to conduct a thorough review of all aspects of the implementation of this resolution 90 days after the en?try into force of paragraph 1 above and again prior to the end of the 180-day period, and expresses its intention, pri?or to the end of the 180-day period, to consider favourably renewal of the provisions of this resolution as appropriate, provided that the reports referred to in paragraphs 5 and 6 below indicate that those provisions are being satisfactori?ly implemented;

Requests the Secretary-General to provide a compre?hensive report to the Council 90 days after the date of en?try into force of this resolution on its implementation and again at least one week prior to the end of the 180-day pe?riod, on the basis of observations of United Nations per?sonnel in Iraq, and of consultations with the Government of Iraq, on whether Iraq has ensured the equitable distri?bution of medicine, health supplies, foodstuffs, and mate?rials and supplies for essential civilian needs, financed in accordance with paragraph 8 (a) of resolution 986 (1995), including in his reports any observations which he may have on the adequacy of the revenues to meet Iraq's hu?manitarian needs;

Requests the Committee established by resolution 661 (1990), in close consultation with the Secretary-Gen?eral, to report to the Council 90 days after the entry into force of paragraph 1 above and prior to the end of the 180day period on the implementation of the arrangements in paragraphs 1, 2, 6, 8, 9 and 10 of resolution 986 (1995);

Decides that from the funds produced pursuant to this resolution in the escrow account established by paragraph 7 of resolution 986 (1995), up to a total of 600 million United States dollars may be used to meet any reasonable expenses, other than expenses payable in Iraq, which fol?low directly from the contracts approved in accordance with paragraph 2 of resolution 1175 (1998) and paragraph 18 of resolution 1284 (1999), and expresses its intention to consider favourably the renewal of this measure;

Expresses its readiness to consider, in the light of the cooperation of the Government of Iraq in implementing all the resolutions of the Council, allowing a sum of 15 million United States dollars drawn from the escrow account to be used for the payment of the arrears in Iraq's contribution to the budget of the United Nations, and considers that this sum should be transferred from the account created pursuant to paragraph 8 (d) of resolution 986 (1995);

Requests the Secretary-General to take the necessary steps to transfer the excess funds drawn from the account created pursuant to paragraph 8 (d) of resolution 986 (1995) for the purposes set out in paragraph 8 (a) of reso?lution 986 (1995) in order to increase the funds available for humanitarian purchases, including as appropriate the pur?poses referred to in paragraph 24 of resolution 1284 (1999);

Directs the Committee established by resolution 661 (1990) to approve, on the basis of proposals from the Sec?retary-General, lists of basic electricity and housing sup?plies consistent with the priority given to the most vulnera?ble groups in Iraq, decides, notwithstanding paragraph 3 of resolution 661 (1990) and paragraph 20 of resolution 687 (1991), that supplies of these items will not be sub?mitted for approval of that Committee, except for items subject to the provisions of resolution 1051 (1996), and will be notified to the Secretary-General and financed in ac?cordance with the provisions of paragraphs 8 (a) and 8 (b) of resolution 986 (1995), requests the Secretary-General to inform the Committee in a timely manner of all such notifi?cations received and actions taken, and expresses its readiness to consider such action with regard to lists of further supplies, in particular in the transport and telecom?munications sectors;

Requests the Secretary-General to expand and up?date, within 30 days of the adoption of this resolution, the lists of humanitarian items submitted in accordance with paragraph 17 of resolution 1284 (1999) and paragraph 8 of resolution 1302 (2000), directs the Committee established by resolution 661 (1990) to approve expeditiously the ex?panded lists, decides that supplies of these items will not be submitted for approval of the Committee established by resolution 661 (1990), except for items subject to the pro?visions of resolution 1051 (1996), and will be notified to the Secretary-General and financed in accordance with the provisions of paragraphs 8 (a) and 8 (b) of resolution 986 (1995), and requests the Secretary-General to inform the Committee in a timely manner of all such notifications re?ceived and actions taken;

Decides that the effective deduction rate of the funds deposited in the escrow account established by resolution 986 (1995) to be transferred to the Compensation Fund in the 180-day period shall be 25 per cent, further decides that the additional funds resulting from this decision will be deposited into the account established under paragraph 8 (a) of resolution 986 (1995) to be used for strictly human?itarian projects to address the needs of the most vulnera?ble groups in Iraq as referred to in paragraph 126 of the re?port of the Secretary-General of 29 November 2000 (S/2000/1132), requests the Secretary-General to report on the use of these funds in his reports referred to in para?graph 5 above, and expresses its intention to establish a mechanism to review, before the end of the 180-day peri?od, the effective deduction rate of the funds deposited in the escrow account to be transferred to the Compensation Fund in future phases, taking into account the key ele?ments of the humanitarian needs of the Iraqi people;

Urges the Committee established by resolution 661 (1990) to review applications in an expeditious manner, to ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ (ΤΕΥΧΟΣ ΠΡΩΤΟ) 4163 of paragraph 3 above;

14.

Urges all States submitting applications, all financial institutions, including the Central Bank of Iraq, and the Secretariat, to take steps to minimize the problems identi?fied in the report of the Secretary-General of 29 November 2000 pursuant to paragraph 5 of resolution 1302 (2000);

15.

Requests the Secretary-General to make the nec?essary arrangements, subject to the approval of the Coun?cil, to allow funds deposited in the escrow account estab?lished by resolution 986 (1995) to be used for the purchase of locally produced goods and to meet the local cost for es?sential civilian needs which have been funded in accor?dance with the provisions of resolution 986 (1995) and re?lated resolutions, including, where appropriate, the cost of installation and training services, and further requests the Secretary-General to make the necessary arrangements, subject to the approval of the Council, to allow funds up to 600 million euros deposited in the escrow account estab?lished by resolution 986 (1995) to be used for the cost of in?stallation and maintenance, including training services, of the equipment and spare parts for the oil industry which have been funded in accordance with the provisions of res?olution 986 (1995) and related resolutions, and calls upon the Government of Iraq to cooperate in the implementation of all such arrangements;
