Τις διατάξεις της Συμφωνίας μεταξύ της Κυβέρνησης της Ελληνικής Δημοκρατίας και της Κυβέρνησης της Γεωργίας σε σχέση με τις διεθνείς οδικές μεταφορές επιβατών και εμπορευμάτων που υπογράφηκε στην Τιφλίδα, στις 10 Απριλίου 1997 και κυρώθηκε με τον υπ’ αριθμ. 2597/1998 νόμο που δημοσιεύθηκε στο υπ’ αριθμ. 65 Φύλλο Εφημερίδος της Κυβερνήσεως, Τεύχος Α΄, της 24ης Μαρτίου 1998.

Το άρθρο δεύτερο του ως άνω κυρωτικού νόμου σύμφωνα με το οποίο τα σε εκτέλεση της Συμφωνίας αυτής Πρωτόκολλα−Πρακτικά που καταρτίζονται από τη Μεικτή Επιτροπή του άρθρου 21 αυτής, εγκρίνονται με Κοινή Πράξη των αρμοδίων κατά περίπτωση Υπουργών.

Τις διατάξεις του άρθρου 90 της Κωδικοποίησης της νομοθεσίας για την Κυβέρνηση και τα Κυβερνητικά όργανα (π.δ. 63 − ΦΕΚ 98/Α/22.4.2005).

Το γεγονός ότι εκ της εφαρμογής των διατάξεων του υπό έγκριση Πρωτοκόλλου ουδεμία δαπάνη προκαλείται σε βάρος του κρατικού προϋπολογισμού πλέον αυτής που προκύπτει από τις βασικές διατάξεις της Συμφωνίας και που είχε εκτιμηθεί στην Έκθεση του Γενικού Λογιστηρίου του Κράτους.

Το περιεχόμενο του υπό έγκριση Πρωτοκόλλου, αποφασίζουμε: Εγκρίνουμε ως έχει και στο σύνολό του το Πρωτόκολλο της Συνάντησης της Μικτής Ελληνο−Γεωργιανής Επιτροπής Οδικών Μεταφορών, που υπογράφηκε στην Αθήνα, στις 18 Νοεμβρίου 2005, το κείμενο του οποίου σε πρωτότυπο στην αγγλική γλώσσα και σε μετάφραση στην ελληνική έχει ως εξής: PROTOCOL OF THE MEETING OF THE JOINT HELLENIC−GEORGIΑN COMMITTEE ON ROAD TRANSPORT Athens, 17–18.11.2005 The Meeting of the Joint Hellenic – Georgian Transport Committee on Road Transport was held in Athens, on 17 – 18 November 2005. The Hellenic Delegation was headed by Mr. Demetrios Grammatikopoulos, Director in the Passenger Transport Directorate of the Ministry of Transport and Communications of the Hellenic Republic. The Georgian Delegation was headed by Mr. Alexander Chkhikvadze, Chairman of the Administration of Road Transport of Georgia. The lists of the Hellenic and Georgian Delegations are attached as Annex I and II to this Protocol. The Georgian delegation was welcomed by Mrs. Evagelia Tsaga, General Director of Transport in the Ministry of Transport & Communications. The following agenda was agreed by the delegations:

Miscellaneous With a view of further enhancing the Hellenic– Georgian mutual cooperation in the transport field, the two Sides held fruitful discussions on all issues of common interest and reached the following conclusions:

Road Transport of Goods The two Sides exchanged information regarding the recently performed bilateral and transit road transport of goods, between and through their territories. Both Sides agreed to maintain the existing quota to 500 permits for bilateral and transit transportation of goods that would be annually exchanged between the competent authorities of the two countries. The Georgian Side requested for timely exchange of the quota of permits for the year 2006. In reply the Greek Side handed the total amount of permits to the Georgian Side and the Georgian Side informed the Greek Side that they would hand over the agreed quota of permits to the Greek Embassy in Tbilisi during the first week of December 2005. The Georgian Side informed the Greek Side on the recent reforms in the Georgian legislation, their fight against corruption and their ambition to join the E.U. in the future. In this light the Georgian Side requested for the arrangement of a meeting in the year 2006 between hauliers of both countries in order the Greek hauliers to provide technical assistance, regarding the Greek as well as the E.U. transport legislation, to these of Georgia. Road Transport of Passengers The two Sides presented the current situation in the field of the regular transport of passengers. Both Sides agreed to liberalise the operation of regular bus services between the two countries. In this light the two Sides agreed that there should be no restrictions as regards to the number of transport companies of both countries that operate the existing regular bus service between Greece and Georgia, as well as to the number of weekly itineraries performed by each carrier. Moreover both Sides agreed to examine in a positive way every future request for the establishment of any other regular service between the two countries, through correspondence. Both Sides agreed that a carrier registered in the territory of one Contracting Party should decide for the terms of operation of the regular bus services between the two countries such as the issue of cooperation with carrier of the other Contracting Party. The two Sides agreed for the prompt processing of the applications of carriers for the operation of the regular bus services between Greece and Georgia and the issuance of the corresponding authorisations within a two−month period, at the latest, from the date of receipt of the applications. In this light both Sides agreed to inform each other by fax regarding the completion of the procedure for the issuance of the authorisations for regular bus services. Moreover the Greek Side requested for the timely processing of applications of Greek carriers for authorisations for the transit passage of the Georgian territory. Both Sides agreed to start the procedure for the issuance of authorisations for regular bus services right upon the signing of this Protocol. The Greek Side posed the matter of illegal immigration, facilitated by some Georgian carriers, and requested for the assistance of the Georgian Side. The Georgian Side admitted the existence of this problem and informed the Greek Side that due to the lack of information they are not able to impose sanctions to Georgian carriers. The Georgian Side requested for information in written form about all the relevant incidents involving Georgian carriers and the Greek Side agreed to provide this piece of information in due time, through correspondence. The two Sides agreed that the buses operating regular bus services should not be subject to structural conversions in order to be used for the facilitation of illegal immigration. In this light the two Sides agreed to intensify their controls to buses operating regular bus services in order to diminish the said phenomenon (facilitation of illegal immigration). The Georgian Side repeated their request, as previously expressed for goods transportation, for the arrangement of a meeting of carriers of both countries in the year

The representatives of the Greek Ministry and the Administration of Road Transport of Georgia undertook to prepare the arrangement of such meeting.

Miscellaneous The Georgian Side requested from the Greek Side technical assistance concerning the Greek and the E.U. transport legislation in general and especially the assistance of a Greek expert in the field of technical inspection of vehicles. The Greek Side stated in response that in Greece the technical inspection is carried out by regional authorities and not by the central Ministry of Transport and Communications. Moreover the Greek Side provided the Georgian Side with a complete set of Greek and E.U. transport legislation. The Georgian Side pointed out the long duration of the procedures for issuing visas for professional drivers by the competent Greek authorities. The Greek Side stressed that the procedures of issuing visas is in accordance with E.U. legislation. However the Greek Side undertook to convey the Georgian remark to the competent Greek Ministry of Foreign Affairs for consideration. The Georgian Side following a question posed by the Greek Side stated that the Georgian Parliament is about to ratify the AETR European Agreement soon. The Meeting of the Joint Hellenic – Georgian Transport Committee was held in a friendly atmosphere depending upon mutual understanding and fruitful cooperation. The Georgian Side invited the Greek Side in Tbilisi for the next Meeting of the Joint Georgian – Hellenic Transport Committee in 2006. This Protocol was done in Athens on the 18th of November 2005 in two original copies in the English language. Mamuka Vatsadze Deputy Head of Transport Department Ministry of Economic Development ΠΡΩΤΟΚΟΛΛΟ ΤΗΣ ΣΥΝΑΝΤΗΣΗΣ ΤΗΣ ΜΙΚΤΗΣ ΕΛΛΗΝΟ−ΓΕΩΡΓΙΑΝΗΣ ΕΠΙΤΡΟΠΗΣ ΟΔΙΚΩΝ ΜΕΤΑΦΟΡΩΝ Αθήνα, 17−18.11.2005 Η Συνάντηση της Μικτής Ελληνο−Γεωργιανής Επιτροπής Οδικών Μεταφορών πραγματοποιήθηκε στην Αθήνα στις 17−18 Νοεμβρίου 2005. Επικεφαλής της Ελληνικής Αντιπροσωπείας ήταν ο Κος Δημήτριος Γραμματικόπουλος, Διευθυντής της Διεύθυνσης Επιβατικών Μεταφορών του Υπουργείου Μεταφορών και Επικοινωνιών της Ελληνικής Δημοκρατίας. Επικεφαλής της Γεωργιανής Αντιπροσωπείας ήταν ο Κος Alexander Chkhikvadze, Πρόεδρος της Διοίκησης Οδικών Μεταφορών της Γεωργίας. Οι κατάλογοι των ονομάτων των μελών της Ελληνικής και της Γεωργιανής Αντιπροσωπείας επισυνάπτονται ως Παραρτήματα Ι και ΙΙ στο παρόν Πρωτόκολλο. Την Γεωργιανή αντιπροσωπεία καλωσόρισε η Κα Ευαγγελία Τσάγκα, Γενική Διευθύντρια Μεταφορών του Υπουργείου Μεταφορών και Επικοινωνιών. Οι αντιπροσωπείες συμφώνησαν στην ακόλουθη ημερήσια διάταξη:

Διάφορα Θέματα Με στόχο την περαιτέρω ενίσχυση της αμοιβαίας Ελληνο−Γεωργιανής συνεργασίας στον τομέα των μεταφορών, οι δύο Πλευρές συζήτησαν εποικοδομητικά όλα τα θέματα κοινού ενδιαφέροντος και κατέληξαν στα ακόλουθα συμπεράσματα:

Οδικές Εμπορευματικές Μεταφορές Οι δύο Πλευρές αντάλλαξαν πληροφορίες σχετικά με τις πρόσφατα πραγματοποιηθείσες διμερείς και διαμετακομιστικές οδικές εμπορευματικές μεταφορές, μεταξύ και μέσω των εδαφών τους. Και οι δύο Πλευρές συμφώνησαν να διατηρηθεί η υπάρχουσα ποσόστωση στις 500 άδειες για διμερείς και διαμετακομιστικές οδικές εμπορευματικές μεταφορές, οι οποίες θα ανταλλάσσονται σε ετήσια βάση μεταξύ των αρμόδιων αρχών των δύο χωρών. Η Γεωργιανή Πλευρά ζήτησε την έγκαιρη ανταλλαγή της ποσόστωσης των αδειών για το έτος 2006. Αποκρινόμενη, η Ελληνική Πλευρά παρέδωσε το σύνολο των αδειών στη Γεωργιανή Πλευρά και η Γεωργιανή Πλευρά πληροφόρησε την Ελληνική Πλευρά ότι θα παρέδιδε τη συμφωνηθείσα ποσόστωση των αδειών στην Ελληνική Πρεσβεία στην Τιφλίδα κατά την διάρκεια της πρώτης εβδομάδας του Δεκεμβρίου 2005. Η Γεωργιανή Πλευρά πληροφόρησε την Ελληνική Πλευρά σχετικά με τις πρόσφατες μεταρρυθμίσεις της Γεωργιανής νομοθεσίας, τη μάχη τους κατά της διαφθοράς και την φιλοδοξία τους να γίνουν μελλοντικά μέλος της ΕΕ. Υπ’αυτό το πρίσμα, η Γεωργιανή Πλευρά ζήτησε την διοργάνωση μίας συνάντησης κατά το έτος 2006 μεταξύ οδικών μεταφορέων από τις δύο χώρες, προκειμένου οι Έλληνες οδικοί μεταφορείς να παρέξουν τεχνική βοήθεια σε σχέση με την Ελληνική αλλά και την Ευρωπαϊκή νομοθεσία σε θέματα μεταφορών στους Γεωργιανούς οδικούς μεταφορείς. Ο εκπρόσωπος των Ελλήνων οδικών μεταφορέων συγκατατέθηκε στην αίτηση αυτή και οι εκπρόσωποι των δύο Πλευρών ανέλαβαν να προβούν σε αλληλογραφία για τη διοργάνωση της ανωτέρω συνάντησης.

Οδικές Επιβατικές Μεταφορές Οι δύο Πλευρές παρουσίασαν την τρέχουσα κατάσταση στον τομέα των τακτικών επιβατικών μεταφορών. Και οι δύο Πλευρές συμφώνησαν στην απελευθέρωση της λειτουργίας τακτικών λεωφορειακών γραμμών μεταξύ των δύο χωρών. Υπ’αυτό το πρίσμα, οι δύο Πλευρές συμφώνησαν ότι δεν θα έπρεπε να υπάρχουν περιορισμοί σε σχέση με τον αριθμό των μεταφορικών εταιριών των δύο χωρών που εκμεταλλεύονται την υπάρχουσα τακτική λεωφορειακή γραμμή μεταξύ Ελλάδας και Γεωργίας, ούτε και σε σχέση με τον αριθμό των εβδομαδιαίων δρομολογίων που θα πραγματοποιούνται από κάθε μεταφορική εταιρία. Επιπλέον, οι δύο Πλευρές συμφώνησαν να εξετάζουν με θετικό τρόπο κάθε μελλοντική αίτηση για την δημιουργία οποιασδήποτε άλλης τακτικής γραμμής μεταξύ των δύο χωρών, μέσω αλληλογραφίας. Και οι δύο Πλευρές συμφώνησαν ότι ένας μεταφορέας εγγεγραμμένος στο έδαφος ενός εκ των Συμβαλλόμενων Μερών θα πρέπει να αποφασίζει σε σχέση με τους όρους λειτουργίας των τακτικών λεωφορειακών γραμμών μεταξύ των δύο χωρών, όπως είναι το θέμα της συνεργασίας με μεταφορέα του άλλου Συμβαλλόμενου Μέρους. Οι δύο Πλευρές συμφώνησαν στην άμεση διεκπεραίωση των αιτήσεων που θα υποβάλλονται από μεταφορικές εταιρείες για την εκμετάλλευση τακτικών λεωφορειακών γραμμών μεταξύ Ελλάδας και Γεωργίας και την έκδοση των αντίστοιχων αδειών εντός μίας περιόδου δύο μηνών, το αργότερο, από την ημερομηνία λήψης των αιτήσεων. Υπ’αυτό το πρίσμα, οι δύο Πλευρές συμφώνησαν να ενημερώνουν η μία την άλλη με τηλεομοιοτυπία αναφορικά με την ολοκλήρωση της διαδικασίας έκδοσης των εγκρίσεων για τις τακτικές λεωφορειακές γραμμές. Περαιτέρω, η Ελληνική Πλευρά ζήτησε την έγκαιρη διεκπεραίωση των αιτήσεων που υποβάλλουν Ελληνικές μεταφορικές εταιρίες για διέλευση από το έδαφος της Γεωργίας. Και οι δύο Πλευρές συμφώνησαν να κινήσουν την διαδικασία για την έκδοση αδειών για τις τακτικές λεωφορειακές γραμμές αμέσως μετά την υπογραφή του παρόντος Πρωτοκόλλου. Η Ελληνική Πλευρά έθεσε το θέμα της παράνομης μετανάστευσης, που διευκολύνεται από ορισμένους Γεωργιανούς μεταφορείς, και ζήτησε την συνδρομή της Γεωργιανής Πλευράς. Η Γεωργιανή Πλευρά παραδέχθηκε την ύπαρξη αυτού του προβλήματος και πληροφόρησε την Ελ ΗΛΕΚΤΡΟΝΙΚΗ ΔΙΕΥΘΥΝΣΗ: http://www.et.gr – e-mail: webmaster@et.gr ληνική Πλευρά ότι εξαιτίας της έλλειψης πληροφοριών δεν είναι σε θέση να επιβάλλουν κυρώσεις στους Γεωργιανούς μεταφορείς. Η Γεωργιανή Πλευρά ζήτησε πληροφορίες εγγράφως σε σχέση με όλα τα σχετικά περιστατικά στα οποία εμπλέκονταν Γεωργιανοί μεταφορείς και η Ελληνική Πλευρά συμφώνησε να παρέξει αυτές τις πληροφορίες εν ευθέτω χρόνω, μέσω αλληλογραφίας. Οι δύο Πλευρές συμφώνησαν ότι δεν θα πρέπει να πραγματοποιούνται κατασκευαστικές μετατροπές στα λεωφορεία των τακτικών λεωφορειακών γραμμών έτσι ώστε να χρησιμοποιούνται για την διευκόλυνση της παράνομης μετανάστευσης. Υπ’αυτό το πρίσμα, οι δύο Πλευρές συμφώνησαν στην εντατικοποίηση των ελέγχων που πραγματοποιούν σε λεωφορεία των τακτικών λεωφορειακών γραμμών για τον περιορισμό του ανωτέρω φαινομένου (της διευκόλυνσης της παράνομης μετανάστευσης). Η Γεωργιανή Πλευρά επανέλαβε την αίτησή της, όπως την είχε εκφράσει ήδη σε σχέση με τις εμπορευματικές μεταφορές, για τη διοργάνωση μίας συνάντησης μεταξύ μεταφορικών εταιριών και από τις δύο χώρες κατά το έτος

Οι εκπρόσωποι του Ελληνικού Υπουργείου και της Διοίκησης Οδικών Μεταφορών της Γεωργίας ανέλαβαν να ετοιμάσουν τη διοργάνωση αυτής της συνάντησης.
