Public Health (Tobacco) (Amendment) Act 2011

1. Amendment of section 38 of Public Health (Tobacco) Act 2002.

1.— Section 38 (as amended by section 6 of the Public Health (Tobacco) (Amendment) Act 2009) of the Public Health (Tobacco) Act 2002 is amended, in subsection (6)—

(a) by the substitution, in paragraph (a), of “giving effect or further effect” for “giving effect”,

(b) by the substitution of the following paragraph for paragraph (b):

“(b) giving effect or further effect to—

(i) Commission Decision No. 2003/641/EC of 5 September 2003 [^1] on the use of colour photographs or other illustrations as health warnings on tobacco packages,

(ii) Commission Decision C(2005) 1452 final of 26/V/2005 on the library of selected source documents containing colour photographs or other illustrations for each of the additional warnings listed in Annex 1 to Directive 2001/37/EC of the European Parliament and of the Council, or

(iii) Commission Decision C(2006) 1502 final of 12/IV/2006 amending Commission Decision C(2005) 1452 final of 26 May 2005 on the library of selected source documents containing colour photographs or other illustrations for each of the additional warnings listed in Annex 1 to Directive 2001/37/EC of the European Parliament and of the Council,”,

and

(c) by the substitution, in paragraph (c), of “or any or all of the Commission Decisions referred to in sub-paragraphs (i), (ii) and (iii) of paragraph (b).” for “or the Commission Decision referred to in paragraph (b).”.

2. Short title and collective citation.

2.— (1) This Act may be cited as the Public Health (Tobacco) (Amendment) Act 2011.

(2) The Public Health (Tobacco) Acts 2002 to 2010 and this Act may be cited together as the Public Health (Tobacco) Acts 2002 to 2011.
