Commission Implementing Regulation (EU) No 1212/2011 of 23 November 2011 amending Regulation (EC) No 1416/2006 laying down specific rules on the implementation of Article 7(2) of the Agreement between the European Community and the United States of America on trade in wine concerning the protection of US names of origin in the Community

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Decision 2006/232/EC of 20 December 2005 on the conclusion of the Agreement between the European Community and the United States of America on trade in wine (1), and in particular Article 3 thereof,

Whereas:

(1) Commission Regulation (EC) No 1416/2006 (2) provides for the protection of certain United States names of viticultural significance in the Union.

(2) It was agreed between the Parties in accordance with Article 11(5) of the Agreement between the European Community and the United States of America on trade in wine (3) that Annex V to that Agreement should be updated in order to reflect recent regulatory changes in the United States, and in particular newly established American viticultural areas. It was further agreed that these changes should take effect on 1 December 2011.

(3) Regulation (EC) No 1416/2006 should therefore be amended accordingly.

(4) The measures provided for in this Regulation are in accordance with the opinion of the Management Committee for the Common Organisation of Agricultural Markets,

HAS ADOPTED THIS REGULATION:

Article 1

The Annex to Regulation (EC) No 1416/2006 shall be replaced by the Annex to this Regulation.

Article 2

This Regulation shall enter into force on 1 December 2011.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
