Commission Delegated Regulation (EU) 2022/1528 of 4 July 2022 supplementing Regulation (EU) 2021/1077 of the European Parliament and of the Council with provisions on the establishment of a monitoring and evaluation framework

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 2021/1077 of the European Parliament and of the Council of 24 June 2021 establishing, as part of the Integrated Border Management Fund, the Instrument for financial support for customs control equipment (1), and in particular Article 12(2) thereof,

Whereas:

(1) The indicators for reporting on the progress of the Instrument for financial support for customs control equipment (‘the Instrument’) in achieving the general and specific objectives set out in Article 3 of Regulation (EU) 2021/1077 are listed in Annex II to that regulation.

(2) The indicators listed in Annex II to Regulation (EU) 2021/1077, while suitable for the purpose of annual monitoring of performance, are not sufficient in order to enable a comprehensive monitoring and evaluation of the Instrument’s activities and results in achieving its general and specific objectives. Therefore, additional indicators should be laid down as part of the monitoring and evaluation framework.

(3) The indicators should measure the outputs, results and impacts of the Instrument, taking into account the existing reporting and evaluation requirements established in Articles 11, 12 and 13 of Regulation (EU) 2021/1077.

(4) To ensure that data for monitoring and evaluation of the Instrument are collected efficiently, effectively and in a timely manner, proportionate reporting requirements should be imposed on the recipients of the Instrument’s funds, while minimising an administrative burden,

HAS ADOPTED THIS REGULATION:

Article 1

Monitoring and evaluation framework indicators and reporting requirements
1.

When monitoring and evaluating the Instrument in accordance with Article 12 and 13 of Regulation (EU) 2021/1077 the following indicators shall be used as part of the monitoring and evaluation framework:

(a) the indicators (2) set out in Annex II to Regulation (EU) 2021/1077,which shall measure the results of the Instrument;

(b) the indicators set out in the Annex to this Regulation, which shall measure the outputs, results and impacts of the Instrument.

The underlying data used by the Commission to measure the indicators referred to in paragraph 1 shall be provided by the recipients of the Union funds on an annual basis, when such data are available. The results obtained from the yearly reports, from Border Crossing Points and customs laboratories, should be submitted to the Commission through, but not limited to, national administrations’ annual communication, application for funding and predefined surveys addressed to them by the Commission.

The Commission shall use the information provided by the recipients of Union funds to measure the indicators referred to in paragraph 1, as part of the monitoring and evaluation framework.

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
