LegalizeCommission Implementing Decision (EU) 2023/2447 of 24 October 2023 concerning emergency measures in relation to outbreaks of highly pathogenic avian influenza in certain Member States (notified under document C(2023)7450)
Article 1
Subject matter and scope
This Decision lays down, at Union level:
- (a) the areas where, in the Member States listed in Parts A and B of the Annex to this Decision, protection and surveillance zones must be established following outbreaks of highly pathogenic avian influenza in poultry or captive birds in accordance with Article 21 of Delegated Regulation (EU) 2020/687, and the duration of the disease control measures to be applied in those zones;
- (b) the areas where, in the Member States listed in Part C of the Annex to this Decision, further restricted zones must be established following outbreaks of highly pathogenic avian influenza in poultry or captive birds in accordance with Article 21 of Delegated Regulation (EU) 2020/687, and the duration of the measures to be applied in such further restricted zones.
Article 2
Protection zones
Each Member State referred to in Part A of the Annex to this Decision shall:
- (a) establish protection zones in accordance with Article 21(1), point (a), of Delegated Regulation (EU) 2020/687 which comprise at least the areas mentioned as protection zones in Part A of the Annex to this Decision;
- (b) apply the measures required to be applied in protection zones according to Delegated Regulation (EU) 2020/687 until the date set out, for each protection zone, in Part A of the Annex to this Decision.
Article 3
Surveillance zones
Each Member State referred to in Part B of the Annex to this Decision shall:
- (a) establish surveillance zones in accordance with Article 21(1), point (b), of Delegated Regulation (EU) 2020/687 which comprise at least the areas mentioned as surveillance zones in Part B of the Annex to this Decision;
- (b) apply the measures required to be applied in surveillance zones according to Delegated Regulation (EU) 2020/687 at least until the dates set out in Part B of the Annex to this Decision.
Article 4
Further restricted zones
Each Member State referred to in Part C of the Annex to this Decision shall:
- (a) establish further restricted zones in accordance with Article 21(1), point (c), of Delegated Regulation (EU) 2020/687 which comprise at least the areas mentioned as further restricted zones in Part C of the Annex to this Decision;
- (b) apply the measures to be applied in the further restricted zones as provided for in Article 21(1), point (c), of Delegated Regulation (EU) 2020/687 until at least the dates for the further restricted zones set out in Part C of the Annex to this Decision.

This Decision is addressed to the Member States.
