Article 1

Amendments to Regulation (EU) 2019/1239

The Annex to Regulation (EU) 2019/1239 is replaced by Annex I to this Regulation.

Article 2

Establishment of the EMSWe data set

The EMSWe data set provided for under Article 3(1) of Regulation (EU) 2019/1239 is set out in Annex II to this Regulation.

Article 3

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

It shall apply from 15 August 2025.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

ANNEX I

A. Reporting obligations stemming from legal acts of the Union

This category of reporting obligations includes the information which is to be provided in accordance with the following provisions:

A1 -   Notification for ships arriving in and departing from ports of the Member States

Article 4 (1) of Directive 2002/59/EC of the European Parliament and of the Council of 27 June 2002 establishing a Community vessel traffic monitoring and information system (OJ L 208, 5.8.2002, p. 10).

A2 -   Border checks on persons

Article 19 of Regulation (EU) 2016/399 of the European Parliament and of the Council of 9 March 2016 on a Union Code on the rules governing the movement of persons across borders (Schengen Borders Code) (OJ L 77, 23.3.2016, p. 1).

A3 -   Notification of dangerous or polluting goods carried on board

Article 13 of Directive 2002/59/EC of the European Parliament and of the Council of 27 June 2002 establishing a Community vessel traffic monitoring and information system (OJ L 208, 5.8.2002, p. 10).

A4.1 -   Advance waste notification

Article 6 (1) of Directive (EU) 2019/883 of the European Parliament and the Council of 17 April 2019 on port reception facilities for the delivery of waste from ships, amending Directive 2010/65/EU and repealing Directive 2000/59/EC (OJ L 151, 7.6.2019, p. 116).

A4.2 -   Waste delivery receipt

Article 7 (3) of Directive (EU) 2019/883 of the European Parliament and the Council of 17 April 2019 on port reception facilities for the delivery of waste from ships, amending Directive 2010/65/EU and repealing Directive 2000/59/EC (OJ L 151, 7.6.2019, p. 116).

A5 -   Ship pre-arrival security information

Article 6 of Regulation (EC) No 725/2004 of the European Parliament and of the Council of 31 March 2004 on enhancing ship and port facility security (OJ L 129, 29.4.2004, p. 6).

The form set out in the Appendix to this Annex shall be used for identifying the data elements required under Article 6 of Regulation (EC) No 725/2004.

A6.1 -   Number of persons sailing on board passenger ships

Article 4 (2) of Council Directive 98/41/EC of 18 June 1998 on the registration of persons sailing on board passenger ships operating to or from ports of the Member States of the Community (OJ L 188, 2.7.1998, p. 35).

A9 -   Notification of arrival of ships eligible for an expanded inspection

Article 9 (1) of Directive 2009/16/EC of the European Parliament and of the Council of 23 April 2009 on port State control (OJ L 131, 28.5.2009, p. 57).

A10 -   Maritime transport statistics

Article 3 of Directive 2009/42/EC of the European Parliament and of the Council of 6 May 2009 on statistical returns in respect of carriage of goods and passengers by sea (OJ L 141, 6.6.2009, p. 29).

ANNEX II

SECTION 1

Introductory notes

The names, formats, and descriptions of the data elements included in this Annex are applicable in relation with the EMSWe data set referred to in Article 3 of Regulation (EU) 2019/1239.

The data elements are listed in Sections 2 and 3 per data groups. Data groups are meant for facilitating the reading and sorting of data elements.

Column with heading ‘ID’ indicates the unique identification number of the data group (starting with prefix ‘DG’) or data element (starting with prefix “DE’) within the EMSWe data set.

Column with heading ‘Name’ indicates the standard name of the data group or data element.

Column with heading ‘Description’ provides a textual description of the data element.

Column with heading ‘Format’ indicates the requirements for the data type and the data length. The codes for the data types are as follows:

a alphabetic
n numeric
an alphanumeric

The number following the code indicates the admissible data length.

The following applies:

The optional two dots before the length indicator mean that the data has no fixed length, but it can have up to a number of digits, as specified by the length indicator. A comma in the data length means that the attribute can hold decimals, the digit before the comma indicates the total length of the attribute, the digit after the comma indicates the maximum number of digits after the decimal point.

Examples of field lengths and formats:

n2 2 numeric characters, fixed length
an3 3 alphanumeric characters, fixed length
a..4 up to 4 alphabetic characters
n..5 up to 5 numeric characters

Column with heading ‘IMO Compendium’ indicates, when provided, the data element ID of the corresponding data element from the IMO Compendium on faciliation and electronic business as published by the International Maritime Organisation with reference FAL.5/ Circ.53.

Column with heading ‘UCC Annex B’ indicates, when provided, the procedure code of the corresponding data element from Annex B to Delegated Regulation (EU) 2015/2446.

Whenever the information in a data element takes the form of codes, the code list indicated in column with heading ‘Code list’ shall be applied. Code lists are either defined in Section 4, in other Union legal acts or in international standards. As regards UCC code lists, the legal reference is the Implementing Regulation (EU) 2015/2447, Annex B, Title II.

When reference to GEONOM code list is made, the codes to be used are defined by the introductory note number 13, point 3 of Annex B to Implementing Regulation (EU) 2015/2447.

Column with heading ‘Business rules’ indicates, when provided, the business rules provided in Section 5 that are applicable to the data element.

Columns in Section 3 of this Annex with headings from ‘A1’ to ‘C’ indicate in which of the reporting obligations listed in the Annex to Regulation (EU) 2019/1239 the data element is used.
