Commission Implementing Regulation (EU) 2023/2157 of 17 October 2023 amending and correcting Implementing Regulation (EU) 2022/1475 as regards the description of the budget code structure and the type and format of information to be provided for monitoring and evaluation of the CAP Strategic Plans

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 2021/2115 of the European Parliament and of the Council of 2 December 2021 establishing rules on support for strategic plans to be drawn up by Member States under the common agricultural policy (CAP Strategic Plans) and financed by the European Agricultural Guarantee Fund (EAGF) and by the European Agricultural Fund for Rural Development (EAFRD) and repealing Regulations (EU) No 1305/2013 and (EU) No 1307/2013 ¹, and in particular Article 133 and Article 134(4) thereof,

Whereas:

• (1) In point 2(a)(iv) of Annex IV to Commission Implementing Regulation (EU) 2022/1475 ², the number of digits assigned to the budget code has proved to be insufficient to fulfil the needs of the Member States regarding the number of unit amounts for CAP interventions. Consequently, to ensure clarity and coherence, the description of the budget code to be reported should remove the reference to the number of digits, and point 2(a)(iv) of that Annex should be amended accordingly.

• (2) Point 7 of Annex V to Implementing Regulation (EU) 2022/1475, provides for the annual report of market information for other sectors referred to in Article 42, point (f), of Regulation (EU) 2021/2115. In order to allow assessing the rate of organisation in the fruit and vegetables sector, the hops sector and in the olive oil and the table olives sector, which will allow a better assessment of the coverage of the common agricultural policy, data on the total area under fruit and vegetables production, under hops production and under the olive oil and the table olives production from producers organised in producer organisations, transnational producer organisations, associations of producer organisations and transnational associations of producer organisations should be collected. To ensure the collection of this data, ‘Form A.7.’ in point 7 of that Annex should be amended.

• (3) To ensure the collection of data on the budget of cross border/transnational operational groups and the total budget of operational groups other than those supported by the EAFRD, Member States should provide additional data on additional non-national financing or private contributions. Point (n)(iv) and point (p), of point 1 of Annex VI of Implementing Regulation (EU) 2022/1475 should therefore be amended.

• (4) Article 2, point (d), of Implementing Regulation (EU) 2022/1475 requires Member States to carry out, as a part of the evaluation of the CAP Strategic Plans and, where relevant, an assessment of specific interventions or topics of the CAP Strategic Plans. Point 4(b) of Annex II to that Implementing Regulation includes an erroneous reference to Article 2, point (e), of that Implementing Regulation, when it should refer to point (d) of that Article. To ensure clarity and coherence, point 4(b) of that Annex should be corrected accordingly.

• (5) Corrections of a few errors in the provisions on the labels of the variables laid down in Annexes II, IV and VI to Implementing Regulation (EU) 2022/1475 are also necessary.

• (6) Implementing Regulation (EU) 2022/1475 should therefore be amended and corrected accordingly.

• (7) The measures provided for in this Regulation are in accordance with the opinion of the Common Agricultural Policy Committee,

HAS ADOPTED THIS REGULATION:

Article 1

Amending provisions

Implementing Regulation (EU) 2022/1475 is amended as follows:

• (1) in Annex IV, point 2(a), point (iv) is replaced by the following:

• ‘(iv) M040: budget code

This field provides the budget code, which includes budget nomenclature, type of intervention, sector and subsector, output indicator, intervention, unit amount, reduction of payment or contribution rate, and calendar year;’;

• (2) in Annex V, point 7 is replaced by the following:

• ‘7. Form A.7.

This form concerns the fruit and vegetables sector, the hops sector, the olive oil and table olives sector, and the other sectors referred to in Article 42, points (a) and (d) to (f), of Regulation (EU) 2021/2115, for which Member States shall report annually the following market information for the preceding calendar year:

• (a) total area (in hectares) of fruit and vegetables production by POs, TPOs, APOs, TAPOs (excluding mushrooms);

• (b) total area (in hectares) of hops production by POs, TPOs, APOs, TAPOs;

• (c) total area (in hectares) of olive oil and table olives production by POs, TPOs, APOs, TAPOs;

• (d) for other sectors:

• — for crop sectors referred to in Article 1(2), points (a) to (e), (h), (k), and (m), of Regulation (EU) No 1308/2013 and the sectors covering products listed in Annex VI to Regulation (EU) 2021/2115, the total area (in hectares) covered and/or volume (in tonnes) produced by POs, TPOs, APOs and TAPOs;

• — for livestock sectors referred to in Article 1(2), points (o) to (t), and (w), of Regulation (EU) No 1308/2013 and the sectors covering products listed in Annex VI to Regulation (EU) 2021/2115, the total number of animals and/or volume (in tonnes) produced by POs, TPOs, APOs, and TAPOs.’;

• (3) in Annex VI, point 1, is amended as follows:

• (a) in point (n), point (iv), is replaced by the following:

• ‘(iv) budget per Member State(s)/region(s) which form part of the project, in public expenditure, summing all contributions (EAFRD, national co-financing, additional national financing and other financing, if applicable);’;

• (b) point (p) is replaced by the following:

• ‘(p) total budget: total project contributions (EAFRD, national co-financing, additional national financing and other financing, if applicable)’.

Article 2

Correcting provisions

Implementing Regulation (EU) 2022/1475 is corrected as follows:

• (1) in Annex II, point 4, point (b) is replaced by the following:

• ‘(b) where relevant, the evaluations to assess specific topics referred to in Article 2, point (d);’;

• (2) Annex IV is corrected as follows:

• (a) in point 2(b), point (i), the heading ‘M050: total amount paid (EU funds)’ is replaced by the following:

‘M050: total EU funds amount’;

• (b) in point 4(a), the heading ‘B010: unique beneficiary ID’ is replaced by the following:

‘B010: unique beneficiary identifier’;

• (3) in Annex VI, point 1, point (i) is replaced by the following:

• ‘(i) project status: ongoing, completed, cancelled;’.

Article 3

Entry into force

This Regulation shall enter into force on the seventh day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
