THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1151/2012 of the European Parliament and of the Council of 21 November 2012 on quality schemes for agricultural products and foodstuffs 1, and in particular Article 52(2) thereof,
Whereas:
- (1) In accordance with Article 5(2) of Regulation (EU) 2021/2117 of the European Parliament and of the Council 2, the rules applicable before 7 December 2021 continue to apply to applications for approval of amendments to a product specification received by the Commission pursuant to Regulation (EU) No 1151/2012 before 8 June 2022.
- (2) On 25 May 2022, the Commission received from Austria an application for the approval of amendments to the product specification for the protected geographical indication ‘Marchfeldspargel’, registered under Commission Regulation (EC) No 1263/96 3, as amended by Regulation (EC) No 564/2002 4.
- (3) The Commission has examined Austria’s application in accordance with Article 50(1) of Regulation (EU) No 1151/2012 in conjunction with the first subparagraph of Article 53(1) of that Regulation, as applicable before 7 December 2021.
- (4) Since the amendments in question are not minor within the meaning of Article 53(2) of Regulation (EU) No 1151/2012, as applicable before 7 December 2021, the Commission published the amendment application in the Official Journal of the European Union 5 as required by Article 50(2)(a) of that Regulation.
- (5) As no reasoned statement of opposition under Article 51 of Regulation (EU) No 1151/2012 has been received by the Commission, the amendments to the product specification should be approved,
HAS ADOPTED THIS REGULATION:
Article 1
The amendments to the product specification published in the Official Journal of the European Union regarding the protected geographical indication ‘Marchfeldspargel’ are hereby approved.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

Commission Regulation (EC) No 564/2002 of 2 April 2002 amending the specification of two names appearing in the Annex to Regulation (EC) No 1107/96 on the registration of geographical indications and designations of origin under the procedure laid down in Article 17 of Council Regulation (EEC) No 2081/92 on the protection of geographical indications and designations of origin for agricultural products and foodstuffs, and amending the specification of a name appearing in the Annex to Regulation (EC) No 2400/96 on the entry of certain names in the Register of protected designations of origin and protected geographical indications provided for in Council Regulation (EEC) No 2081/92 (Marchfeldspargel/Baena/Lammefjordsgulerod) (OJ L 86, 3.4.2002, p. 7).
