Commission Regulation (EU) 2024/264 of 17 January 2024 amending Regulation (EC) No 1099/2008 of the European Parliament and of the Council on energy statistics, as regards the implementation of updates for the annual, monthly and short-term monthly energy statistics

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 1099/2008 of the European Parliament and of the Council of 22 October 2008 on energy statistics (1), and in particular Article 4(3), Article 5(3) and Article 9(2) thereof,

Whereas:

(1) Regulation (EC) No 1099/2008 establishes a common framework for the production, transmission, evaluation and dissemination of comparable energy statistics in the Union.

(2) Energy statistics need to be regularly reviewed due to the fast pace of technological progress, developments in Union energy policies and the importance of basing Union targets and the monitoring of progress towards them on official energy data. Regular updates must therefore be made to the European energy statistics reporting framework, to reflect growing or changing needs.

(3) Using reliable high-quality energy statistics to monitor policy targets under the European Green Deal, and the Fit for 55 and Energy Union packages should enhance the credibility of Union energy policy.

(4) The Commission has identified several aspects of the annual, monthly and short-term monthly energy statistics that need to be updated. They concern notably additional reporting requirements for hydrogen and its relationship to other fuels that provide a more comprehensive overview of the hydrogen economy; definitions on the nuclear industry and the use of hard coal that give greater clarity to reported data; the change in the fuel oil sulfur content categories that follow international classifications and more details for hydropower reporting that improve the assessment of this energy source.

(5) Regulation (EC) No 1099/2008 should therefore be amended accordingly.

(6) The measures provided for in this Regulation are in accordance with the opinion of the European Statistical System Committee, established by Article 7 of Regulation (EC) No 223/2009 of the European Parliament and of the Council (2),

HAS ADOPTED THIS REGULATION:

Article 1

The Annexes to Regulation (EC) No 1099/2008 are replaced by the text in the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the twentieth day following its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
