Commission Implementing Regulation (EU) 2025/458 of 10 March 2025 correcting certain language versions of Implementing Regulation (EU) 2019/773 on the technical specification for interoperability relating to the operation and traffic management subsystem of the rail system within the European Union

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Directive (EU) 2016/797 of the European Parliament and of the Council of 11 May 2016 on the interoperability of the rail system within the European Union (1), and in particular Article 5(11) thereof,

Whereas:

(1) The Croatian, Dutch, French, German, Lithuanian, Maltese, Portuguese, Romanian and Swedish language versions of the Annex to Commission Implementing Regulation (EU) 2019/773 (2) contain an error in Appendix B2, rule 8.2, second subparagraph, as regards the obligation of the driver. The error affects the substance of that provision.

(2) The Croatian, Dutch, French, German, Lithuanian, Maltese, Portuguese, Romanian and Swedish language versions of the Annex to Implementing Regulation (EU) 2019/773 contain an error in Appendix C2, point 3, third paragraph, as regards the delivery of the operational instruction. The error affects the substance of that provision.

(3) The Dutch language version of the Annex to Implementing Regulation (EU) 2019/773 contains errors in point 4.7.1.1, first paragraph; in Appendix A, point 4.2, table 1, the definition of ‘trip’; in Appendix A, point 6.36.2(ii); in Appendix A, point 7.13.2, second paragraph; in Appendix B2, point 18; in Appendix C1, point 2.4; in Appendix C2, point 1(7); in Appendix C2, point 6, the title of the form ‘European Instruction 7’ and in Appendix D1, table, the second row concerning ‘ETCS’, sixth column. The errors were introduced by Commission Implementing Regulation (EU) 2023/1693 (3) and affect the substance of those provisions.

(4) The French language version of the Annex to Implementing Regulation (EU) 2019/773 contains an error in point 4.2.2.5.1, point (B), third paragraph, point (c), first paragraph, as regards one of the parameters relevant for route compatibility; as well as an error in Appendix A, point 3.1, third and fourth paragraphs, as regards the references to ETCS level 1 and ETCS level 2 in that Appendix. The errors were introduced by Implementing Regulation (EU) 2023/1693 and affect the substance of those provisions.

(5) The Croatian, Dutch, French, German, Lithuanian, Maltese, Portuguese, Romanian and Swedish language versions of Implementing Regulation (EU) 2019/773 should therefore be corrected accordingly. The other language versions are not affected.

(6) The measures provided for in this Regulation are in accordance with the opinions of the Committee established in accordance with Article 51(1) of Directive (EU) 2016/797, which were delivered prior to the adoption of Implementing Regulation (EU) 2019/773 and Implementing Regulation (EU) 2023/1693,

HAS ADOPTED THIS REGULATION:

Article 1

(Does not concern the English language.)

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
