Commission Implementing Regulation (EU) 2025/713 of 14 April 2025 operating deductions from fishing effort available to Italy in 2024 on account of overfishing in the previous year
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EC) No 1224/2009 of 20 November 2009 establishing a Union control system for ensuring compliance with the rules of the common fisheries policy, amending Regulations (EC) No 847/96, (EC) No 2371/2002, (EC) No 811/2004, (EC) No 768/2005, (EC) No 2115/2005, (EC) No 2166/2005, (EC) No 388/2006, (EC) No 509/2007, (EC) No 676/2007, (EC) No 1098/2007, (EC) No 1300/2008, (EC) No 1342/2008 and repealing Regulations (EEC) No 2847/93, (EC) No 1627/94 and (EC) No 1966/2006 (1), and in particular Article 106(1), (2) and (3) thereof,
Whereas:
(1) Fishing effort opportunities for the year 2023 have been established by Council Regulation (EU) 2023/195 (2).
(2) Fishing effort opportunities for the year 2024 have been established by Council Regulation (EU) 2024/259 (3).
(3) Pursuant to Article 106(1) of Regulation (EC) No 1224/2009, when the Commission has established that a Member State has exceeded the fishing effort which has been allocated to it, the Commission is to operate deductions from the future fishing effort allocated to that Member State.
(4) Article 106(2) of Regulation (EC) No 1224/2009 provides that such deductions are to be operated in the following year or years by applying the respective multiplying factors as set out therein.
(5) Italy has exceeded the maximum allowable fishing effort allocated to it for the year 2023 for Type 10 length bottom trawl vessels targeting European hake in the General Fisheries Commission for the Mediterranean (GFCM) geographical subareas 12, 13, 14, 15 and 16 (EFF4/MED4_OTB2) and for demersal longliners targeting European hake in the GFCM geographical subareas 8, 9, 10 and 11 (EFF1/MED2_LL3).
(6) Deductions should therefore be operated on the fishing effort allocated to Italy in 2024 for the overfished fishing effort in the areas and fisheries concerned.
(7) However, the fishing effort available to Italy in 2024 for Type 10 length bottom trawl vessels targeting European hake in the GFCM geographical subareas 12, 13, 14, 15 and 16 (EFF4/MED4_OTB2) is not available to operate the due deduction on the fishing effort in the same area and fishery concerned.
(8) Article 106(3) of Regulation (EC) No 1224/2009 provides that if the deduction cannot be operated on the fishing effort that was exceeded because such fishing effort is not or not sufficiently available to the Member State concerned, the Commission may deduct in the following year or years fishing effort available to that Member State in the same geographical area.
(9) It is therefore appropriate to operate the deduction from fishing effort allocated to Italy for Type 11 length bottom trawl vessels targeting European hake in the GFCM geographical subareas 12, 13, 14, 15 and 16 (EFF4/MED4_OTB3).
(10) Italy has been informed and consulted about the Commission’s intention to operate the deduction from this alternative fishing effort allocated to that Member State in 2024 in the same geographical area.
(11) Further updates or corrections may still occur following the detection, for the current or previous deduction exercises, of errors, omissions or misreporting in the fishing effort deployment data declared by Italy pursuant to Article 33 of Regulation (EC) No 1224/2009,
HAS ADOPTED THIS REGULATION:
Article 1
The fishing effort opportunities fixed for the year 2024 in Regulation (EU) 2024/259 shall be reduced as set out in the Annexes to this Regulation.
Article 2
This Regulation shall enter into force on the seventh day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
