THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 2016/2031 of the European Parliament and of the Council of 26 October 2016 on protective measures against pests of plants, amending Regulations (EU) No 228/2013, (EU) No 652/2014 and (EU) No 1143/2014 of the European Parliament and of the Council and repealing Council Directives 69/464/EEC, 74/647/EEC, 93/85/EEC, 98/57/EC, 2000/29/EC, 2006/91/EC and 2007/33/EC (1), and in particular Articles 30(1) and 41(2) thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2022/1372 (2) provides for temporary measures to prevent the entry into, the movement and spread within, the multiplication and release in the Union of Meloidogyne graminicola (Golden & Birchfield) (the ‘specified pest’).

(2) Those measures have proven effective to prevent the introduction into, the movement and spread within, the multiplication and release in the Union territory of the specified pest, as it has not been found present in any areas of the Union other than those where it was already present at the time of the entry into force of Implementing Regulation (EU) 2022/1372.

(3) Within the Union territory, the pest is only present in Italy. Surveys carried out by the Italian authorities in the containment areas have shown that the population of the specified pest has significantly decreased within the second year after the year of entry into force of Implementing Regulation (EU) 2022/1372. However its presence requires continued efforts in order to make sure that the incipient decrease of the populations of the specified pest will persist in future.

(4) In the light of these results, the effect of the measures provided for by Implementing Regulation (EU) 2022/1372 should be further monitored, for an additional year. This will allow a more thorough evaluation of their effects on the populations of the specified pest present in the Union territory. On the basis of that evaluation it may be decided whether the temporary measures laid down in Implementing Regulation (EU) 2022/1372 are sufficiently effective or would require some further revision.

(5) It is therefore appropriate that those measures apply until 30 June 2026.

(6) Implementing Regulation (EU) 2022/1372 should therefore be amended accordingly.

(7) The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS REGULATION:

Article 1

Amendment of Implementing Regulation (EU) 2022/1372

In the second paragraph of Article 12 of Implementing Regulation (EU) 2022/1372, the date ‘30 June 2025’ is replaced by ‘30 June 2026’.

Article 2

Entry into force

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
