Commission Delegated Regulation (EU) 2025/1124 of 19 March 2025 correcting Delegated Regulation (EU) 2018/273 as regards the import of wine originating in Canada

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007 (1), and in particular Article 89, point (a), and Article 147(3), point (a), thereof,

Whereas:

(1) Commission Delegated Regulation (EU) 2018/273 (2) supplements Regulation (EU) No 1308/2013 as regards the accompanying documents for release of imported wine products into free circulation in the Union.

(2) According to Article 23 of the Agreement between the European Community and Canada on trade in wines and spirit drinks (3) (‘the Agreement’), wine originating in Canada, which is produced under the supervision and control of one of the competent bodies listed in Annex VI to the Agreement, may be imported in accordance with the simplified certification provisions provided for under Union rules.

(3) According to Article 23(2) of the Agreement, individual producers may draw up and sign the certification document where they are authorised to do so by one of the competent bodies.

(4) Commission Delegated Regulation (EU) 2019/840 (4) amended Delegated Regulation (EU) 2018/273 in order to implement Article 23 of the Agreement by allowing the use of the simplified procedure referred to in Article 26 of that Delegated Regulation for the import of wines originating in Canada into the Union. By means of this amendment, Canada was included in the list of third countries where wine producers may draw up and sign the certification document.

(5) However, the use of the simplified procedure for the certification of imported products of the wine sector is not limited to the provision laid down in Article 26 of Delegated Regulation (EU) 2018/273. It also concerns the provision laid down in Article 21, point (b), of that Delegated Regulation, which allows for the submission of a simplified version of the analysis report section of the VI-1 document for the import of wines originating from the list of third countries where wine producers may draw up and sign the certification document, that are put up in labelled containers of a capacity not exceeding 60 litres, fitted with non-reusable closing devices.

(6) In order to correctly implement Article 23 of the Agreement, Delegated Regulation (EU) 2018/273 should be corrected to include a provision allowing also the use of the simplified procedure laid down in Article 21, point (b), of that Delegated Regulation for the import of wines originating in Canada into the Union.

(7) Delegated Regulation (EU) 2018/273 should therefore be corrected accordingly.

(8) Any further delay in the correct implementation of Article 23 of the Agreement would also delay use of the simplified analysis report section of the VI-1 document for the import of wine from Canada. Therefore, this Regulation should enter into force on the day following that of its publication in the Official Journal of the European Union,

HAS ADOPTED THIS REGULATION:

Article 1

In Annex VII to Delegated Regulation (EU) 2018/273, in Part IV, Section A is replaced by the following:

Article 2

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
