Commission Implementing Regulation (EU) 2025/2581 of 18 December 2025 amending Implementing Regulation (EU) 2025/2144 making imports of pea protein originating in the People’s Republic of China subject to registration
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protection against dumped imports from countries not members of the European Union (1) and in particular Article 14(5) thereof,
After informing the Member States,
Whereas:
(1) On 29 August 2025, the European Commission (‘the Commission’) published a notice initiating an anti-dumping investigation concerning imports of pea protein originating in the People’s Republic of China (2) (the ‘Notice of 29 August 2025’).
(2) On 21 October 2025, by Commission Implementing Regulation (EU) 2025/2144 (3), the Commission made imports of pea protein originating in the People’s Republic of China subject to registration.
(3) During the investigation, a number of Member States and interested parties brought to the Commission’s attention the fact that the product under investigation can be classified under certain Combined Nomenclature (‘CN’) codes that were not mentioned in the notice of 29 August 2025. The Commission amended the Notice of 29 August 2025 to add those CN codes and the corresponding TARIC codes.
(4) Imports under those CN and TARIC codes should also be subject to registration. Therefore, Article 1 of Implementing Regulation (EU) 2025/2144 should be amended,
HAS ADOPTED THIS REGULATION:
Article 1
Article 1 of Implementing Regulation (EU) 2025/2144 shall be replaced as follows:
‘Article 1
The customs authorities are hereby directed, under Article 14(5) of Regulation (EU) 2016/1036, to take the appropriate steps to register imports into the Union of high protein content pea protein, which contains more than 65 percent protein on a dry weight basis, encompassing all types of pea protein derived from peas (including, but not limited to, yellow field peas and green field peas), in all physical forms (including solid (e.g. powder) and liquid (solution) forms), whether textured or not, currently falling within CN codes:

— ex 2106 90 92 (TARIC codes 2106 90 92 75),

Article 2
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
