Commission Implementing Regulation (EU) 2026/387 of 23 February 2026 establishing the format of the European technical assessment pursuant to Regulation (EU) 2024/3110 of the European Parliament and of the Council
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2024/3110 of the European Parliament and of the Council of 27 November 2024 laying down harmonised rules for the marketing of construction products and repealing Regulation (EU) No 305/2011 (1), and in particular Article 37(4) thereof,
Whereas:
(1) Article 37(3) of Regulation (EU) 2024/3110 establishes requirements for the content of the European technical assessment (‘ETA’). Since the technical details necessary for the implementation of the assessment and verification systems that are to be applied are set out in the applicable European assessment document (‘EAD’), the ETA should contain only the necessary additional technical details for the implementation of the assessment and verification systems which are not included in the EAD.
(2) ETA format should be adapted to present the relevant information in accordance with the elements provided in the applicable EAD. It should also be consistent with the guidelines to ensure interoperability of the human and machine-readable formats for the declaration of performance and conformity developed in accordance with Article 35(2) point (c) of Regulation (EU) 2024/3110. Those technical details should be set out in a general and a specific part of the ETA, with the general part covering identification and administrative information and the specific part covering technical information, in order to ensure a clear, structured and harmonised presentation of that information.
(3) In order to protect confidential technical information on the product, the manufacturer should be able to indicate to the responsible technical assessment body which parts of the product description are confidential and are not be disclosed together with the ETA. Confidential information should be included in separate Annexes to the ETA.
(4) The organisation for technical assessments established in accordance with Article 41(1) of Regulation (EU) 2024/3110 and the Construction Products Regulation (‘CPR’) Acquis Expert Group established by Article 4(1) of that Regulation have been consulted.
(5) The measures provided for in this Regulation are in accordance with the opinion of the Committee on Construction Products established by Article 90 of Regulation (EU) 2024/3110,
HAS ADOPTED THIS REGULATION:
Article 1
The format of the European technical assessment is set out in the Annex.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
