THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protection against dumped imports from countries not members of the European Union (1), and in particular Article 9(1) thereof,

Having regard to Regulation (EU) 2016/1037 of the European Parliament and of the Council of 8 June 2016 on protection against subsidised imports from countries not members of the European Union (2) and in particular Article 14(1) thereof,

Whereas:

(1) Certain imports of biodiesel originating in United States of America are subject to definitive anti-dumping and countervailing duties imposed by Commission Implementing Regulations (EU) 2021/1266 (3) and (EU) 2021/1267 (4).

(2) Following two anti-circumvention investigations concluded in 2011, the measures were extended by Council Implementing Regulation (EU) No 444/2011 (5) to imports of biodiesel consigned from Canada and Council Implementing Regulation (EU) No 443/2011 (6).

(3) On 17 March 2025 KD Pharma Canada Ltd informed the Commission that DSM Nutritional Products Canada Inc., (TARIC (7) additional code C114), a company subject to an exemption of the individual anti-dumping duty rate of EUR 172,2 per tonne net, had changed its name to KD Pharma Canada Ltd and requested DSM Nutritional Products Canada Inc. to transfer its TARIC additional code C114 to the former.

(4) According to the information provided, it appeared that DSM Nutritional Products Canada Inc., continued to exist as a singular entity in its current form, under the same name.

(5) After carrying out an examination of the request, on 8 January 2026, the Commission informed KD Pharma Canada Ltd by letter of its intention to reject the request on the ground that the request did not constitute a case for a change of company name.

(6) The Commission rejected this request on the ground that only companies with clearly verified continuity in law, structure and operations can have their names updated in the Regulation.

(7) On 8 January 2026, the Commission disclosed its findings to KD Pharma Canada Ltd and invited the company to provide comments. No comments were received.

(8) The measures provided for in this Regulation are in accordance with the opinion of the Committee established by Article 15(1) of Regulation (EU) 2016/1036,

HAS ADOPTED THIS REGULATION:

Article 1

Article 2 (1) of Implementing Regulations (EU) 2021/1266 and (EU) 2021/1267 are amended as follows:

is removed.

Article 2

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

(5) Council Implementing Regulation (EU) No 444/2011 of 5 May 2011 extending the definitive anti-dumping duty imposed by Regulation (EC) No 599/2009 on imports of biodiesel originating in the United States of America to imports of biodiesel consigned from Canada, whether declared as originating in Canada or not, and extending the definitive anti-dumping duty imposed by Regulation (EC) No 599/2009 to imports of biodiesel in a blend containing by weight 20 % or less of biodiesel originating in the United States of America, and terminating the investigation in respect of imports consigned from Singapore (OJ L 122, 11.5.2011, p. 12, ELI: http://data.europa.eu/eli/reg_impl/2011/444/oj).

(6) Council Implementing Regulation (EU) No 443/2011 of 5 May 2011 extending the definitive countervailing duty imposed by Regulation (EC) No 598/2009 on imports of biodiesel originating in the United States of America to imports of biodiesel consigned from Canada, whether declared as originating in Canada or not, and extending the definitive countervailing duty imposed by Regulation (EC) No 598/2009 to imports of biodiesel in a blend containing by weight 20 % or less of biodiesel originating in the United States of America, and terminating the investigation in respect of imports consigned from Singapore (OJ L 122, 11.5.2011, p. 1, ELI: http://data.europa.eu/eli/reg_impl/2011/443/oj).
