Authorizes States, subject to the provisions of para?graph 2 below, to permit, notwithstanding the provisions of paragraph 3 (c) of resolution 661 (1990), the export to Iraq 2159 ΠΕΡΙΕΧΟΜΕΝΑ ΑΠΟΦΑΣΕΙΣ Committee established by resolution 661 (1990), or a pan?el of experts appointed by that Committee for this purpose, to approve contracts for the parts and equipment referred to in paragraph 1 above according to lists of parts and equipment approved by that Committee for each individu?al project;

Decides that the funds in the escrow account pro?duced pursuant to resolution 1153 (1998) up to a total of 300 million United States dollars may be used to meet any reasonable expenses, other than expenses payable in Iraq, which follow directly from contracts approved in ac?cordance with paragraph 2 above;

Decides also that the expenses directly related to such exports may, until the necessary funds are paid into the es?crow account, and following approval of each contract, be financed by letters of credit drawn against future oil sales, the proceeds of which are to be deposited in the escrow ac?count;

Notes that the distribution plan approved by the Sec?retary-General on 29 May 1998, or any new distribution plan agreed by the Government of Iraq and the Secretary?General, will remain in effect, as required, for each subse?quent periodic renewal of the temporary humanitarian ar?rangements for Iraq and that, for this purpose, the plan will be kept under constant review and amended as necessary through the agreement of the Secretary-General and the Government of Iraq and in a manner consistent with reso?lution 1153 (1998);

Expresses its gratitude to the Secretary-General for making available to the Committee established by reso?lution 661 (1990) a comprehensive review, with comments by the group of experts established pursuant to paragraph 12 of resolution 1153 (1998), of the list of parts and equip?ment presented by the Government of Iraq, and requests the Secretary-General, in accordance with the intention ex?pressed in his letter of 15 April 1998, to provide for the mon?itoring of the parts and equipment inside Iraq;

Decides to remain seized of the matter. ΑΠΟΦΑΣΗ 1175 (1998) που υιοθετήθηκε από το Συμβούλιο Ασφαλείας κατά την 3893η συνεδρίασή του στις 19 Ιουνίου 1998 Το Συμβούλιο Ασφαλείας, Υπενθυμίζοντας τις προηγούμενες σχετικές αποφάσεις του και ιδιαίτερα τις αποφάσεις του 986 (1995) της 14ης Απριλίου 1995, 1111 (1997) της 4ης Ιουνίου 1997, 1129 (1997) της 12ης Σεπτεμβρίου 1997, 1143 (1997) της 4ης Δεκεμβρίου 1997, 1153 (1998) της 20ής Φεβρουαρίου 1998 και 1158 (1998) της 25ης Μαρτίου 1998, Χαιρετίζοντας την επιστολή του Γενικού Γραμματέα της 15ης Απριλίου 1998 (S/1998/330) όπου επισυνάπτεται η περίληψη της έκθεσης της ομάδας εμπειρογνωμόνων που δημιουργήθηκε σύμφωνα με την παράγραφο 12 της απόφασης 1153 (1998) και επισημαίνοντας την εκτίμηση ότι, υπό τις υφιστάμενες συνθήκες, το Ιράκ δεν μπορεί να εξάγει πετρέλαιο ή πετρελαϊκά προϊόντα επαρκή για την κάλυψη του συνολικού ποσού των 5.256 δισεκατομμυ?ρίων δολαρίων Ηνωμένων Πολιτειών που αναφέρεται στην απόφαση 1153 (1998), Χαιρετίζοντας την επιστολή του Γενικού Γραμματέα της 29ης Μαΐου 1998 (S/1998/446) όπου εκφράζει την συναί?νεση του για το σχέδιο διανομής που υποβλήθηκε από την Κυβέρνηση του Ιράκ, Πεπεισμένο για την ανάγκη συνέχισης του προγράμμα?τος που εγκρίθηκε με την απόφαση 1153 (1998) ως προ?σωρινό μέτρο για την αντιμετώπιση των ανθρωπιστικών αναγκών του λαού του Ιράκ έως την εκπλήρωση εκ μέ?ρους της Κυβέρνησης του Ιράκ των σχετικών αποφάσε?ων, συμπεριλαμβανομένης κυρίως της απόφασης 687 (1991) της 3ης Απριλίου 1991, επιτρέπει στο Συμβούλιο να λάβει περαιτέρω σχετικά με τις απαγορεύσεις που αναφέρονται στην απόφαση 661 (1990) της 6ης Αυγού?στου 1990 σύμφωνα με τις διατάξεις των εν λόγω αποφά?σεων, Επανεπιβεβαιώνοντας ότι ενέκρινε, στην παράγραφο 5 της απόφασης 1153 (1998), τις συστάσεις του Γενικού Γραμματέα που περιέχονται στην έκθεσή του της 1ης Φε?βρουαρίου 1998 (S/1998/90) σχετικά με ένα βελτιωμένο και διαρκές σχέδιο διανομής βάσει προγράμματος, Επανεπιβεβαιώνοντας επίσης την προσήλωση όλων των Κρατών Μελών στην κυριαρχία και την εδαφική ακε?ραιότητα του Ιράκ, Ενεργώντας σύμφωνα με το Κεφάλαιο VII του Χάρτη των Ηνωμένων Εθνών,

Εξουσιοδοτεί τα Κράτη, υπό την επιφύλαξη των δια?τάξεων της παραγράφου 2 κατωτέρω, να επιτρέψουν, πα?ρά τις διατάξεις της παραγράφου 3 (γ) της απόφασης 661 (1990), την εξαγωγή στο Ιράκ των απαραίτητων εξαρτη?μάτων και εξοπλισμού για να μπορέσει το Ιράκ να αυξήσει την εξαγωγή πετρελαίου και πετρελαϊκών προϊόντων, σε ποσότητες επαρκείς για την κάλυψη του ποσού που κα?θορίζεται στην παράγραφο 2 της απόφασης 1153 (1998),

Ζητά από την Επιτροπή που δημιουργήθηκε σύμφω?να με την απόφαση 661 (1990), ή από ομάδα εμπειρογνω?μόνων που θα διορίσει η εν λόγω Επιτροπή για το σκοπό αυτό, να εγκρίνει συμβάσεις για τα εξαρτήματα και τον εξοπλισμό που αναφέρονται στην παράγραφο 1 ανωτέρω σύμφωνα με τους καταλόγους εξαρτημάτων και εξοπλι?σμού που εγκρίνει η εν λόγω Επιτροπή για κάθε μεμονω?μένο πρόγραμμα,

Αποφασίζει ότι τα κεφάλαια που κατατέθηκαν στον μεσεγγυητικό λογαριασμό σύμφωνα με την απόφαση 1153 (1998) θα μπορούν να χρησιμοποιηθούν, έως το συ?νολικό ποσό των 300 εκατομμυρίων δολαρίων Ηνωμένων Πολιτειών για την αντιμετώπιση κάθε εύλογης δαπάνης, εκτός των δαπανών που εξοφλούνται στο Ιράκ, οι οποίες απορρέουν άμεσα από τις συμβάσεις που εγκρίνονται σύμφωνα με την παράγραφο 2 ανωτέρω,

Αποφασίζει επίσης ότι οι δαπάνες που συνδέονται άμεσα με τις εν λόγω εξαγωγές μπορούν, έως ότου κατα?βληθούν τα απαραίτητα κεφάλαια στον μεσεγγυητικό λο?γαριασμό, και μετά την έγκριση κάθε σύμβασης, να χρη?ματοδοτηθούν με εγγυητικές επιστολές έναντι μελλοντι?κών πωλήσεων πετρελαίου, τα έσοδα των οποίων θα κατατεθούν στον μεσεγγυητικό λογαριασμό, 2160 ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ (ΤΕΥΧΟΣ ΠΡΩΤΟ) διακανονισμών για το Ιράκ και ότι, για το σκοπό αυτό, το σχέδιο θα υπόκειται σε συνεχή αναθεώρηση και θα τρο?ποποιείται ανάλογα με τις ανάγκες μέσω συμφωνίας του Γενικού Γραμματέα και της Κυβέρνησης του Ιράκ και με τρόπο σύμφωνο με την απόφαση 1153 (1998),

Εκφράζει την ευγνωμοσύνη του προς τον Γενικό Γραμματέα επειδή διέθεσε στην Επιτροπή που ιδρύθηκε σύμφωνα με την απόφαση 661 (1990) μια πλήρη ανασκό?πηση, με σχόλια από την ομάδα εμπειρογνωμόνων που δημιουργήθηκε σύμφωνα με την παράγραφο 12 της από?φασης 1153 (1998), του καταλόγου των εξαρτημάτων και εξοπλισμού που έδωσε η Κυβέρνηση του Ιράκ, και ζητά από τον Γενικό Γραμματέα, σύμφωνα με την πρόθεση που εκφράζεται στην επιστολή του της 15ης Απριλίου 1998, να φροντίσει για την καταγραφή των εξαρτημάτων και του εξοπλισμού εντός του Ιράκ,

Ο ΥΠΟΥΡΓΟΣ ΕΞΩΤΕΡΙΚΩΝ Έχοντας υπόψη: Την διάταξη του άρθρου 1 του Α.Ν. 92 της 3/10.8.67 «πε?ρί εφαρμογής αποφάσεων του Συμβουλίου Ασφαλείας Συνελεύσεως», προβαίνουμε: Στην δημοσίευση της αποφάσεως 1210(1998) του Συμ?βουλίου Ασφαλείας των Ηνωμένων Εθνών η οποία είναι, δυνάμει του άρθρου 25 του Χάρτη των Ηνωμένων Εθνών που κυρώθηκε με τον Α.Ν. 585/1954, υποχρεωτική για τα κράτη μέλη του Οργανισμού και παραγγέλλουμε την αυ?στηρή τήρηση και συμμόρφωση προς τις διατάξεις της απόφασης αυτής. RESOLUTION 1210 (1998) Adopted by the Security Council at its 3946th meeting, on 24 November 1998 The Security Council, Recalling its previous relevant resolutions and in partic?ular its resolutions 986 (1995) of 14 April 1995, 1111 (1997) of 4 June 1997, 1129 (1997) of 12 September 1997, 1143 (1997) of 4 December 1997, 1153 (1998) of 20 February 1998 and 1175 (1998) of 19 June 1998, Convinced of the need as a temporary measure to con?tinue to provide for the humanitarian needs of the Iraqi peo?ple until the fulfilment by the Government of Iraq of the rel?evant resolutions, including notably resolution 687 (1991) of 3 April 1991, allows the Council to take further action with regard to the prohibitions referred to in resolution 661 (1990) of 6 August 1990, in accordance with the provisions of those resolutions, Welcoming the positive impact of the relevant reso?lutions on the humanitarian situation in Iraq as described in the report of the Secretary-General dated 19 November 1998 (S/1998/1100), Reaffirming the commitment of all Member States to the sovereignty and territorial integrity of Iraq, Acting under Chapter VII of the Charter of the United Nations,

Decides that the provisions of resolution 986 (1995), except those contained in paragraphs 4, 11 and 12, shall remain in force for a new period of 180 days beginning at 00.01 hours, Eastern Standard Time, on 26 November 1998;

Further decides that paragraph 2 of resolution 1153 (1998) shall remain in force and shall apply to the 180-day period referred to in paragraph 1 above;

Directs the Committee established by resolution 661 (1990) to authorize, on the basis of specific requests, reasonable expenses related to the Hajj pilgrimage, to be met by funds in the escrow account;

Requests the Secretary-General to continue to take the actions necessary to ensure the effective and efficient implementation of this resolution, and to review, by 31 De?cember 1998, the various options to resolve the difficulties encountered in the financial process, referred to in the Sec?retary-General's report of 19 November 1998 (S/1998/ 1100), and to continue to enhance as necessary the United Nations observation process in Iraq in such a way as to provide the required assurance to the Council that the goods produced in accordance with this resolution are dis?tributed equitably and that all supplies authorized for pro?curement, including dual usage items and spare parts, are utilized for the purpose for which they have been au?thorized;

Further decides to conduct a thorough review of all as?pects of the implementation of this resolution 90 days after the end of the 180-day period, on receipt of the reports re?ferred to in paragraphs 6 and 10 below, and expresses its appropriate, provided that the said reports indicate that those provisions are being satisfactorily implemented;

Requests the Secretary-General to report to the Coun?cil 90 days after the date of entry into force of paragraph 1 above, and again prior to the end of the 180-day period, on the basis of observations of United Nations personnel in ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ (ΤΕΥΧΟΣ ΠΡΩΤΟ) 2161 supplies for essential civilian needs, financed in accor?dance with paragraph 8 (a) of resolution 986 (1995), in?cluding in his reports any observations which he may have on the adequacy of the revenues to meet Iraq's humanitar?ian needs, and on Iraq's capacity to export sufficient quan?tities of petroleum and petroleum products to produce the sum referred to in paragraph 2 of resolution 1153 (1998);

Requests the Secretary-General to report to the Coun?cil if Iraq is unable to export petroleum and petroleum prod?ucts sufficient to produce the total sum provided for in paragraph 2 above and, following consultations with rel?evant United Nations agencies and the Iraqi authorities, make recommendations for the expenditure of the sum expected to be available, consistent with the priorities es?tablished in paragraph 2 of resolution 1153 (1998) and with the distribution plan referred to in paragraph 5 of resolution 1175 (1998);

Decides that paragraphs 1, 2, 3 and 4 of resolution 1175 (1998) shall remain in force and shall apply to the new 180-day period referred to in paragraph 1 above;

Requests the Secretary-General, in consultation with the Government of Iraq, to submit to the Council, by 31 De?cember 1998, a detailed list of parts and equipment nec?essary for the purpose described in paragraph 1 of reso?lution 1175 (1998);

Requests the Committee established by resolution 661 (1990), in close coordination with the Secretary-Gen?eral, to report to the Council 90 days after the entry into force of paragraph 1 above and again prior to the end of the 80-day period on the implementation of the arrangements in paragraphs 1, 2, 6, 8, 9 and 10 of resolution 986 (1995);

Urges all States, and in particular the Government of Iraq, to provide their full cooperation in the effective imple?mentation of this resolution;

Appeals to all States to continue to cooperate in the timely submission of applications and the expeditious is?sue of export licences, facilitating the transit of humanitari?an supplies authorized by the Committee established by resolution 661 (1990), and to take all other appropriate measures within their competence in order to ensure that urgently required humanitarian supplies reach the Iraqi people as rapidly as possible;

Stresses the need to continue to ensure respect for the security and safety of all persons directly involved in the implementation of this resolution in Iraq;
