Τις διατάξεις της Συμφωνίας μεταξύ της Κυβέρνησης της Ελληνικής Δημοκρατίας και της Κυβέρνησης της Δη?μοκρατίας της Βουλγαρίας για συνεργασία στον τομέα του Τουρισμού η οποία υπογράφηκε στην Αθήνα την 14η Μαΐου 1999 και κυρώθηκε με το Ν. 2851/2000, που δημο?σιεύθηκε στο υπ’ αριθμ. 239 Φύλλο της Εφημερίδας της Κυβερνήσεως τεύχος Α, της 31ης Οκτωβρίου 2000.

Το δεύτερο Άρθρο του κυρωτικού Νόμου της Συμφωνίας μεταξύ της Κυβέρνησης της Ελληνικής Δημοκρατίας και της Κυβέρνησης της Δημοκρατίας της Βουλγαρίας για συνεργα?σία στον τομέα Τουρισμού, σύμφωνα με τα οποία τα Πρωτό?κολλα-Πρακτικά που καταρτίζονται από τη Μεικτή Επιτροπή του άρθρου 9 της παρούσας Συμφωνίας εγκρίνονται με Κοι?νή Πράξη των αρμοδίων κατά περίπτωση Υπουργών.

Τις διατάξεις του άρθρου 29 Α~ του Νόμου 1558/1985, όπως προστέθηκε με το άρθρο 27 του Νόμου 2081/1992 και αντικαταστάθηκε με το άρθρο 1 παρ. 2 του Νόμου 2469/1997.

Το γεγονός ότι εκ της εφαρμογής των διατάξεων του υπό έγκριση Πρωτοκόλλου δεν προκαλείται πρόσθετη δαπάνη πλέον αυτής που προκύπτει από τις βασικές δια?τάξεις της Συμφωνίας και που είχε εκτιμηθεί στην Έκθεση του Γενικού Λογιστηρίου του Κράτους.

Το περιεχόμενο του υπό έγκριση Πρωτοκόλλου, απο?φασίζουμε: Εγκρίνουμε ως έχει και στο σύνολό του το Πρωτόκολλο της Πρώτης Συνόδου της Μεικτής Ελληνο-βουλγαρικής Επιτροπής για τον τουρισμό που υπεγράφη στη Θεσσα?λονίκη στις 14 Φεβρουαρίου 2004 το κείμενο του οποίου σε πρωτότυπο στην Αγγλική και σε μετάφραση στην Ελ?ληνική έχει ως εξής: OF THE FIRST SESSION OF THE GREEK -BULGARIAΝ PROTOCOL - JOINT COMMISSION ON TOURISM Upon the invitation of the Minister of Development of the Hellenic Republic Mr A. Tsohatzopoulos and in accor?dance with the stipulations of article 9 of the Agreement on cooperation in the field of Tourism between the Govern?ment of the Hellenic Republic and the Government of the Republic of Bulgaria signed in Athens on the 14th of May 1999, the Deputy Minister of Economy responsible for Tourism of the Republic of Bulgaria Mr Dimitar Had?jinikolov, accompanied by a delegation of High Officials, visited Thessaloniki from the 13th to the 15th of February 2004 in order to meet with his Greek Counterpart and co?chair the works of the first session of the Greek-Bulgarian Joint Commission on Tourism under the said Agreement. During his stay in Thessaloniki, the Bulgarian Deputy Minister of Economy was received by the Greek Minister of Development Mr A. Tsohatzopoulos and discussed with him the development of tourism in their two countries as well as ways and means for further promoting tourist exchanges between Greece and Bulgaria and for attrac?ting tourists from third countries. The Greek Delegation at the first session of the Joint Com?mission on Tourism, which took place on the 14th of Febru?ary 2004, was headed by the Secretary General of Tourism Dr Kostas Botopoulos and the Bulgarian Delegation by the Deputy Minister of Economy Mr Dimitar Hadjinikolov. The list of participants is attached in annex herewith. The Heads of the two Delegations expressed their satis?faction for holding this meeting, which reflects their sincere wish to enhance their cooperation in the field of Tourism and underlined that this cooperation strengthens the bonds of friendship and understanding between the two peoples. The two Parties agreed on the following agenda:

Exchange of information on the development of Tourism in the two countries.

Review of the bilateral relations in the field of Tourism.

Measures to be taken for the promotion of tourist co?operation between the two countries.

Place and date of the second session of the Commission. ITEM 1 on the Agenda The Heads of the two Delegations proceeded to an exchange of information regarding the development and trends of tourist flows in the two countries as well as the progress in expanding, diversifying and modernizing their tourist infrastracture and presented their respective poli?cies in this field. Particular mention was made by the two sides of the possi?bilities for the development of increased tourist traffic not only 5249 Athens on the 14th of May 1999 of the new agreement on tourism cooperation between the two countries which provides the legal framework for undertaking specific actions for the increase of the tourist flows between the two countries. The Bulgarian Party expressed its appreciation to the Greek Party for the organization in the years 1998 and 2000 of educational seminars in the field of Tourism for officials of their Ministry of Economy, employees of tourist enter?prises and trainers of schools of tourist professions, as well as for on the job training for Bulgarian students of tourist schools at greek hotels. The two Parties stressed in particular the beneficial effect of the abolition of visas and of the opening of new border crossing points for the development of Tourism between Greece and Bulgaria as well as of the more frequent direct connection between Greek and Bulgarian cities by air car?riers of both countries, a beneficial effect that is reflected in the significant increase of the number of Bulgarian and Greek tourists visiting Greece and Bulgaria respectively during the last years. ITEM 3 on the Agenda Both Parties taking into consideration the importance of implementing the Agreement effectively and obtaining concrete results by way of introducing the necessary measures, have agreed as follows:

The two Parties will exchange their experiences in the field of tourist promotion, planning and tourist marketing activities, including the development of their national tourist portals.

The two Parties will regularly exchange tourist infor?mation materials, such as posters, slides video and CD, films and new publications, when they are issued.

In view of intensifying tourism between their respective countries, the Parties will encourage the mutual organi?zation of familiarization tours, congresses, seminars as well as fairs, festivals, exhibitions and cultural weeks be?tween both countries. The Parties will also consider participating in similar pro?motional activities organized by the other Party.

The two Parties will elaborate a program of cooper?ation in the field of social tourism and school tourism.

The two Parties will encourage their national associ?ations of travel and tourism agencies and transport com?panies to get in direct contact, with a view to cooperating in organising mutual tourist programs and increasing the bi?lateral tourist movement.

The Parties will encourage the activities of their tourism private sectors, concerning the promotion of com?mon products in the field of historical, natural and cultural heritage to be presented as a combined tourist package for long-haul destinations, especially major overseas markets like Japan and the U.S.A.

The two Parties will exchange information on their national legislation concerning the incentives for foreign capital investments and joint ventures in the field of Tourism in their respective countries as well as on the guarantees for the protection of the foreign capital im?ported for investments. The two Parties will also exchange information on the op?portunities for such investments existing each time in the two countries and on projects where the participation of foreign capital is desirable and will encourage direct con?tacts of businessmen from the two Parties interested in in?vesting in the two countries.

The two Parties will share their experience in tourism planning.

The two Parties will promote the exchange of technical experience and know-how with particular emphasis on tourism infrastructure and the development of winter sports tourism, spas, thalassotherapy centers and rural tourism.

The two Parties will recommend to their appropriate Authorities as well as to their relevant professional Associ?ations to cooperate and share experience in the areas of yacht and cruise tourism.

The Parties will cooperate for ensuring sustainable tourism development and promotion of eco-tourism.

The two Parties will examine the possibilities of de?veloping bilateral religious tourism, taking stock of the nu?merous religious sites and monasteries in both countries and of promoting relevant cultural itineraries for pilgrims and tourists from both countries.

The two Parties will consider the possibility of estab?lishing common tourist paths in bordering areas of the two countries combining different mountain and sea land?scapes and profiting from the opening of new border crossing points and will encourage the twining of cities across the borders of the two countries.

The two Parties will exchange training programs and study curricula applied in tourism and hotel training schools, organizations, institutions and centers in the two countries and will examine the possibility of exchanging students of tourist professions. In this context the Greek Party invited 5 students of the Bulgarian schools of tourist professions for on the job train?ing at Greek hotels during the summer period of 2004. Moreover, the Bulgarian Party will also be able to send 2 participants in a seminar for training the trainers, which will be organized next Fall in Greece in the context of the Black Sea Economic Cooperation Organization.

The two Parties will cooperate within the framework of international tourist organizations, associations or ini?tiatives of which both are members, with particular empha?sis on the World Tourism Organization, the European Trav?el Commission, the Organization of the Black Sea Eco?nomic Cooperation and the Cooperation of the South Eastern European Countries. ITEM 4 on the Agenda The two Parties agreed that the 2nd Session of the Greek-Bulgarian Joint Commission on Tourism will take place in Bulgaria at a date, which will be mutually agreed upon by correspondence. The Bulgarian Delegation expressed its appreciation for the warm hospitality extended to them by the Greek Side. Τσοχατζόπουλου και σύμφωνα με τους όρους του Άρθρου 9 της Συμφωνίας Συνεργασίας στον Τομέα του Τουρισμού μεταξύ της Κυβέρνησης της Ελληνι?κής Δημοκρατίας και της Κυβέρνησης της Δημοκρατίας της Βουλγαρίας, που υπεγράφη στην Αθήνα στις 14 Μαΐου 1999, ο Υφυπουργός Οικονομίας αρμόδιος για θέματα Τουρισμού της Δημοκρατίας της Βουλγαρίας Dimitar Hadjinikolov, συ?νοδευόμενος από αντιπροσωπεία Ανώτερων Αξιωματούχων, επισκέφθηκε τη Θεσσαλονίκη από τις 13 έως τις 15 Φε?βρουαρίου 2004 προκειμένου να συναντηθεί με τον Έλληνα Ομόλογό του και να συμπροεδρεύσουν των εργασιών της πρώτης συνόδου της Μεικτής Ελληνο-Βουλγαρικής Επιτρο?πής για τον Τουρισμό σύμφωνα με την ανωτέρω Συμφωνία. Κατά τη διάρκεια της παραμονής του στη Θεσσαλονίκη, ο Βούλγαρος Υφυπουργός Οικονομίας έγινε δεκτός από τον Έλληνα Υπουργό Ανάπτυξης Α.Τσοχατζόπουλο και συζήτησαν μαζί την ανάπτυξη του τουρισμού στις δύο χώ?ρες τους όπως και τρόπους και μέσα για την περαιτέρω προώθηση των τουριστικών ανταλλαγών μεταξύ της Ελ?λάδας και της Βουλγαρίας και την προσέλκυση τουρι?στών από τρίτες χώρες. Επικεφαλής της Ελληνικής Αντιπροσωπείας κατά την πρώτη σύνοδο της Μεικτής Επιτροπής για τον Τουρισμό, που πραγματοποιήθηκε στις 14 Φεβρουαρίου 2004, ήταν ο Γενικός Γραμματέας Τουρισμού Δρ. Κώστας Μποτό?πουλος ενώ επικεφαλής της Βουλγαρικής Αντιπροσωπεί?ας ήταν ο Υφυπουργός Οικονομίας Dimitar Hadjinikolov. Ο κατάλογος των συμμετεχόντων επισυνάπτεται στο παρόν ως παράρτημα. Οι Επικεφαλής των δύο Αντιπροσωπειών εξέφρασαν την ικανοποίησή τους για την πραγματοποίηση της συνό?δου, που αντανακλά την ειλικρινή τους επιθυμία για τό?νωση της συνεργασίας τους στον τομέα του Τουρισμού και υπογράμμισαν ότι η συνεργασία αυτή ενισχύει τους δεσμούς φιλίας και κατανόησης μεταξύ των δύο λαών. Τα δύο Μέρη συμφώνησαν στο ακόλουθο πρόγραμμα:

Ανταλλαγή πληροφοριών για την ανάπτυξη του Του?ρισμού στις δύο χώρες,

Εξέταση των διμερών σχέσεων στον τομέα του Του?ρισμού,

Μέτρα προς λήψη για την προώθηση της τουριστικής συνεργασίας μεταξύ των δύο χωρών,

Τόπος και ημερομηνία της δεύτερης συνόδου της Επιτροπής. ΘΕΜΑ 1 του Προγράμματος Οι Επικεφαλής των δύο Αντιπροσωπειών προχώρησαν σε ανταλλαγή πληροφοριών σχετικά με την ανάπτυξη και τις τάσεις των τουριστικών ροών στις δύο χώρες όπως και σχετικά με την πρόοδο στην επέκταση, διαφοροποίηση και εκσυγχρονισμό των τουριστικών υποδομών τους και πα?ρουσίασαν τις αντίστοιχες πολιτικές τους στον τομέα αυτό. Ιδιαίτερη αναφορά έγινε από τις δύο πλευρές στις δυ?νατότητες ανάπτυξης αυξημένης τουριστικής κίνησης όχι μόνον προς την Ελλάδα αλλά και προς τη Βουλγαρία και άλλες τουριστικές χώρες με την ευκαιρία των Ολυμπια?κών Αγώνων του 2004 της Αθήνας. ΘΕΜΑ 2 του Προγράμματος Και τα δύο Μέρη εξέφρασαν την ικανοποίησή τους για την υπογραφή στην Αθήνα στις 14 Μαΐου 1999 της νέας συμφωνίας τουριστικής συνεργασίας μεταξύ των δύο χω?ρών που ορίζει το νομικό πλαίσιο για την ανάληψη συγκε?κριμένων δράσεων για την αύξηση των τουριστικών ροών μεταξύ των δύο χωρών. Το Βουλγαρικό Μέρος εξέφρασε την εκτίμησή του στο Ελληνικό Μέρος για τη διοργάνωση κατά τα έτη 1998 και 2000 εκπαιδευτικών σεμιναρίων στον τομέα του Τουρι?σμού για αξιωματούχους του Υπουργείου Οικονομικών τους, υπαλλήλους τουριστικών επιχειρήσεων και εκπαι?δευόμενων σχολών τουριστικών επαγγελμάτων, όπως και για την πρακτική εκπαίδευση Βούλγαρων φοιτητών του?ριστικών σχολών σε Ελληνικά ξενοδοχεία. Τα δύο Μέρη τόνισαν ιδιαίτερα τις επωφελείς συνέπειες της κατάργησης της θεώρησης διαβατηρίου και του ανοίγ?ματος νέων σημείων διάβασης των συνόρων για την ανά?πτυξη του Τουρισμού μεταξύ της Ελλάδας και της Βουλγα?ρίας όπως και των συχνότερων άμεσων συνδέσεων μεταξύ Ελληνικών και Βουλγαρικών πόλεων που συνίστανται στη σημαντική αύξηση του αριθμού Βούλγαρων και Ελλήνων τουριστών που επισκέφθηκαν την Ελλάδα και την Βουλγα?ρία, αντίστοιχα, κατά τη διάρκεια των τελευταίων ετών. ΘΕΜΑ 3 του Προγράμματος Και τα δύο Μέρη, λαμβάνοντας υπόψη τη σημασία της αποτελεσματικής υλοποίησης της Συμφωνίας και της λή?ψης συγκεκριμένων αποτελεσμάτων με την εισαγωγή των απαραίτητων μέτρων, συμφώνησαν στα ακόλουθα:

Τα δύο Μέρη θα ανταλλάσσουν τις εμπειρίες τους στον τομέα της τουριστικής προώθησης και σχεδιασμού και των δραστηριοτήτων τουριστικού μάρκετινγκ, συμπεριλαμβανο?μένης της ανάπτυξης των εθνικών τουριστικών πυλών τους.

Τα δύο Μέρη θα ανταλλάσσουν συχνά τουριστικό πληροφοριακό υλικό, όπως αφίσες, διαφάνειες, βίντεο και CD, ταινίες και νέες δημοσιεύσεις, όταν εκδίδονται.

Ενόψει της εντατικοποίησης του τουρισμού μεταξύ των αντίστοιχων χωρών τους, τα Μέρη θα ενθαρρύνουν την αμοιβαία διοργάνωση περιηγήσεων εξοικείωσης, συ?νεδρίων, σεμιναρίων όπως και εκθέσεων, φεστιβάλ, πα?ρουσιάσεων και πολιτιστικών εβδομάδων μεταξύ των δύο ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ (ΤΕΥΧΟΣ ΠΡΩΤΟ) 5251 σχολικού τουρισμού.
