Φ. 0544/ΑΣ 137/Μ. 5590 Έγκριση του Εκτελεστικού Προγράμματος Πολιτιστι?κής, Επιστημονικής και Εκπαιδευτικής συνεργασίας μεταξύ της Κυβέρνησης της Ελληνικής Δημοκρατίας και της Κυβέρνησης της Δημοκρατίας του Περού για τα έτη 2004, 2005 και 2006 (Λίμα, 31 Οκτωβρίου 2003). ΟΙ ΥΠΟΥΡΓΟΙ ΕΞΩΤΕΡΙΚΩΝ - ΑΝΑΠΤΥΞΗΣ - ΕΘΝΙΚΗΣ ΠΑΙΔΕΙΑΣ ΚΑΙ ΘΡΗΣΚΕΥΜΑΤΩΝ - ΠΟΛΙΤΙΣΜΟΥ - ΕΠΙΚΡΑΤΕΙΑΣ Έχοντας υπόψη τις διατάξεις:

της Μορφωτικής Συμφωνίας μεταξύ της Κυβέρνησης της Ελληνικής Δημοκρατίας και της Κυβέρνησης της Δη?μοκρατίας του Περού η οποία υπογράφηκε στην Αθήνα στις 28 Ιουνίου 1988 και κυρώθηκε με τον υπ’ αριθμ. 2141/1993 Νόμο που δημοσιεύθηκε στο υπ’ αριθ. 86 Φύλ?λο της Εφημερίδας της Κυβερνήσεως, Τεύχος Α~, της 28ης Μαΐου 1993,

το άρθρο 29 Α του Νόμου 1558/1985, όπως αυτό συ?μπληρώθηκε με το άρθρο 27 του Νόμου 2081/1992 (ΦΕΚ Α~ 154) και τροποποιήθηκε με το άρθρο 1 παρ. 2 του Νό?μου 2469/1997 (ΦΕΚ Α~ 38),

το γεγονός ότι εκ της εφαρμογής των διατάξεων του υπό έγκριση Προγράμματος δεν προκαλείται πρόσθετη δαπάνη πλέον αυτής που προκύπτει από τις βασικές δια?τάξεις της Συμφωνίας και που είχε εκτιμηθεί στην Έκθεση του Γενικού Λογιστηρίου του Κράτους,

το περιεχόμενο του υπό έγκριση Εκτελεστικού Προ?γράμματος, αποφασίζουμε: Εγκρίνουμε ως έχει και στο σύνολό του το Εκτελεστικό Πρόγραμμα Πολιτιστικής, Επιστημονικής και Εκπαιδευτι?κής συνεργασίας μεταξύ της Κυβέρνησης της Ελληνικής Δημοκρατίας και της Κυβέρνησης της Δημοκρατίας του Περού για τα έτη 2004, 2005 και 2006 που υπογράφηκε στη Λίμα στις 31 Οκτωβρίου 2003 του οποίου το κείμενο σε πρωτότυπο στην αγγλική γλώσσα και σε μετάφραση στην ελληνική έχει ως εξής: EXECUTIVE PROGRAMME OF CULTURAL, SCIENTIFIC AND EDUCATIVE CO-OPERATION, BETWEEN THE GOVERNMENT OF THE HELLENIC REPUBLIC AND THE GOVERNMENT OF REPUBLIC OF PERU THE FOR 2004, 2005 AND 2006 The Government of the Hellenic Republic and the Gov?ernment of the Republic of Peru, guided by the desire to de?velop their cultural, scientific and educative relationships, in agreement with the dispositions of Article 5 of the Cultur?al Agreement between the Government of the Hellenic Re?public and the Government of the Republic of Peru, sub?scribed in Athens on 28th June 1988, have agreed the fol?lowing Cultural, Scientific and Educative Co-operation Programme for the years 2004, 2005 and 2006.

EDUCATION ARTICLE 1 The two Parties will encourage the direct co-operation between their higher education, universitary and non?universitary institutions, in agreement with the rules and regulations of each country. ARTICLE 2 The two parties will annually grant a scholarship for re?search or postgraduate studies. The duration of each scholarship shall not exceed a 10 months period. ARTICLE 3 During the validity of the present Programme, the two Parties will exchange two (2) experts in the field of basic ed?ucation (primary, secondary) or non-universitary techno?logical education or the administration of education, in or?der to exchange views and experience. Each visit will be for a period up to ten (10) days. The two parties through their Ministries of Education, will exchange information and material on: Management of ed?ucative system, curricula, methodology and evaluation. ARTICLE 4 During the validity of the present Programme, the two Parties will exchange, through the competent authorities of each country, one (1) member of their universities’ teach?ing staff, for a period of ten (10) days. ARTICLE 5 The two Parties will promote their co-operation within the European projects framework. 5403 European Union and the Republic of Peru, to develop and strengthen the scientific and technological co-operation, on the possible widest scope in all the fields considered of reciprocal interest and benefit. This co-operation will be directed especially to: • Tighten and diversify scientific and technological links between the contracting parties. • Promote the scientific and technological progress and the transference of technology, just as the conclusion in the appropriate agreements. The Parties can adopt any further specific agreement that is considered necessary for the future development of their scientific and technological co-operation. ARTICLE 7 The Parties will maintain consultations in order to identi?fy high priority sectors in their co-operation, so as new sci?entific and technological co-operation sectors. ARTICLE 8 The Parties will create favourable conditions for the de?velopment of the scientific and technological co-operation between them, as well as among their respective public or private organisations, governmental and non governmen?tal institutions, according to their national priorities and with subjection to their laws. This co-operation will be feasible, among others, through the following modalities: • Scientists, researchers and experts exchange. • Elaboration of joint research programmes. • Organisation of development programmes in fields of mutual interest. • Provision of scientific and technical knowledge. • Organisation of symposia and seminaries. • Information and data exchange. • Provision of equipment and necessary materials for the accomplishment of specific projects. • Granting of scholarships for specialisation. ARTICLE 9 A Joint Committee will be constituted with the aim to en?sure the execution of this Agreement. The Joint Committee will be integrated by represen?tatives of the Parties and it will meet, at the request of anyone of them, through the diplomatic channels, in the place and at the time when it is agreed by common con?sent. The Joint Committee will have the following functions: • Care for the suitable operation of this Agreement. • Co-ordinate activities, projects and specific oper?ations related to the aims of this Agreement, proposing the necessary means for its accomplishment and correspond?ing pursuits. • Identify new co-operation sectors. • Look for appropriate methods in order to solve prob?lems that could arise in relation to this Agreement’s ac?complishment and, if it is precise, formulate the respective recommendations. III. ARCHIVES AND LIBRARIES ARTICLE 10 Both Parties will encourage the co-operation between their national libraries and universitary ones. The co-operation between their national libraries, will in?clude exchange of: a) information and experiences in the conservation, restoration, and diffusion of the documentary and biblio?graphical patrimony, b) exchange of information about books on Peru in Greece and vice versa and exchange of reproductions or copies of such books between their national libraries, The parties will encourage the co-operation between the national archives in order to exchange information and experience, in the conservation, preservation and resto?ration of the documentary patrimony. For this intent, both Parties will exchange one (1) librari?an or archivist for a period of up to ten (10) days. IV CULTURE ARTICLE 11 In the period of validity of the present programme, the two Parties will exchange three or four (3-4) experts of di?verse cultural and artistic fields (archaeology, con?servation, restoration, museology, literature, folklore, art, etc.) so that they may exchange their respective experi?ences in the field of their area of expertise. Each visit will have a span of no more than eight (8) days. ARTICLE 12 The two Parties will respectively encourage the organis?ing of a cultural event devoted to intellectuals of the other country. ARTICLE 13 The two Parties will encourage the initiatives of the pub?lishing firms of both countries for the translation and publi?cation of contemporary literature of the other country. For this purpose, both parties will exchange one or two (1-2) translators or publishers per periods of up to eight (8) days. The Greek Party informs to the Peruvian Party that the Ministry of Culture has initiated a programme to stimulate the translations of Greek contemporary Literature works to foreign languages. ARTICLE 14 Each one of the Parties will encourage the participation of artistic groups of the other country in organised cultural events in its country. ARTICLE 15 Both Parties will exchange one (1) folklore show or one art exhibition, whose subject will be specified through the diplomatic channels. ARTICLE 16 Each one of the Parties will organise one cinemato?graphic week, respectively. Technical and other details will be directly determined between the competent authorities of the two countries. ARTICLE 17 Both Parties will exchange cinema related materials, with a view to enriching their cinematographic archives. ARTICLE 18 Both Parties will promote bilateral co-operation and exchanges in the field of the culture, within the framework 5404 ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ (ΤΕΥΧΟΣ ΠΡΩΤΟ) cultural patrimony, and endorsing, respectively, the un?dertaken actions to prevent the commercialisation, export and transference of objects considered as part of their cultural patrimonies. V. SOCIAL MASS MEDIA ARTICLE 20 Both Parties will promote the co-operation in the follow?ing areas: • Exchange of experience concerning cultural television and radio. • Exchange of educative, cultural, musical and en?tertaining programmes with the purpose of favouring a better and greater knowledge of the cultural wealth of both countries. • Staff qualification in technical operative aspects on production of programmes of radio and television, as well as programmes that contribute to improve the knowledge and improvement of social communication professionals of both countries. • Training and technical assistance in audio-visual archives. VI. YOUTH AND SPORTS ARTICLE 21 Both Parties will promote co-operation and contacts con?cerning cultural and social activities, between juvenile or?ganisations of both countries. Both Parties will exchange information and experience related to juvenile subjects with a view to strength their re?lationships, create friendship conditions and promote peace between young people. ARTICLE 22 Both Parties will encourage the co-operation in the field of sports and physical education for the exchange of ath?letes, trainers, sport administrators, experts and sport sci?entists that take part in research programmes and techno?logical programmes, upon bilateral bases, or starting from initiatives in the field of competitive sports, of «sports for ev?eryone» and in the development of professional sports. The fields of co-operation include sport’ sciences, train?ing, administration, sporting organisation, and profession?al improvement. VII. VARIOUS MATTERS ARTICLE 23 Technical and another details concerning the implemen?tation of the present Programme, will be regulated through the competent authorities of both countries. ARTICLE 24 The provisions of the present Programme will not prevent that the Parties decide through the diplomatic channels, the implementation of other exchanges in the fields of ed?ucation, science and culture. ARTICLE 25 The attached annex, that contains general and financial provisions, is an integral part of the present Programme. ARTICLE 26 The present programme will enter into force on the date of its signature and will remain in force until the 31st De?cember 2006. Done and signed in the city of Lima, the 31st of October of 2003, in two originals, in the english and spanish lan?guages, each text being equally authentic. FOR THE GOVERNMENT OF FOR THE GOVERNMENT OF THE HELLENIC REPUBLIC THE REPUBLIC OF PERU -ANNEX A. GENERAL PROVISIONS IN THE FIELD OF SCIENCE AND EDUCATION a) Individuals’ exchange The candidates who will participate in the exchange, in accordance with the dispositions of the present Pro?gramme, will be designated by the requesting Party, that will notify this designation to the requested Party three (3) months before the departure date of the proposed candi?dates. The requesting party will present to the requested Party personal information related to the titles, specialisation, and professional merits, the academic degrees, the spo?ken languages (English or the language of the host coun?try), the programme of stay of the individuals who will par?ticipate in the exchange, as well as another useful infor?mation. The requested Party will notify to the requesting Party its consent, at least (2) months before the proposed date for the visit. When the consent of the requested Party is obtained, the requesting Party will communicate the exact date of com?mencement, at least a month (1) in advance. b) Scholarships’ exchange

The Party that grants a scholarship will annually send its offers, before the 31st January.

The requesting Party will send to the requested Party the file of the candidate before the 30th April of the same year.

3.

The file of the candidate will have to include the follow?ing: • Curriculum vitae • Copies of diplomas with the pertinent certifications and legalisation’s • Foreseen programme of the research or studies • Medical certificate • Letter of acceptance to a post degree training pro?gramme

The requested Party will announce the definitive ac?ceptance of the scholarship holder before the 30th June.

The candidate who receives the scholarship must speak the language of the receiving country or English. The candidates for postgraduate studies in Greece should speak the greek language and have been accepted in a postgraduate studies programme. B. FINANCIAL PROVISIONS IN THE FIELDS OF SCI?ENCE AND EDUCATION a) Individuals’ exchange

1.

The sending Party will cover the roundtrip trip to the capital of the receiving country, to the individuals sent un?der this Programme. ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ (ΤΕΥΧΟΣ ΠΡΩΤΟ) 5405 - cost of an one or two-day visit to archaeological or historical sites.

The Peruvian Party shall provide the expenses of lodg?ing and local transportation, according to its possibilities.

4.

In case of emergency, the receiving Party will provide medical assistance, in a public hospital, for individuals who turn up in accordance with the rules of the present Pro?gramme. b) Scholarships’ exchange

1.

The scholarship holders themselves will have to pay for the roundtrip between the two countries. - a monthly allowance of 440 Euro for postgraduate students or researchers commencing upon student’s ar?rival in Greece and covering the duration of the scholar?ship, - a lump sum of 59 Euro upon arrival for accommodation cost for those settling in Athens or 88 Euro for those settling in the provinces. Students, whose scholarship has been renewed, shall not be entitled to this sum, - exemption from tuition fees, - traveling expenses within the Greek territory, according to the approved study programme of postgraduate stu?dents or researchers, of up to the sum of 88 Euro.

The Peruvian Party shall provide the expenses of lodging and local transportation, according to its possibil?ities.

In case of emergency, the medical assistance in a pub?lic hospital will be provided by the receiving Party, for indi?viduals who turn up in accordance with the rules of the pre?sent Programme. C. GENERAL PROVISIONS IN THE FIELD OF CULTURE a) Individuals’ exchange The individuals who will participate in this exchange in accordance with the rules of the present Programme will be designated by the requesting Party, that will notify to the requested Party their designation three (3) months be?fore the proposed date of departure. The requesting Party will also provide to the requested Party all the necessary information about the diplomas, academic and profes?sional merits, as well as the programme of the proposed research work, the extent of stay and any other useful in?formation. The requested Party will notify to the requesting Party its decision, at least sixty (60) days before the proposed de?parture date. When receiving the consent of the requested Party, the requesting party will communicate the exact date of commencement, at least with thirty (30) days of an?ticipation. It will be required that the exchange visitors, according to the rules of the present Programme in the field of the cultur?al co-operation, master the language of the host country, or English or French. b) Exhibition exchanges The requesting Party will inform to the requested Party, at least with twenty-four (24) months in advance, the dates and subject of the exhibition that is being prepared. With the purpose of making the relevant adjustments for the exhibition, the requesting party will provide essential tech?nical information on the future exhibition as well as the in?dispensable material for the impression of the catalogue (preface, list of objects, photographs, etc.), at least three (3) months before the inauguration. The exhibitions will ar?rive at the place from destiny at least (1) month before the inauguration. D. FINANCIAL PROVISIONS IN THE FIELD OF CULTURE a) Individuals exchange The expenses of the trip and the reception of the people who arrive within the framework of the present Pro?gramme, will be financed as follows:

The sending Party will cover the expenses of the inter?national trip towards and from the State Capital of the re?ceiving Party. - 80 Euro per day for hotel charges and daily expenses, - a lump sum of 90 Euro, upon arrival, per visit to cover cost of travel within Greece.

3.

The Peruvian Party shall provide the expenses of lodg?ing and local transportation, according to its possibilities.

4.

In case of emergency, the medical assistance in a pub?lic hospital will be provided by the receiving Party, for indi?viduals who turn up in accordance with the rules of the pre?sent Programme. b) Exhibitions exchanges
