α) Το άρθρο 27 του Ν. 2066/1952 "Περί ιδρύσεως Τα?μείου Αρωγής και Υγείας Οικονομικών Υπαλλήλων και άλ?λων τινών διατάξεων" (ΦΕΚ 99 Α'),

Το άρθρο 29 Α του Ν. 1558/1985 (ΦΕΚ 137 Α'), το οποίο προστέθηκε με το άρθρο 27 του Ν.2081/1992 (ΦΕΚ 247 Α') και αντικαταστάθηκε με το άρθρο 1 παράγραφος 2α του Ν.2469/1997 (ΦΕΚ 38 Α').

Το γεγονός ότι από τις διατάξεις του παρόντος προ?καλείται δαπάνη σε βάρος του προϋπολογισμού ΤΑΛΣ οι?κονομικού έτους 2004 ύψους 700.000,002 η οποία εκτι?μάται ότι θα υπερκαλυφθεί από τα προβλεπόμενα στο πα?ρόν έσοδα. Για τα επόμενα οικονομικά έτη προβλέπεται ετησίως δαπάνη ύψους 800.000,002 με την εγγραφή ανα?λόγου ποσού στο ΚΑΕ 0631 του προϋπολογισμού του ΤΑΛΣ η οποία επίσης θα υπερκαλυφθεί από τα προβλεπό?μενα στο παρόν έσοδα. Σημειωτέον δε ότι το Ταμείο δεν επιχορηγείται από τον Κρατικό Προϋπολογισμό.

Την υπ' αριθ. 223/2004 γνωμοδότηση του Συμβουλί?ου της Επικρατείας, ύστερα από πρόταση των Υπουργών Εμπορικής Ναυτιλίας, Απασχόλησης και Κοινωνικής Προ?στασίας και του Υφυπουργού Οικονομίας και Οικονομι?κών, αποφασίζουμε:

Road Transport of Goods The two Sides exchanged information regarding the per?formed bilateral and transit road transport of goods, be?tween and through their Countries. Both Sides noted with satisfaction the progress made towards the gradual increase for the permit quotas. 5526 ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ (ΤΕΥΧΟΣ ΠΡΩΤΟ) The two Sides agreed to further promote their cooper?ation in the field of road transport of goods, according to the progress observed in the volume of bilateral trade.

Transport Safety - Implementation of the A.D.R. Agreement The Hellenic Side referred to the matter of the implemen?tation of the ADR Agreement by the Turkish Side. Further?more, the Hellenic Side described briefly the controls that are being made in the Greek territory by the competent control authorities in all Greek and foreign vehicles and drivers performing road transportation of dangerous goods. The Turkish Side informed the Hellenic Side about the on going procedure for acceding to the ADR Agreement.

Road Transport of Passengers The two Sides expressed their satisfaction for the good level of cooperation achieved in the field of passenger transport. Both Sides agreed to finalize the permits' issuance pro?cedure, as soon as all necessary documents have been re?ceived, with full respect to the principle of reciprocity. In this context, the total number of itineraries, for each regular ser?vice, is equally allocated to both Sides. The Hellenic Side stated that the current way of exploiting the regular passenger services, namely as a pool formed of carriers of both countries operating the same regular service, should not be obligatory. However, within the context of enhancing the viability of regular passenger transportation, these services should be performed through an agent resident in the country of desti?nation. It is preferable that this agent would be operating the regular service in question. In case that, any problems arise in such cooperation, the relevant Ministries of both Coun?tries will conclude to a mutually acceptable solution. In the field of occasional passenger services, both Sides raised the issue of illegal passenger transportation by taxis or with the use of control documents of the ASOR Agree?ment, which is a direct threat to legally operating regular passenger services. The two Sides agreed to invite the bor?der competent authorities of both Countries to intensify their controls. The two Sides agreed to examine the possibility for es?tablishing direct correspondence between the relevant Ministries of both Countries in order to avoid delays.

Rail Transport The representatives of the national railway enterprises of the two countries, CH and TCDD, presented the develop?ments in the field of the railway transports. Reference was made in particular: To the Memorandum of Cooperation, signed between the President and Managing Director of CH Mr. K. Gian?nakos and the President and General Director of TCDD Mr. Karaman, on March 5, 2003, which provides the fol?lowing: • Development of the combined transports between Turkey and Hellas. Together with the conventional existing routes, the Adriatic-Ionian Intermodal Corridor (Western Railways Corridor) of "Kalambaka-Kozani/ Kalambaka?Ioannina-Igoumenitsa/Antirio-Rio", which was mentioned by CH, could also be used in the future after being includ?ed to the Trans-European Network for Transport (TEN), • Development of the freight transports, • Improvement of the infrastructure at the border cross?ing Pythio - Uzunkopru, • Cooperation for the running of a night passenger high quality train between Thessaloniki and Istanbul, • Cooperation with the forwarding associations, the chambers of trade and industry, the associations of ex?porters, and other collective bodies in the private sector of both countries. Both Sides expressed their satisfaction for the very good level of co-operation between the two railway enterprises, which contributes positively to the improvement of the quality of the provided services and to the growth of the trade between the two countries. Finally, the both Sides expressed their ample satisfaction and asked from the two railway enterprises to increase the volume of the freight and passenger transports, taking in?to consideration the forthcoming Olympic Games of 2004. To this end, both Sides noted that the two networks would provide the appropriate efforts in order to resolve success?fully any possible technical problems.

Transport Infrastructure The two Sides exchanged information on the development of the road infrastructure interconnecting their territories, namely Via Egnatia - Kipoi/Ipsala, Kinali junction- Istanbul. Both Sides declared their wish to further upgrade the existing road connection between their Countries. To this end, the Hellenic Side proposed the establishment of a Joint Expert Group to examine the technical details of the road connection: Via Egnatia - Kipoi/Ipsala - Kinali junction - Istanbul and undertook the initiative to convene the first meeting of this Group. The Turkish Side committed to con?vey the Hellenic proposal to the competent authority.

Miscellaneous The Turkish Side expressed the wish to continue the co?operation between the two Countries in the field of Mar?itime Transport, as well. The Hellenic Side stated that it would convey this wish to the competent Ministry of Mercantile Marine. The next Meeting of the Joint Turkish Hellenic Transport Committee will be held in Turkey in 2004. This Protocol was done in Athens on the 14th of May 2003 in two original copies in the English language, both being equally authentic. Miscellaneous ΠPΩTOKOΛΛO THΣ 11ης ΣYNOΔOY THΣ MIKTHΣ EΛΛHNO?TOYPKIKHΣ EΠITPOΠHΣ METAΦOPΩN Aθήνα 13-14 Mαΐου 2003 H 11η Σύνοδος της Mικτής Eλληνο-Tουρκικής Eπιτρο?πής Mεταφορών έλαβε χώρα στην Aθήνα στις 13-14 Mαΐου 2003. Tης Eλληνικής Aντιπροσωπείας επικεφαλής ήταν ο BAΣIΛEIOΣ KAΛΛIBΩKAΣ, Διευθυντής της Διεύθυνσης Eμπορευματικών Mεταφορών του Yπουργείου Mεταφο?ρών και Eπικοινωνιών της Eλληνικής Δημοκρατίας. Tης Tουρκικής Aντιπροσωπείας επικεφαλής ήταν ο Mehmet Kutlu, Aναπληρωτής Yφυπουργός του Yπου?ργείου Mεταφορών της Tουρκικής Δημοκρατίας. Oι κατάλογοι της Eλληνικής και της Tουρκικής Aντιπρο?σωπείας επισυνάπτονται ως Παραρτήματα I και II του πα?ρόντος Πρωτοκόλλου. H Hμερήσια Διάταξη της Συνόδου επισυνάπτεται ως Παράρτημα III του παρόντος Πρωτοκόλλου. H 11η Σύνοδος της Mικτής Eλληνο-Tουρκικής Eπιτρο?πής Mεταφορών έλαβε χώρα σε φιλική ατμόσφαιρα με βάση την αμοιβαία κατανόηση και την στενή συνεργασία. Kαι οι δύο Πλευρές παρουσίασαν την τρέχουσα κατάστα?5528 ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ (ΤΕΥΧΟΣ ΠΡΩΤΟ) Περαιτέρω, και οι δύο Πλευρές εξέφρασαν την πεποί?θησή τους ότι ο εντατικός διάλογος μεταξύ των δύο Xω?ρών και των αντιστοίχων οικονομικών οντοτήτων τους, ενεργών στον τομέα των μεταφορών, μπορεί να ασκήσει ισχυρή επιρροή πάνω στην προώθηση της διμερούς οικο?νομικής συνεργασίας. Mε προοπτική την περαιτέρω αύξηση της Eλληνο-Tουρ?κικής αμοιβαίας συνεργασίας στον τομέα των μεταφο?ρών, οι δύο Πλευρές είχαν καρποφόρες συζητήσεις επί όλων των θεμάτων κοινού ενδιαφέροντος και κατέληξαν στα ακόλουθα συμπεράσματα
