ΤΕΥΧΟΣ ΠΡΩΤΟ Αρ. Φύλλου 176 9 Σεπτεμβρίου 2009 ΑΠΟΦΑΣΕΙΣ Αριθμ. Φ.0544 /Μ.6267/ ΑΣ.455 Εγκριση του Πρωτοκόλλου της 4ης Συνάντησης της Μικτής Επιτροπής Μεταφορών Ελλάδας − Ουκρανίας» (Αθήνα, 27−28 Μαΐου 2009). ΟΙ ΥΠΟΥΡΓΟΙ ΕΞΩΤΕΡΙΚΩΝ − ΜΕΤΑΦΟΡΩΝ ΚΑΙ ΕΠΙΚΟΙΝΩΝΙΩΝ Έχοντας υπόψη:
Τις διατάξεις της Συμφωνίας μεταξύ της Κυβέρνησης της Ελληνικής Δημοκρατίας και της Κυβέρνησης της Ουκρανίας για διεθνείς οδικές επιβατικές και εμπορευματικές μεταφορές, που υπογράφηκε στην Αθήνα, στις 11 Νοεμβρίου 1996 και κυρώθηκε με τον ν. 2506/1997 που δημοσιεύθηκε στο υπ’ αριθμόν 119 Φύλλο Εφημερίδος της Κυβερνήσεως, τεύχος Α΄, της 11ης Ιουνίου 1997.
Το άρθρο δεύτερο του ως άνω κυρωτικού νόμου σύμφωνα με το οποίο τα Πρωτόκολλα − Πρακτικά που καταρτίζονται από τη Μικτή Επιτροπή του άρθρου 14 της Συμφωνίας εγκρίνονται με κοινή πράξη των αρμοδίων κατά περίπτωση Υπουργών.
Τις διατάξεις του άρθρου 90 της Κωδικοποίησης της νομοθεσίας για την Κυβέρνηση και τα Κυβερνητικά όργανα (π.δ. 63/2005, ΦΕΚ 98/Α΄/22.4.2005).
Το γεγονός ότι εκ της εφαρμογής των διατάξεων του υπό έγκριση Πρωτοκόλλου ουδεμία δαπάνη προκαλείται σε βάρος του κρατικού προϋπολογισμού πλέον αυτής που προκύπτει από τις βασικές διατάξεις της Συμφωνίας και που είχε εκτιμηθεί στην Έκθεση του Γενικού Λογιστηρίου του Κράτους.
Το περιεχόμενο του υπό έγκριση Πρωτοκόλλου, αποφασίζουμε: Εγκρίνουμε ως έχει και στο σύνολό του το Πρωτόκολλο της 4ης Συνάντησης της Μικτής Επιτροπής Μεταφορών Ελλάδας – Ουκρανίας, που υπογράφθηκε στην Αθήνα, στις 28 Μαΐου 2009, του οποίου το κείμενο σε πρωτότυπο στην αγγλική γλώσσα και σε μετάφραση στην ελληνική έχει ως εξής: 6449 JOINT HELLENIC - UKRAINIAN TRANSPORT COMMITTEE Athens, 27-28 /05/2009 The 4th Meeting of the Joint Hellenic– Ukrainian Transport Committee was held in Athens, on 27 – 28 May 2009. The Hellenic Delegation was headed by Mr. Triantafyllos Papantriantafyllou, Director of the Freight Transport Directorate of the Ministry of Transport and Communications of the Hellenic Republic. The Ukrainian Delegation was headed by Mr. Petro Glavatskiy, Deputy Chief of Motor Transport State Administration of the Ministry of Transport and Communications of Ukraine. The lists of the Hellenic and Ukrainian Delegations are attached as Annex I to this Protocol. The following agenda was agreed by the delegations: - Exchange of statistical data - Road Transport of goods - Road Transport of Passengers - Miscellaneous With a view of further enhancing the Hellenic-Ukrainian mutual cooperation in the transport field, the two Sides held fruitful discussions on all issues of common interest and reached the following conclusions:
Exchange of Statistical data Both Sides underlined their satisfaction for the constant increase of the total trade volume, during the past five years. However, the global economical crisis has recently had a negative effect on the evolution of trade. Both sides expressed their hope that the crisis would soon be overcome, at the benefit, among all, of carriers and entrepreneurs of both countries.
Road Transport of Goods The two Sides exchanged statistical data regarding permit usage, according to which the Ukrainian hauliers seem to make use of higher percentage of permits annually exchanged, in comparison with Greek hauliers. Moreover, Due to the economical crisis, which had an impact on road transport of goods, both Sides noted that the current quotas, taking also into account of the ECMT permits, sufficiently cover the needs of hauliers of both countries. The Ukrainian Side informed the Greek Side that the number of permits to/from third countries was fully used by the Ukrainian hauliers and asked for an increase to the number of these permits. The Greek Side, following the Greek hauliers request stated that they would consider as reasonable even a reduction in the permit quota to/from third countries, but such a standpoint was not accepted by the Ukrainian Side. In this respect, the two Sides decided to maintain the current quotas for year 2009, namely to exchange the following number of permits: - 1.150 bilateral or transit (universal) permits and - 55 permits to / from third countries. The said quotas would also be preliminary valid for year 2010. Both Sides agreed that in case a request is expressed, by either Side, for additional bilateral and transit transport (universal) permits, they are willing to examine such request in a positive way. Furthermore, the two Sides agreed that all permits would be valid till the 31st of January of the following year. The Greek Side noted that according to Greek hauliers considerable delays have been reported as regards to custom formalities in the RomanianUkrainian border crossing. Moreover, there have been reported cases in which, in the course of a return transit journey, a second transit permit was requested by control authorities. The Greek Side requested for the intervention of the Ukrainian Side to their custom authorities so as the number of such cases would be minimized. The Ukrainian Side noted in response, that as regards to custom issues, they are willing to advise their custom authorities in order to facilitate the road transport, although the custom authorities do not fall within the field of competence of the Ministry of Transport and Communications. As far as the latter issue is concerned, the Ukrainian Side acknowledged that no second permit is required on return transit journey and undertook to inform their control authorities accordingly. In addition, the Greek Side informed the Ukrainian Side that in case the maximum permissible weight of a truck is exceeded and the infringement is ascertained during the weekend, the haulier is obliged to wait till Monday in order to pay the corresponding fine and resume the journey. The Ukrainian Side informed the Greek Side that in such cases a special permit is required and issuing such permit previously used to be in the competence of both the State Road Administration and the Road Police. As the Ukrainian Side stated, there has recently been a reform in this procedure being a competency, from now on, of the State Road Administration so hopefully such problems would be resolved. Ukrainian territory and then carry a load from Ukraine to Greece in the return journey with the use of the same permit. The Ukrainian Side agreed to this proposal, on a reciprocal basis, counter-proposing that this arrangement should enter into force as from 1st of July 2009 so as the competent control authorities are adequately informed. Moreover the Greek Side informed the Ukrainian Side that the ECMT Certificates of Compliance with Technical and Safety Requirements for a Motor Vehicle have been in error printed for the current year (2009), since they do not fully comply with the ECMT model. The Greek Side added that the ECMT Secretariat has already been accordingly informed. The Ukrainian Side expressed their understanding and received a specimen of the above mentioned faulty ECMT Certificate in order to inform their control authorities.
Road Transport of Passengers The two Sides presented the current situation of the regular bus service Athens – Kiev and agreed that the issue of temporary operation of carriers should be resolved in a more permanent way, namely by issuing new authorizations instead of prolonging the validity period of the existing ones. The Greek Side stated that they support the further liberalization of the operation of the regular bus services, lifting unjustified restrictions to carrieraccess in the regular bus services between the two countries. Moreover they stated that a simplified procedure should be provided regarding the establishment of new regular services. The Ukrainian Side responded that they have no major objection to further liberalization of the market as long as certain conditions are being met adding that the full deregulation of the market should be avoided. In this respect, the two Sides agreed that they are willing to examine requests for new regular bus services on the basis of the following criteria: - a new regular bus service should not overlap the existing ones - the feasibility of a new bus service should be presumed - a new regular bus service should not compromise the existence of regular services already authorized. As regards to the existing regular service Athens – Kiev, both Sides agreed that as from the end of August, new authorizations should be issued, paying respect to the provisions of the internal legislation of both countries. Both Sides undertook the obligation to respond, positively or negatively in written form, to each application conveyed by either Side for regular services within two months. It should be stated though that the application and relevant documentation should be in English language. Both Sides agreed that as regards to the non-liberalised occasional transportation the existing quota of 100 annually exchanged permits should The Greek Side also repeated the following issues, already posed on the occasion of the 2nd Joint Committee:
The need in special cases for the use of trailers attached to the buses due to the insufficiency of fixed luggage compartment of the buses.
The possibility of granting priority in border crossing points to buses operating regular bus lines bearing in mind that the buses operating regular services should pay respect to fixed timetables. The Ukrainian Side responded respectively that:
The use of trailers is prohibited according to the Ukrainian legislation. However, in the course of the gradual harmonization of the Ukrainian legislation with the E.U. one, the above mentioned prohibition is likely to be lifted.
They also hold the opinion that buses operating regular services should be granted priority in border crossings. The Ukrainian Side confirmed its readiness to facilitate the simplification of custom and border formalities to the extent that they fall within the competence of the Ministry of Transport and Communications of Ukraine, in order to avoid unnecessary delays. The Ukrainian Side referred to a request already been sent concerning the establishment of a new regular service Athens – Lvov. The Greek Side undertook to respond, in the light of the above mentioned terms, within two months. The Ukranian Side informed the Greek Side that they have already signed the IINTERBUS Agreement, pending, though, the ratification process, at present. The Greek Side expressed their wish to be informed, as soon as the ratification process is completed.
Miscellaneous The Ukrainian Side noted that drivers operating road transport have often faced difficulties in the issuing of visas by the Greek Consulates in Ukraine. Moreover, they added that since they have concluded the “Agreement between the European Union and Ukraine on the facilitation of the E.U. issuance of visas”, Ukrainian drivers should be subject to a simplified procedure. The Greek Side requested for specific information in order to convey this issue to the competent Ministry of Foreign Affairs. The two Sides underlined their satisfaction for the constant improvement of bilateral road transportation as well as for the level of cooperation achieved. fruitful cooperation. The Ukrainian Side invited the Greek Side in Ukraine for the next Meeting of the Joint Ukrainian - Hellenic Transport Committee. This Protocol was done in Athens on the 28th of May 2009 in two original copies in the English language. The Greek Delegation

Η Ελληνική Αντιπροσωπεία είχε επικεφαλής τον Τριαντάφυλλο Παπατριανταφύλλου, Διευθυντή της Διεύθυνσης Εμπορευματικών Μεταφορών του Υπουργείου Μεταφορών και Επικοινωνιών της Ελληνικής Δημοκρατίας. Η Ουκρανική Αντιπροσωπεία είχε επικεφαλής τον Petro Glavatskiy, Αναπληρωτή Διευθυντή της Κρατικής Διοίκησης Μηχανοκίνητων Μεταφορών του Υπουργείου Μεταφορών και Επικοινωνιών της Ουκρανίας. Οι κατάλογοι της Ελληνικής και της Ουκρανικής Αντιπροσωπείας επισυνάπτονται ως Παράρτημα Ι του παρόντος Πρωτοκόλλου. Η ακόλουθη ημερήσια διάταξη εγκρίθηκε από τις αντιπροσωπείες: − Ανταλλαγή στατιστικών στοιχείων − Οδικές εμπορευματικές μεταφορές − Οδικές επιβατικές μεταφορές − Διάφορα θέματα Με στόχο την περαιτέρω ενίσχυση της Ελληνο−Ουκρανικής αμοιβαίας συνεργασίας στον τομέα των μεταφορών, οι δύο Πλευρές είχαν εποικοδομητικές συζητήσεις για όλα τα θέματα κοινού ενδιαφέροντος και κατέληξαν στα ακόλουθα συμπεράσματα:
Ανταλλαγή στατιστικών στοιχείων Και οι δύο Πλευρές τόνισαν την ικανοποίηση τους για τη συνεχή αύξηση του συνολικού όγκου των συναλλαγών, κατά τη διάρκεια των τελευταίων πέντε ετών. Ωστόσο, η παγκόσμια οικονομική κρίση είχε, πρόσφατα, έναν αρνητικό αντίκτυπο στην εξέλιξη των εμπορικών συναλλαγών. Και οι δύο Πλευρές εξέφρασαν την ελπίδα on η κρίση θα ξεπεραστεί σύντομα, προς όφελος, μεταξύ άλλων, των μεταφορέων κατ των επιχειρηματιών και των δύο χωρών.
