Φ.0544/Μ.5932/ΑΣ.793 Έγκριση του Πρωτοκόλλου της συνάντησης μεταξύ Αντιπροσωπειών του Υπουργείου Μεταφορών της Ρωσικής Ομοσπονδίας και του Υπουργείου Μεταφορών και Επικοινωνιών της Ελληνικής Δημοκρατίας» (Μόσχα, 12−13 Ιουλίου 2006). ΟΙ ΥΠΟΥΡΓΟΙ ΕΞΩΤΕΡΙΚΩΝ − ΜΕΤΑΦΟΡΩΝ ΚΑΙ ΕΠΙΚΟΙΝΩΝΙΩΝ Έχοντας υπόψη: 1− τις διατάξεις της Συμφωνίας μεταξύ των Κυβερνήσεων της Ελληνικής Δημοκρατίας και της Ένωσης Σοβιετικών Σοσιαλιστικών Δημοκρατιών περί διεθνών οδικών μεταφορών και του συνημμένου σ’ αυτή Πρωτοκόλλου, που υπογράφηκε στη Μόσχα, στις 12 Φεβρουαρίου 1985 και κυρώθηκε με τον ν. 1605/1986, που δημοσιεύθηκε στο υπ’ αριθμόν 88 Φύλλο Εφημερίδος της Κυβερνήσεως, τεύχος Α΄, της 7ης Ιουλίου 1986. 2− το άρθρο δεύτερο σύμφωνα με το οποίο τα Πρωτόκολλα ή Πρακτικά που καταρτίζονται σε εκτέλεση της Συμφωνίας κατά τις συνομιλίες των αρμοδίων εκπροσώπων των συμβαλλομένων μερών του άρθρου 21 αυτής, εγκρίνονται με κοινή Πράξη των αρμοδίων κατά περίπτωση Υπουργών. 3− τις διατάξεις του Πρωτοκόλλου μεταξύ της Κυβέρνησης της Ελληνικής Δημοκρατίας και της Κυβέρνησης της Ρωσικής Ομοσπονδίας σχετικά με το διμερές συμβατικό πλαίσιο των δύο χωρών, που υπογράφηκε στην Αθήνα, στις 13 Δεκεμβρίου 1995 και εγκρίθηκε με Ανακοίνωση (ΦΕΚ 4 Α΄/16.1.1996). 4− τις διατάξεις του άρθρου 90 της Κωδικοποίησης της νομοθεσίας για την Κυβέρνηση και τα Κυβερνητικά όργανα (π.δ.63−ΦΕΚ 98/Α/22.4.2005). 5− το γεγονός ότι εκ της εφαρμογής των διατάξεων του υπό έγκριση Πρωτοκόλλου ουδεμία δαπάνη προκαλείται σε βάρος του κρατικού προϋπολογισμού πλέον αυτής που προκύπτει από τις βασικές διατάξεις της Συμφωνίας και που είχε εκτιμηθεί στην Έκθεση του Γενικού Λογιστηρίου του Κράτους. 6− Το περιεχόμενο του υπό έγκριση Πρωτοκόλλου, αποφασίζουμε: Εγκρίνουμε ως έχει και στο σύνολό του το Πρωτόκολλο της συνάντησης μεταξύ Αντιπροσωπειών του Υπουργείου Μεταφορών της Ρωσικής Ομοσπονδίας και του Υπουργείου Μεταφορών και Επικοινωνιών της Ελληνικής Δημοκρατίας, που υπογράφηκε στην Μόσχα, στις 13 Ιουλίου 2006, του οποίου το κείμενο σε πρωτότυπο στην αγγλική γλώσσα και σε μετάφραση στην ελληνική έχει ως εξής: 2491 of the Ministry of Transport of the Russian Federation and the Ministry of transport and Communication of the Hellenic Republic 12 −13 July 2006 Moscow The meeting between the Delegations of the Ministry of Transport of the Russian Federation and the Ministry of Transport and Communication of the Hellenic Republic took place on July 12−13 2006 in Moscow. The list of the DeIegations is attached hereto. Delegations have agreed on agenda as follows:
Exchange of information and statistical data on the carriage of goods between Russia and Greece.
Discussion of the draft Agreement on International Road Transport.
Carriage of goods.
Carriage of passengers.
MiscelIaneous. To the first issue Delegations exchanged the information and statistical data on volumes of road goods and passenger transport between Russia and Greece in 2005 and the past period of 2006. The Delegations noted with satisfaction the development of road goods and passenger transport between Russia and Greece. The Russian Delegation informed that in 2005 the volume of road goods transported between Russia and Greece, was 73.5 thousand tones and showed a 55% growth in comparison with 2004. In the first quarter of 2006 − 13.6 thousand tones, that is 19% higher than in the same period in 2005. The share of the Russian road carriers for the traffic in 2005 amounted to 12.6%. The Greece share amounted to 2.9%. There was a significant prevalence of road carriers of third countries − 84.5%. The Russian Delegation has expressed its concern on the situation connected with the high share of the third country carriers on the road transport market between Russia and Greece and has pointed out that it is necessary for both parties to undertake more efforts to activate the work of their national carriers. Due to the statistic data given by the Service on the Control in the sphere of transport of Russian Federation the volumes of passenger transport between Russia and Greece have fallen down by 7% in accordance with 2004. However in the first quarter 2006 the volume of passenger transport between Russia and Greece has grown up to 150 % in comparison with first quarter of 2005. The Greek Delegation confirmed the above mentioned data, pointing out that in 2005 the Greek transport operators used only 550 bilateral and transit permits in comparison with the agreed quota of 1000 permits and 25 permits to/from third countries which are too less than the number of 100 permits. This decrease of the market share carried out the Greek operators is affiliated to the performance of the major part of bilateral exchanges by third−country operators using CEMT permits and to the difficulties of granting visa to the Greek drivers by competent Russian authorities. Both sides committed themselves to address properly the corresponding diplomatic services in order to simplify procedure of visa issuance, in particular to increase the time period of its validity to one year for multiple entries and to harmonize the cost of its issuance. To the second issue The Delegations stated that transport of goods and passengers between Russia and Greece and transit through their territories have been carried out by road transport operators in conformity with the Agreement on International Road Transport of February, 12, 1985 and that there aren’t particular problems connected to their performance. At the same time, within the work on updating legislative − legal base it should be appropriate to prepare and sign a new intergovernmental Agreement on International Road Transport. The Delegations elaborated article by article a new draft Agreement on Road Transport on the basis of the text that was presented by the Russian side. The Delegations agreed on all articles of the draft Agreement attached to this Protocol, to the exception of Art. 10, p. 2 which is not acceptable by the Greek side. In this context the Russian side undertook to present a rephrasing of Art.10. The draft Agreement as formulated during the discussions will be further examined by the competent authorities of the two sides and will be exchanged in an official form between the two Ministries. To the third issue The Russian Delegation informed that in accordance with its analysis, the quantity of Greek permits used by Russian carriers in 2006, is 1,3 times less than in 2005. The quantity of carriages to/from the third countries also reflects a decrease being estimated at 2,7 times in comparison with year 2005. In this connection, Russian Delegation suggested to set for the 2006 and 2007 the following quota: 1000 permits for bilateral and transit carriages and 150 permits for carriages to/from third countries. The Greek Delegation agreed with the above mentioned quota. To the 4−th issue The Delegations confirmed that the regular services currently existing between Russian Federation and Greece are operated by (5) Russian and (3) Greek carriers. The Russian Delegation informed the Greek Delegation about the fact that for the issuance of Russian permits for the operation of international regular services to the Russian Federation, a carrier should have documents which confirm the right for the bus departure from certain departure points of the service and for ticket−issuing for the passenger. During the discussion of the issue connected with permits for carriers carrying out regular bus services between Russia and Greece the Russian Delegation agreed with the proposal made by Greek Delegation that the departure times of carriers operating the same regular bus service between Russia and Greece should differ at least 4 hours. In accordance with the Article 3 of the intergovernmental Agreement on International Road Transport currently in force occasional passenger services between Russia and Greece or in transit through their territories are carried out on a permit basis to the exclusion of the cases specified in the Article 4 of the abovementioned Agreement. in case such necessity arises both countries will positively examine this issue through a written procedure. To the 5−th issue The Greek Delegation asked the Russian Delegation to give information regarding Regulations for vehicles exceeding permissible weight dimensions while carrying out the carriage on the Russian territory. The Russian Delegation agreed to give this information at e nearest future. Both Delegations noted with satisfaction the constructive and friendly climate of the meeting. The Greek Delegation has proposed to hold the following meeting in Greece. The terms and the place of the meeting will be agreed additionally. The Russian Delegation has accepted the proposal with gratitude. The Protocol made in Russian and English languages and in the event of difference of opinions arises as to the interpretation of this Protocol, the English text shall prevail Done on July 13,2006 in Moscow.
