ΟΙ ΥΠΟΥΡΓΟΙ ΕΞΩΤΕΡΙΚΩΝ - ΜΕΤΑΦΟΡΩΝ ΚΑΙ ΕΠΙΚΟΙΝΩΝΙΩΝ - ΕΜΠΟΡΙΚΗΣ ΝΑΥΤΙΛΙΑΣ Έχοντας υπόψη τις διατάξεις:

Της Συμφωνίας περί ρυθμίσεως της οδικής διακινή?σεως επιβατών και εμπορευμάτων μεταξύ των δύο χωρών ως και της διελεύσεως τράνζιτ μεταξύ των εδαφών των που υπογράφηκε στην Αθήνα στις 9.7.1964 και κυρώθηκε με το υπ’ αριθ. 4393/1964 Νομοθετικό Διάταγμα που δη?μοσιεύθηκε στο υπ’ αριθ. 193 Φύλλο της Εφημερίδας της Κυβερνήσεως τεύχος Α΄ της 4.11.1964.

Το περιεχόμενο του υπό έγκριση Πρωτοκόλλου εκ της εφαρμογής των διατάξεων του οποίου δεν προκαλεί?ται πρόσθετη δαπάνη επιβαρύνουσα τον Κρατικό Προϋ?πολογισμό, αποφασίζουμε: Εγκρίνουμε ως έχει και στο σύνολό του το Πρωτόκολλο της 12ης Συνόδου της Μόνιμης Έλληνο-Βουλγαρικής Υποε?πιτροπής Μεταφορών που υπογράφηκε στην Αθήνα στις 31.10.2001, του οποίου το κείμενο σε πρωτότυπο στην αγ?γλική και σε μετάφραση στην Ελληνική γλώσσα έχει ως εξής: Αθήνα, 22 Μαρτίου 2002 ΟΙ ΥΠΟΥΡΓΟΙ ΕΞΩΤΕΡΙΚΩΝ ΜΕΤΑΦΟΡΩΝ ΚΑΙ ΕΠΙΚΟΙΝΩΝΙΩΝ Γ. ΠΑΠΑΝΔΡΕΟΥ Χ. ΒΕΡΕΛΗΣ ΕΜΠΟΡΙΚΗΣ ΝΑΥΤΙΛΙΑΣ Γ. ΑΝΩΜΕΡΙΤΗΣ OF THE 12TH SESSION OF THE PERMANENT P R O T O C O L - HELLENIC - BULGARIAN SUB-COMMITTEE ON TRANSPORT Athens, 30 -31 October 2001 The 12TH session of Permanent Hellenic - Bulgarian Sub?Committee on Transport, took place in Athens from 30 to 31 October 2001. The Hellenic Delegation was headed by Mr. Ioannis Kon?stantinidis, Secretary General of the Ministry of Transport and Communications of the Hellenic Republic. The Bul?garian Delegation was headed by Mr. Lyubomil Ivanov Deputy Minister of Tansport and Communications of the Republic of Bulgaria. The list of the Hellenic and Bulgarian Delegations is attached as Annex I and II to this Protocol. The Agenda of the session is presented in Annex III of this Protocol. As a result of the bilateral negotiations, the two Dele?gations reached the following conclusions and decisions: I. Draft Agreement on International Road Transport of Passengers and Goods Acknowledging the fact that the existing Agreement on In?ternational Road Transport of Passengers and Goods be?tween the two Countries, signed in 1964, does not meet the existing international standards in this field, both Sides con?sidered the possibility to adopt a new Agreement on Inter?national Road Transport of Passengers and Goods, upon the updated draft texts that were exchanged by the two Sides during this session. The two Sides agreed that the details of this Agreement will be discussed in the forthcoming meeting of an Expert Joint Committee. The Bulgarian Side invited the Greek Side to Sofia in De?cember 2001. The Greek side accepted the invitation. The exact date of the meeting will be agreed through corre?spondence. II. Road Transport of Passengers The two Sides reviewed the existing framework for re?gular passengers services operation. In this context, both Sides expressed their satisfaction with the existing regular bus lines between Bulgaria and Greece. The Greek Side informed the Bulgarian Side about de?lays in the procedure of issuing transit permits for regular bus lines. The Bulgarian Side communicated that delays might oc?cur only due to missing information in the set of application documents. Provided that all needed information and do?1303 operators of the two Countries should meet the principle of reciprocity and agreed to discuss this issue in detail, during the forthcoming expert meeting to be held in Sofia in December 2001. The issue of weighing buses will also be discussed in this meeting. Both Sides agreed to examine the possibilities of esta?blishing separate priority Corridors for regular bus services as well as to take the appropriate measures to facilitate bor?der crossing procedures and reduce delays. As far as occasional passengers' services are con?cerned, the Bulgarian Side informed the Greek Side that the Bulgarian Government has signed the INTERBUS Agreement. The Greek Side informed the Bulgarian Side on the new national regulatory framework for regular bus services, with Countries outside EU and asked the Bulgarian Side to take into consideration the fact that the existing permits will be in force until 15 December 2001. The Bulgarian Side stated that this framework creates new conditions for the operation of the existing regular bus lines between the two Countries. The Greek Side commited itself to send, as soon as pos?sible, details regarding the tendering procedures, in order a clear view of the new framework, to be obtained by the Bulgarian Side. Moreover, the Greek Side undertook the commitment to send the approved list of operators by the Greek Ministry of Transport and Communications, to the Bulgarian Side, un?til the 5th December 2001. The Bulgarian Side committed itself that an official reply to this request, will be communicated, directly or through diplomatic channels, as soon as the above mentioned commitments, undertaken by the Greek Side, are fulfilled and in compliance with the agreed procedure for issuing of permits. Both Sides agreed to discuss this issue in detail during the meeting in Sofia in December 2001. The Bulgarian Side proposed the Greek Side to extend the validity of the existing permits until 15th January 2002, in order to facilitate passengers’ traffic during Christmas holidays. The Greek Side undertook to reply to this request as soon as possible. III. Road Transport of Goods Both sides exchanged information regarding the per?formed transport of goods between and through the two Countries and stated their desire to continue fruitful co-op?eration in this field. Both Sides expressed their satisfaction concerning their constructive co-operation on the facilitation of internatio?nal road transport of goods and stated their willingness to further enhance this co-operation. In this context, they stressed the importance of the Memorandum of Under?standing on the Facilitation of Road Transport of Goods in SECI region, which provides a consistent framework for further promoting and expanding regional co-operation in this field. The Bulgarian Side communicated that the national le?gislation in the field of international road transport of goods, mainly regarding the technical provisions concern?ing maximum permissible weights and dimensions of goods vehicles has been harmonized with Directive 96/53/EEC. The Bulgarian Side informed that transition period for the maximum permissible axle weight has been negotiated in Annex V of the Transit Agreement with E.U. Bothe Sides also stated their willingness to harmonize charging systems of international road transport of goods, with the standards prevailing in EU and according to the principles of transparency, non discrimination and cost re?latedness adopted in the framework of the Memorandum of Understanding on the Facilitation of Road Transport of Goods in SECI region. The Bulgarian Side suggested that the number of per?mits from third countries transport should be increased. The Greek Side undertook the responsibility to submit its reply for the increase of the number of permits from third countries transport, in due course. The Bulgarian Side suggested that the Greek Side should communicate the reply to this request, until 15th January 2002. Both Sides agreed that the preliminary quota of the year 2002 remains 150 permits from third countries. IV. Rail Transport Both sides stated their interest in operating quality passen?gers’ trains and a block train on Sofia - Thessalonica line. The technical details will be negotiated, between the Railway Companies of the two countries, at expert level. Both Sides considered the possibility of convening a tri?lateral meeting of the Representatives of the Railway Com?panies, of Greece, Bulgaria and Romania to discuss the improvement of the Railway Line Athens - Thessalonica - Sofia - Bucharest both for passengers’ and freight trans?port. The Hellenic Railways Organization will organize the first meeting, in Athens by the end of the year 2001. Both Sides stated their willingness to simplify border - crossing procedures aiming at facilitating international rail transport. V. Draft Agreement on International Combined Transport of Goods Acknowledging the fact that there is a need to meet the existing international standards in the field of transport the two Sides considered the possibility to adopt a new Agree?ment on International Combined Transporrt of Goods be?tween the two Countries and the details of this Agreement will be discussed in the forthcoming meeting of the Expert Joint Committee in December 2001 in Sofia. VI. Transport Infrastructure The Greek side presented its position on the alignment of the southern part of Corridor IX stating that there are two equivalent alternative alignments: • Haskovo - Kurdjali - Makaza - Komotini - Alexan?droupolis, and • Haskovo - Svilengrad - Ormenio - Alexandroupolis. The Greek informed that this position has been re?peatedly registered in the three meetings of the relevant Steering Committee (June 1996, November 1997 and May 2000) and has been officially adopted in the Final TINA Re?port (November 1999), as well as in the last report of Pan?European Corridors and Transport Areas by the European Commission (February 2000). 1304 ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ (ΤΕΥΧΟΣ ΠΡΩΤΟ) The Greek side referred to the road connection Svilen?grad - Burgas, belonging to the TINA network, with con?struction time horizon of 2008, and reiterated its willing?ness to finance a pre-feasibility study amounting to 1,2 mil?lion $ made in January 1999, in order to facilitate the construction of this project. The Bulgarian Side undertook to submit its reply in due course. The Greek Side informed the Bulgarian Side about the status of the construction works of the three new road con?nections Drama - Goce Delcev, Xanthi - Rudozem and Ko?motini - Makaza, in the Greek territory and requested the Bulgarian Side to submit the respective information in the Bulgarian territory. The Greek Side, in the framework of the Financial Memo?randum of PHARE CBC/Interreg Programme will continue assisting the Bulgarian Side to obtain the necessary funds according to the progress of the Projects. The Bulgarian Side informed the Greek side about the fi?nalizing of the Project for rehabilitation and electrification of the railway section of Dupnitsa - Kulata, along the Pan Eu?ropean Transport Corridor IV, which was financed by PHARE CBC Programme. The Bulgarian Side informed the Greek side about the fi?nalizing of the Studies for upgrading E79 Road (Kulata - Sofia) to a motorway width along the Pan European Trans?port Corridor IV. The Bulgarian side requested information on the status of the TWIN project on Greek territory. The Greek Side un?dertook provide this information. VII. Maritime Transport Both sides stressed their strong interest in further deve?loping and promoting the co-operation between the two countries in the field of maritime transport. In particular, both Sides pointed out their interest with re?gard to the co-operation between the main Greek and Bul?garian ports in the transport of cargoes and the respective transport of passengers by cruise ships. The Greek Side informed the Bulgarian Side for its willingness to provide know-how and experience on issues concerning the formulation of the institutional framework for the operation of the Bulgarian ports on the basis of the relative directives and general legal framework of the E.U. In addition, both Sides agreed to consider particular is?sues regarding the co-operation between Greek and Bul?garian Ports (and especially the Ports Thessalonica - Lom and Alexandroupolis - Bourgas), aiming at the improve?ment of the transportation of transit cargoes. For this pur?pose it was also agreed the establishment of a Working Group in which representatives from the private transport sector will participate. This Working Group will convene regularly either in Greece (Thessalonica - Alexandroupo?lis) or Bulgaria (Sofia - Varna - Bourgas) whereas its activi?ties is planned to commence in mid - December 2001 or the beginning of 2002, the exact date and place of which to be determined accordingly. Finally, both sides were informed about the recent de?velopments in the legal operative status of their ports and exchanged views on issues of mutual commercial - ma?ritime interest. Both Sides agreed that the 13th Session of the Perma?nent Bulgarian - Hellenic Sub - Committee on Transport should be held in Sofia in 2002. This Protocol was done on 31 October 2001, in two orig?inal copies in the English language, both being equally au?thentic.
