Φ.0544/4/ΑΣ30/Μ.5315 Έγκριση του Προγράμματος ανταλλαγών στους τομείς του Πολιτισμού, της Εκπαίδευσης, των Επιστημών, των Μέσων Μαζικής Ενημέρωσης, της Νεολαίας και του Αθλητισμού μεταξύ της Κυβέρνησης της Ελληνι?κής Δημοκρατίας και της Κυβέρνησης της Δημοκρα?τίας της Τουρκίας. Αθήνα, 8.11.2001. ΟΙ ΥΠΟΥΡΓΟΙ ΟΙΚΟΝΟΜΙΑΣ ΚΑΙ ΟΙΚΟΝΟΜΙΚΩΝ - ΕΞΩΤΕΡΙΚΩΝ - ΕΘΝΙΚΗΣ ΠΑΙΔΕΙΑΣ ΚΑΙ ΘΡΗΣΚΕΥΜΑΤΩΝ - ΠΟΛΙΤΙΣΜΟΥ - ΤΥΠΟΥ ΚΑΙ ΜΕΣΩΝ ΜΑΖΙΚΗΣ ΕΝΗΜΕΡΩΣΗΣ Έχοντας υπόψη τις διατάξεις:
Της Συμφωνίας Πολιτιστικής συνεργασίας μεταξύ της Κυβερνήσεως της Ελληνικής Δημοκρατίας και της Κυ?βερνήσεως της Δημοκρατίας της Τουρκίας που υπογρά?φηκε στην Αθήνα στις 4 Φεβρουαρίου 2000 και κυρώθηκε με τον υπ’ αριθ. 2929/2001 Νόμο που δημοσιεύθηκε στο υπ’ αριθ. 142 Φύλλο της Εφημερίδας της Κυβερνήσεως στις 27 Ιουνίου 2001 Τεύχος Α΄.
Του νόμου 2929/2001 βάσει του οποίου τα Πρωτό?κολλα-Πρακτικά που καταρτίζονται βάσει της ανωτέρω Συμφωνίας εγκρίνονται με κοινή απόφαση των αρμοδίων κατά περίπτωση Υπουργών.
Του νόμου 1558/1985 Κυβέρνηση και Κυβερνητικά Όργανα (ΦΕΚ. 137/Α/1985).
Του περιεχομένου του υπό έγκριση Προγράμματος εκ των διατάξεων του οποίου δεν προκαλείται πρόσθετη δαπάνη, αποφασίζουμε: Εγκρίνουμε ως έχει και στο σύνολό του το Πρόγραμμα ανταλλαγών στους τομείς του πολιτισμού, της εκπαίδευ?σης, της επιστήμης, των Μέσων Μαζικής Ενημέρωσης, της νεολαίας και του αθλητισμού μεταξύ της Κυβέρνησης της Ελληνικής Δημοκρατίας και της Κυβέρνησης της Δη?μοκρατίας της Τουρκίας που υπογράφηκε στην Αθήνα στις 8.11.2001 του οποίου το κείμενο σε πρωτότυπο στην αγγλική γλώσσα και σε μετάφραση στην ελληνική έχει ως εξής: CULTURAL, EDUCATIONAL, SCIENTIFIC, MASS MEDIA, YOUTH AND SPORTS EXCHANGE PROGRAMME BETWEEN THE GOVERNMENT OF THE HELLENIC REPUBLIC AND THE GOVERNMENT OF THE REPUBLIC OF TURKEY The Government of the Hellenic Republic and the Gov?ernment of the Republic of Turkey, hereinafter referred to as the «Parties», inspired by their mutual desire to strength?en and deepen the ties of friendship between the two coun?tries; convinced that contacts, exchanges and cooperation in the fields of culture and arts, education, science, mass media, youth and sports shall lead to a better understand?ing of their history, traditions, respective cultures, and in conformity with the bilateral Cultural Agreement, signed in Athens, on February 4, 2000, have agreed on the following Exchange Programme, which they believe shall serve as a viable framework and constitute a firm ground to enhance their bilateral relations. I. EDUCATION AND SCIENCE I.a. EDUCATION ARTICLE 1 The Parties shall encourage cooperation between their respective educational authorities and institutions in order to improve their knowledge of mutual educational systems, programmes and teaching methods. ARTICLE 2 The Parties shall exchange information and documen?tation regarding their primary, secondary and higher ed?ucational systems with a view to facilitate the equivalence and the reciprocal recognition of diplomas, academic de?grees, certificates and titles awarded by their respective educational institutions. ARTICLE 3 During the validity of this Programme, the Parties shall exchange two (2) teachers from primary education, two (2) teachers from secondary education and two (2) professors from their Technological Educational Institutions, with a view to get informed about the educational system of the other country. ARTICLE 4 The Parties shall exchange information and lecturers and 1463 enrich their common denominators and shared values. ARTICLE 5 The Parties shall continue their cooperation towards the objective presentation of the history, geography and culture of the other country in the textbooks of the various educational institutions in accordance with the spirit and objectives of UNESCO and the Council of Europe. Within this framework, the Parties shall hold, if deemed necessary, expert meetings the details of which shall be determined through diplomatic channels. ARTICLE 6 The Parties shall stimulate the establishment of «Sister school» relations at the level of primary and secondary ed?ucation, through the Department of International Relations of the Ministry for National Education and Religious Affairs of the Hellenic Republic and the Ministry of National Ed?ucation of the Republic of Turkey, in order to develop friendly relations between their respective teachers, stu?dents and their families. ARTICLE 7 The Parties shall support the participation of primary and secondary school students in international activities, such as competitions, fairs, festivals and exhibitions to be or?ganised in their respective countries. ARTICLE 8 The Parties shall grant, annually, each other: a) four (4) scholarships for post-graduate studies or re?search, for a period of up to ten (10) months, each. b) six (6) scholarships for the attendance to the summer courses of their language and culture. ARTICLE 9 The Parties shall encourage exchange programmes of students between their respective universities. ARTICLE 10 The Parties shall reciprocally encourage the exchange of university professors, scolars and experts, with a view to promote their respective cultural and natural heritage and to conduct studies of preservation of archaeological sites in their countries. I.b. SCIENCE ARTICLE 11 The Parties shall initiate scientific and technological co?operation by the way of promoting direct contacts between their respective higher education and scientific institutions, including the exchange of academicians, scientists and in?formation along with the realisation of joint projects of re?searches, seminars and congresses. The Parties shall also support the reciprocal exchange of academicians, scientists and researchers for short periods with the aim of exchanging views, delivering conferences or giving lectures and conducting research in various fields of joint interest. ARTICLE 12 The Parties shall provide each other with information con?cerning international symposia, congresses, conferences, seminars, colloquiums etc. of scientific nature to be held in their respective countries and shall exchange scientific re?ports to be published at the conclusion of such meetings. ARTICLE 13 The Higher Educational Institutions of Greece at all levels shall cooperate with the relevant Institutions of Turkey with a view to exchange members of their staff and students in the framework of European Union, Council of Europe, OECD and UNESCO programmes. The Greek Party shall provide technical know-how for the development of technological educational institutions and particulary for: a) The upgrading of facilities and organising of their lab?oratories. b) The organising and updating of libraries. c) The training of the staff in using new laboratory equip?ment. d) The organising and updating of the administrative de?partments and the training of the administrative staff. e) The development of a technology transferring network. f) The development of new curricula. g) The exchange of staff and students through TEMPUS programme. h) The development of common EU programmes. i) The study and organising of the development of high?er education at a national level. II. ARCHIVES AND LIBRARIES ARTICLE 14 The Parties shall encourage cooperation between their respective state archives administrations, namely the Gen?eral Directorate of State Archives of the Republic of Turkey and the Directorate of State Archives and the State Gener?al Archives of the Hellenic Republic, with a view to serve their mutual interests in the best manner and in conformity with their national legislation as well as with the inter?national archival practice. ARTICLE 15 The Parties agree to ask the exchange of copies from archival documents, microfilms, electronic archives, cata?logues, indexes etc. according to the national legislation of each Party, with a view to enrich their collections. ARTICLE 16 During the validity of the present Programme, both par?ties shall exchange two (2) archivists, for a period of up to ten (10) days, with a view to carry out research in their archives and to exchange knowledge related to modern technologies, as well as to the conservation and recovery of archives. ARTICLE 17 The Parties agree to participate in exhibitions with repro?duced samples of archival material. ARTICLE 18 The Parties shall instigate both bilateral and multilateral 1464 ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ (ΤΕΥΧΟΣ ΠΡΩΤΟ) ARTICLE 19 The Parties shall exchange information, publications, pe?riodicals and microfilms between their National Libraries. ARTICLE 20 The Parties shall mutually encourage the exchange of microfilms of manuscripts of equal value and catalogues. During the validity of the present Programme, both Par?ties shall exchange two (2) librarians, for a period of up to ten (10) days, with a view to get informed in matters of their speciality. ARTICLE 21 The Parties shall inform each other regarding inter?national book fairs and exhibitions to be organised in their respective countries, and shall assist the publication of translated literary works of their respective writers. ARTICLE 22 The Parties shall prompt the exchange of books between their public libraries. ARTICLE 23 The Parties shall encourage the reciprocal participation of their librarians and experts in the international scientific meetings in this field to be organized in their respective countries. III. CULTURE AND ARTS During the validity of this Programme, III.a. FOLK CULTURE ARTICLE 24 The Parties shall inform each other about the internation?al scientific conferences and seminars etc. to be organised in their respective countries in the field of folk culture and shall encourage the participation of their scientists and experts on the basis of reciprocity in such events. ARTICLE 25 The Parties shall exchange publications and other mate?rial among their respective institutions in the field of folk culture. The Parties shall exchange, on the basis of reciprocity, one or two (1-2) experts, for a period of up to seven (7) days each, to conduct research in cooperation with the in?stitutions dealing with and shall exchange exhibitions of folk culture. ARTICLE 26 The Parties shall inform each other regarding various in?ternational folklore festivals to be organised in their re?spective countries and shall encourage the participation of their folklore groups in such festivals. III.b. CINEMA ARTICLE 27 The Parties shall encourage the organising of film days, during which they shall exchange one or two (1-2) experts in the field of cinema. Technical and other details shall be determined through direct co-operation between the competent authorities of the two countries. ARTICLE 28 The Parties shall encourage the realisation of joint film productions by their film producers. ARTICLE 29 The Parties shall provide information and facilitate the participation of professional short and long films and film artists (also directors, scenarists and technical staff etc.) in international film festivals to be organised in their respec?tive countries. ARTICLE 30 The Parties shall inform each other about the inter?national conferences, panels and symposia concerning intellectual property rights, and exchange information, publications and documentation related to their respec?tive intellectual property rights legislation and the settle?ment of disputes emerging from the intellectual property rights issues. IIIc. THEATRE ARTICLE 31 The Parties shall encourage direct and indirect cooper?ation in the field of theatre, with a view to enable the stag?ing of the selected translated versions of the plays by their playwrites and exchange theatre administrators, directors and artists. ARTICLE 32 The Parties shall encourage the realization of theatre workshops and the participation in festivals with the theatri?cal groups to be organized in their respective countries. III.d. PRESERVATION OF CULTURAL HERITAGE AND ARCHAEOLOGY ARTICLE 33 The Parties shall cooperate in the prevention of illegal im?portation / exportation and transfer of works of art and cultural property, and shall take all the necessary preven?tive measures by their customs services with a view to pre?vent illegal trade of cultural property. ARTICLE 34 The Parties shall exchange two (2) archaeologists and two (2) experts in preservation of archaeological sites, for a period of up to ten (10) days each, with a view to exchange information and experience in matters of their speciality. ARTICLE 35 The Parties shall cooperate in the field of preservation and conservation of cultural and historical heritage pursuant to the relevant conventions of UNESCO, the Council of Europe and other international agreements of which they are contracting Parties. ARTICLE 36 The Parties shall reciprocally invite and encourage the participation of their respective officials and scientists in congresses, conferences and symposia to be organised in their respective countries in the field of preservation of ar?ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ (ΤΕΥΧΟΣ ΠΡΩΤΟ) 1465 historical and/or natural monuments. The two Parties ex?pressed their readiness to hold photographic exhibitions. ARTICLE 38 The Parties shall exchange archaeological publications, between their competent authorities. III.e. OPERA, BALLET AND MUSIC ARTICLE 39 The Parties shall promote contacts and cooperation be?tween their respective artistic institutions and societies and shall encourage the exchange of artists, conductors, soloists and artistic groups, on a commercial or non com?mercial basis. ARTICLE 40 The Parties shall encourage reciprocally the holding of concerts by the Presidential Symphony Orchestra of Turkey with a Greek soloist and the State Symphony Or?chestra of Greece with a Turkish soloist. The Parties shall inspire the establishment of «Sister-Or?chestras» relationship between the orchestras of their ma?jor cities across the Aegean coast, such as between Izmir and Thessaloniki. ARTICLE 41 The Parties shall encourage the participation of their artists and artistic groups in international contests and fes?tivals dealing with music, opera, theatre, ballet and dance to be held in their respective countries. III.f. EXHIBITIONS ARTICLE 42 The Parties shall inform each other about the inter?national events in various cultural and artistic fields and en?courage cooperation and exchanges among arts in?stitutions. ARTICLE 43 The Parties shall reciprocally promote the exchange of exhibitions of photography, sculpture and painting. In the case of antiquities, any particular national legislation ap?plied to them shall be respected. ARTICLE 44 The Parties shall support the exchange of exhibitions by their artists in the field of plastic arts and provide facilities for their artists to visit and meet with their counterparts and arts institutions. IV. YOUTH AND SPORTS ARTICLE 45 The Parties shall encourage direct contacts and cooper?ation between their respective youth and sports authori?ties. ARTICLE 46 The Parties shall encourage direct contacts, exchanges and joint initiatives between their youth and sports soci?eties, institutions and associations. These initiatives and activities shall be regulated through diplomatic channels. ARTICLE 47 The Parties shall promote the reciprocal participation of their youth in the summer camps to be organised in their respective countries. The details of this exchange (number of persons, organisational and financial conditions) shall be agreed upon through diplomatic channels. ARTICLE 48 The Parties welcome the joint efforts of the International Olympic Committee and the General Assembly of the United Nations for the revival of Olympic Truce and its ob?servance during the Olympic Games and beyond. Within this context, the Parties welcome the initiative tak?en by Greece and by the International Olympic Committee for the establishment of an International Olympic Truce Center in Athens and reaffirm their will to support actively this initiative by educational, cultural and other similar means. V. MASS MEDIA ARTICLE 49 The Parties shall encourage direct cooperation between their respective state radio and television institutions (ERT and TRT). Based on their mutual membership to the Euro?pean Broadcasting Union (EBU), they shall encourage the exchange of programmes regarding culture and sciences. ARTICLE 50 The Parties shall encourage cooperation between their respective newspapers, press agencies and other infor?mation services with a view to promote the exchange of in?formation and printed material. The Parties shall also support the reciprocal exchange of personalities from the world of media. ARTICLE 51 The Parties shall facilitate the exchange of information re?lated with the economic, political, cultural and social life prevalent in their respective countries with a view to foster a deeper understanding between their people. ARTICLE 52 The Parties shall facilitate a free and improved dissemi?nation of information through cooperation in the area of broadcasting via modern communication means such as cable technology and satellite. VI. CONTACTS BETWEEN PEOPLE ARTICLE 53 The Parties shall support direct contacts between their people and the establishment of «Sister-City» relationships between cities of the two countries. VII. FINANCIAL PROVISIONS ARTICLE 54 FINANCIAL PROVISIONS IN THE FIELDS OF SCIENCE AND EDUCATION, LIBRARIES AND ARCHIVES a) Exchange of Individuals
The sending Party shall cover the cost of two way in?ternational airfare (to the place of activity and return) for In?dividuals sent under this Programme. In case the place of 1466 ΕΦΗΜΕΡΙΣ ΤΗΣ ΚΥΒΕΡΝΗΣΕΩΣ (ΤΕΥΧΟΣ ΠΡΩΤΟ) - 22.000 drachmas daily for hotel accommodation and al?lowance - travel expenses within Greek territory, if they result from the programme of stay - costs for a one or two-day (1-2) visit to archaeological or historical sites.
The Turkish Party shall provide: - board and lodging expenses - local transportation expenses.
In case of emergency, medical assistance, in a public hospital, will be provided by the receiving Party, for per?sons arriving under the provisions of this Programme. The cost of long term treatment and dental prostheses shall not be covered.
Both Parties reserve the right to adjust the daily al?lowance, according to the increase of the cost of living.
Scholars of both Parties shall themselves provide round trip transportation between the two countries. -a monthly allowance of 150.000 drachmas for post?graduate scholars or researchers. - a lump sum of 20.000 drachmas, for accommodation fees for those settling in Athens and of 30.000 drachmas for those settling in the provinces. Students whose scholar?ship has been renewed are not entitled to this sum - exemption from tuition fees. - travel expenses within Greek territory, according to the approved programme of studies, up to the sum of 30.000 drachmas
