Electoral (Revision of Constitutencies) Act , 1935
1 The Principal Act.
1.—(1) In this Act the expression “the Principal Act” means the Electoral Act, 1923 (No. 12 of 1923).
(2) Every word and expression to which a particular meaning is given by the Principal Act for the purposes of that Act has in this Act the meaning so given, save that the word “prescribed” means prescribed by order made by the Minister for Local Government and Public Health.
2 Revision of Constituencies.
2.—The Eighth Schedule to the Principal Act is hereby amended as follows, that is to say:—
(a) by the deletion of the words “nineteen hundred and twenty-three” now contained in rule 2 of the said Eighth Schedule and the insertion in that rule of the words “nineteen hundred and thirty-four” in lieu of the words so deleted, and
(b) by the deletion of Part I of the said Eighth Schedule and the insertion in that Schedule of Part I of the First Schedule to this Act in lieu of the Part so deleted, and
(c) by the deletion of Part II of the said Eighth Schedule and the insertion in that Schedule of Part II of the First Schedule to this Act in lieu of the Part so deleted,
and the Principal Act, and in particular section 50 thereof shall be construed and have effect accordingly.
3 Number of members of Dáil Eireann.
3.—So much of sub-section (1) of section 50 of the Principal Act as enacts that Dáil Eireann shall consist of one hundred and fifty-three members shall cease to have effect on the commencement of this Act, and in lieu thereof it is hereby enacted that Dáil Eireann shall consist of one hundred and thirty-eight members returned by borough constituencies and county constituencies, together with such number of members (if any) as is for the time being required by law to be returned by university constituencies.
4 Returning officers and assistant returning officers.
4.—(1) The officer specified in the second column of the Second Schedule to this Act opposite the name in the first column of the said Second Schedule of any constituency shall be the returning officer for that constituency.
(2) The provisions contained in the third column of the Second Schedule to this Act opposite the name in the first column of the said Second Schedule of any constituency shall have effect in relation to the assistant returning officer for that constituency.
(3) Sub-section (1) of section 23 of the Principal Act is hereby repealed.
5 Constituency of the Ceann Comhairle.
5.—The County Constituency of East Galway as defined in Part II of the First Schedule to this Act shall be the constituency corresponding, for the purposes of Article 21 of the Constitution, to the County Constituency of Galway existing at the passing of this Act.
6 Amendment of section 41 of the Principal Act.
6.—Paragraph (b) of sub-section (2) of section 41 of the Principal Act is hereby amended by the deletion of the words “adjoining the constituency” now contained therein, and the insertion of the words “adjoining the county in which the constituency or the greater part thereof is situate” in the said paragraph in lieu of the words so deleted, and the said section shall be construed and have effect accordingly.
7 Title-page of electors lists, etc.
7.—(1) The title-page of every electors list, list of claimants, list of objections, and register of electors prepared under the First Schedule to the Principal Act after the passing and before the commencement of this Act for a registration unit in a constituency existing at the passing of this Act which is not identical in area and name with a constituency defined in the First Schedule to this Act, shall show in the prescribed manner the name of the constituency defined in the First Schedule to this Act in which such registration unit will be situate as well as the name of the said existing constituency in which such registration unit is situate at the passing of this Act.
(2) This section shall come into operation immediately upon the passing of this Act.
8 Commencement of this Act.
8.—Save as is otherwise provided by this Act, this Act shall come into operation immediately upon the dissolution of the Oireachtas which shall occur next after the passing of this Act.
9 Short title and citation.
9.—(1) This Act may be cited as the Electoral (Revision of Constituencies) Act, 1935.
(2) The Electoral Acts, 1923 to 1927, and this Act may be cited together as the Electoral Acts, 1923 to 1935.
