Oil Pollution of the Sea (Amendment) Act , 1965

1 Amendment of lines 67 ot 69 of the Charter of 1828.

1.—The Charter of 1828 shall be read and construed as if the following words were deleted therefrom where the same appear in lines 67 to 69 thereof, that is to say, the words “and also for inflicting upon all and every Delinquent or Offender, whether Apprentice or Pupil, Member or Licentiate, such reasonable Pains, Penalties and Punishments, by Censure, Suspensions, Amation or Fine, as to them the said President Vice President and Members, or the Majority of them so convened shall seem meet, Provided such Pecuniary Penalty shall not exceed in any case the sum of Fifty Pounds,”.

2 Amendment of lines 144 to 148 of the Charter of 1828.

2.—The Charter of 1828 shall be read and construed as if the following words were deleted therefrom where the same appear in lines 144 to 148 thereof in the Oath or Declaration to be taken by Licentiates, that is to say, the words “and shall at the same time in the presence of the said President or Vice President, Sign Seal and Execute a Bond or Obligation in, and for the Sum of FIVE HUNDRED POUNDS to the said College, conditioned for the due and faithful Observance, Performance and Fulfilment of all and every the Statutes, Bye Laws and Ordinances of said College, and of the said Declaration, and all matters and provisions in them or any of them contained, or to be contained, which said Bond or Obligation, the said College is hereby empowered to Take, Enforce, and Sue upon”.

3 Amendment of lines 163 and 164 of the Charter of 1828.

3.—The Charter of 1828 shall be read and construed as if the following words were deleted therefrom where the same appear in lines 163 and 164 thereof, that is to say, the words “and Executing the Bond, directed to be made and Executed by Licentiates upon their Admission”.

4 Amendment of lines 36, 40 and 41 of the Supplemental Charter of 1844.

4.—The Supplemental Charter of 1844 shall be read and construed as if the following words were deleted therefrom where the same appear, that is to say, in line 36 thereof the words “and the Licentiates of the said College” and in lines 40 and 41 thereof the words “and also to provide regulations for inflicting upon any Delinquent whether Apprentice or Pupil, Fellow or Licentiate such reasonable pains penalties and punishments by censure, suspension, amotion or fine as to them so assembled shall seem meet, provided such pecuniary penalty shall not exceed in any case the sum of fifty pounds And” and as if in substitution for the words so last deleted the word “provided” were inserted therein.

5 Amendment of lines 106 and 107 of the Supplemental Charter of 1844.

5.—The Supplemental Charter of 1844 shall be read and construed:—

(a) As if the following words were deleted therefrom where the same appear in line 106 thereof, that is to say, the words “or that either before or after obtaining such his Letters Testimonial or Diploma he shall have wilfully violated any Bye law Rule or Regulation of the said College,” and as if in substitution therefor the following words were inserted therein, that is to say, the words “or that he shall have committed, done or suffered any act or thing in consequence or by reason whereof his name shall have been erased from The Register of Medical Practitioners for Ireland, or shall have been erased or removed from a register or other authorised roll or record of medical practitioners by law established or maintained elsewhere than in Ireland”.

(b) As if the following words were deleted therefrom where the same appear in line 107 thereof, that is to say, the words “the person so offending” and as if in substitution therefor the following words were inserted therein, that is to say, the words “such Fellow or Licentiate”,

6 Amendment of line 33 of the Supplement Charter of 1885.

6.—The Supplemental Charter of 1885 shall be read and construed as if the following words were deleted therefrom where the same appear in line 33 thereof, that is to say, the words “and the Licentiates of the said College”.

7 Amendment of lines 42 to 45 of the Supplemental Charter of 1885.

7.—The Supplemental Charter of 1885 shall be read and construed as if the following words were deleted therefrom where the same appear in lines 42 to 45 thereof, that is to say, the words “and also to provide regulations for inflicting upon any delinquent whether Apprentice or Pupil, Fellow or Licentiate such reasonable pains, penalties and punishments by censure suspension amotion or fine as to them so assembled shall seem meet provided such pecuniary penalty shall not exceed in any case the sum of Fifty pounds and” and as if, in substitution therefor, the following word was inserted therein, that is to say, the word “provided”.

8 Amendment with respect to approval of bye-laws.

8.—The said Charters or Letters Patent shall have effect subject to the substitution of the Minister for Education as the approving authority for bye-laws made by the Council of the said College.

9 Charters remain in full force and effect.

9.—Save as hereby amended, the said Charters or Letters Patent shall be and remain in full force and effect.

10 Expenses.

10.—The costs charges and expenses preliminary to and of and incidental to the preparing obtaining and passing of this Act shall be paid by The Royal College of Surgeons in Ireland out of the funds of the said College.

11 Short title.

11.—This Act may be cited as The Royal College of Surgeons in Ireland (Charter Amendment) Act, 1965.
