“Iris Oifigiúil” of 7th November, 2014.
I, SIMON COVENEY, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Implementing Regulation (EU) No 885/2014 of 13 August 20141 and Commission Implementing Regulation (EU) No 1021/2014 of 26 September 20142 , hereby make the following regulations:

These Regulations may be cited as the European Communities (Official Controls on the Import of Food of Non-Animal Origin for Pesticide Residues) (Amendment) (No.4) Regulations 2014.

The European Communities (Official Controls on the Import of Food of Non-Animal Origin for Pesticide Residues) Regulations 2011 ( S.I. No. 426 of 2011 ) are amended by substituting—
- (a) in Regulation 2(1) for the definition of “Commission Regulation 669/2009” the following—
“ ‘Commission Regulation 669/2009’ means Commission Regulation (EC) No. 669/2009 of 24 July 20093 as amended by Commission Regulation (EU) No. 212/2010 of 12 March 20104 , Commission Implementing Regulation (EU) No 323/2014 of 28 March 20145 , Commission Implementing Regulation (EU) No 718/2014 of 27 June 20146 and Commission Implementing Regulation (EU) No 1021/2014 of 26 September 2014 and Commission Regulation (EU) No. 885/2014 of 13 August 2014;”, and
- (b) Regulation 12(2)(o) for the following—
“(o) provides misleading information in relation to a proposed re-dispatch of a consignment in accordance with Article 21 of EC Regulation 882/2004;
(p) contravenes Commission Implementing Regulation (EU) No 885/2014 of 13 August 2014.”.

The European Communities (Official Controls on the Import of Food of Non-Animal Origin for Pesticide Residues) (Amendment) (No.3) Regulations 2014 ( S.I. No.343 of 2014 ) are revoked.
