Health and Criminal Justice (Covid-19) (Amendment) Act 2021
1. Amendment of section 2 of Health (Preservation and Protection and other Emergency Measures in the Public Interest) Act 2020
1. Section 2 of the Health (Preservation and Protection and other Emergency Measures in the Public Interest) Act 2020 is amended—
(a) in subsection (3), by the substitution of the following paragraph for paragraph (b):
“(b) Part 3, continue in operation for the period beginning on the 10th day of June 2021 and ending on the later of—
(i) the 9th day of November 2021, or
(ii) the date that is specified in a resolution passed by each House of the Oireachtas under subsection (6).”,
and
(b) by the addition of the following subsection after subsection (5):
“(6) Each House of the Oireachtas may, before the 9th day of November 2021, pass a resolution to continue in operation the amendments effected by Part 3 for such period, not exceeding 3 months, that ends on a date specified in the resolution.”.
2. Amendment of section 1 of Emergency Measures in the Public Interest (Covid-19) Act 2020
2. Section 1 of the Emergency Measures in the Public Interest (Covid-19) Act 2020 is amended by the substitution of the following subsections for subsection (3):
“(3) The amendments to, and other modifications of, the Mental Health Act 2001 effected by Part 5 continue in operation for the period beginning on the 10th day of June 2021 and ending on the later of—
(a) the 9th day of November 2021, or
(b) the date that is specified in a resolution passed by each House of the Oireachtas under subsection (4).
(4) Each House of the Oireachtas may, before the 9th day of November 2021, pass a resolution to continue in operation the amendments to, and other modifications of, the Mental Health Act 2001 effected by Part 5 for such period, not exceeding 3 months, that ends on a date specified in the resolution.
(5) For the avoidance of doubt, it is hereby declared that, on and from the 9th day of November 2021 or such later date as is specified in a resolution passed by each House of the Oireachtas under subsection (4), the Mental Health Act 2001 shall apply and have effect as it applied and had effect immediately before the coming into operation of Part 5 but subject to any amendments made by any other Act of the Oireachtas after such coming into operation.”.
3. Amendment of section 17 of Criminal Justice (Enforcement Powers) (Covid-19) Act 2020
3. Section 17 of the Criminal Justice (Enforcement Powers) (Covid-19) Act 2020 is amended by the substitution of the following subsections for subsection (3):
“(3) This Act continues in operation for the period beginning on the 10th day of June 2021 and ending on the later of—
(a) the 9th day of November 2021, or
(b) the date that is specified in a resolution passed by each House of the Oireachtas under subsection (4).
(4) Each House of the Oireachtas may, before the 9th day of November 2021, pass a resolution to continue this Act in operation for such period, not exceeding 3 months, that ends on a date specified in the resolution.”.
4. Amendment of section 6 of Health (Amendment) Act 2020
4. Section 6 of the Health (Amendment) Act 2020 is amended by the substitution of the following subsections for subsection (3):
“(3) This Act continues in operation for the period ending on the later of—
(a) the 9th day of November 2021, or
(b) the date that is specified in a resolution passed by each House of the Oireachtas under subsection (4).
(4) Each House of the Oireachtas may, before the 9th day of November 2021, pass a resolution to continue this Act in operation for such period, not exceeding 3 months, that ends on a date specified in the resolution.”.
5. Short title and commencement
5. (1) This Act may be cited as the Health and Criminal Justice (Covid-19) (Amendment) Act 2021.
(2) This Act shall come into operation on the 10th day of June 2021.
