Notice of the making of this Statutory Instrument was published in

I, MICHEÁL MARTIN, Taoiseach, in exercise of the powers conferred on me by section 25 (1) of the Statistics Act 1993 (No. 21 of 1993) and for the purpose of giving further effect to Regulation (EU) 2019/2152 of the European Parliament and of the Council of 27 November 2019¹ , as amended by Commission Delegated Regulation (EU) 2021/1704 of 14 July 2021² and Commission Delegated Regulation (EU) 2026/47 of 10 December 2025³ , hereby order as follows:

• (a) in Article 2(1), in the definition of “Regulation”, by the substitution of “, as amended by Commission Delegated Regulation (EU) 2021/1704 of 14 July 2021² and Commission Delegated Regulation (EU) 2026/47 of 10 December 2025³ ” for “, as amended by Commission Delegated Regulation (EU) 2021/1704 of 14 July 2021² ”,

• (b) by the substitution of the following Article for Article 3:

“3. This Order applies to an institutional unit that is classified for statistical purposes under section B, C, D, E, F, G, H, I, J, K, L, M, N, O, Q, R, S or T of NACE Rev. 2.1, as set out in Annex I to Regulation (EC) No. 1893/2006 of the European Parliament and of the Council of 20 December 2006⁴ , as amended by Regulation (EC) No. 295/2008 of the European Parliament and of the Council of 11 March 2008⁵ , Regulation (EU) No. 70/2012 of the European Parliament and of the Council of 18 January 2012⁶ , Regulation (EU) 2019/1243 of the European Parliament and of the Council of 20 June 2019⁷ and Commission Delegated Regulation (EU) 2023/137 of 10 October 2022⁸ .”,

• (c) in Article 4, by the substitution of “in relation to 2025” for “in relation to each year in the period from 2021 to 2025”, and

• (d) in paragraph 1 of the Schedule, by the substitution of “during 2025” for “during the year to which the information relates”.

• (a) in Article 2(1) –

• (i) in the definition of “Regulation”, by the substitution of “as amended by Commission Delegated Regulation (EU) 2021/1704 of 14 July 2021² and Commission Delegated Regulation (EU) 2026/47 of 10 December 2025³ ” for “as amended by Commission Delegated Regulation (EU) 2021/1704 of 14 July 2021² ”, and

• (iii) by the substitution of “NACE Rev. 2.1” for “NACE Rev. 2”,

• (d) in Article 5, by the substitution of “NACE Rev. 2.1” for “NACE Rev. 2”,

• (e) in Article 6, by the substitution of “in the period from August 2026 to December 2027” for “in the period from January 2023 to December 2027”, and

• (f) in Article 7, by the substitution of “in the period from 1 July 2026 to 31 December 2027” for “in the period from 1 January 2023 to 31 December 2027”.

• (c) in Article 4, by the substitution of “in the period commencing from 1 July 2026 and ending on 31 January 2029” for “in the period commencing from 1 February 2024 and ending on 31 January 2029”.

• (a) in Article 2(1) –

• (i) in the definition of “Regulation”, by the substitution of “as amended by Commission Delegated Regulation (EU) 2021/1704 of 14 July 2021² and Commission Delegated Regulation (EU) 2026/47 of 10 December 2025³ .” for “, as amended by Commission Delegated Regulation (EU) 2021/1704 of 14 July 2021;² ”, and

• (ii) by the deletion of the definition of “relevant period”,

• (b) by the substitution of the following Article for Article 3:

“3. This Order applies to a person who, or an undertaking that, is classified for statistical purposes under division 47 or class 56.30 of NACE Rev. 2.1 set out in Annex I to Regulation (EC) No.1893/2006 of the European Parliament and of the Council of 20 December 2006⁴ , as amended by Regulation (EC) No. 295/2008 of the European Parliament and of the Council of 11 March 2008⁵ , Regulation (EU) No. 70/2012 of the European Parliament and of the Council of 18 January 2012⁶ , Regulation (EU) 2019/1243 of the European Parliament and of the Council of 20 June 2019⁷ and Commission Delegated Regulation (EU) 2023/137 of 10 October 2022⁸ .”, and

• (c) by the substitution of the following Article for Article 4:

“4. A requirement on persons or undertakings to which this Order applies to provide, for the purposes of the inquiry, information the general nature of which is specified in the Schedule, monthly and in relation to the immediately preceding month in the period commencing from 1 August 2026 and ending on 31 December 2028, is hereby prescribed.”.

• (a) in Article 2(1) –

• (i) in the definition of “Regulation”, by the substitution of “as amended by Commission Delegated Regulation (EU) 2021/1704 of 14 July 2021² and Commission Delegated Regulation (EU) 2026/47 of 10 December 2025³ .” for “as amended by Commission Delegated Regulation (EU) 2021/1704 of 14 July 2021² ;”, and

• (ii) by the deletion of the definition of “relevant period”,

• (b) by the substitution of the following Article for Article 3:

“3. This Order applies to a person who, or an undertaking that, is classified for statistical purposes under division 46 or section H, I, J, K, M, N, O, S or T of NACE Rev. 2.1 set out in Annex I to Regulation (EC) No. 1893/2006 of the European Parliament and of the Council of 20 December 2006⁴ , as amended by Regulation (EC) No. 295/2008 of the European Parliament and of the Council of 11 March 2008⁵ , Regulation (EU) No. 70/2012 of the European Parliament and of the Council of 18 January 2012⁶ , Regulation (EU) 2019/1243 of the European Parliament and of the Council of 20 June 2019⁷ and Commission Delegated Regulation (EU) 2023/137 of 10 October 2022⁸ .”, and

• (c) by the substitution of the following Article for Article 4:

“4. A requirement on persons or undertakings to which this Order applies to provide, for the purposes of the inquiry, information the general nature of which is specified in the Schedule, monthly and in relation to the immediately preceding month in the period commencing from 1 August 2026 and ending on 31 December 2028, is hereby prescribed.”.

• (b) in Article 3, by the substitution of “division 37 or 39 or group 38.1, 38.2 or 38.3 of section E of NACE Rev. 2.1” for “division 37 or 39 or group 38.1 or 38.2 of section E of NACE Rev. 2”,

• (c) by the substitution of the following Article for Article 4:

“4. A requirement on an undertaking that is classified for statistical purposes in division 36 or group 35.3 of section D of NACE Rev. 2.1 set out in Annex I to Regulation (EC) No. 1893/2006 to provide, for the purposes of the survey, the information specified in subparagraphs (a), (d), (e), (f) and (g) of paragraph 1 and paragraph 2 of the Schedule, is hereby prescribed.”,

• (d) by the substitution of the following Article for Article 5:

“5. A requirement on an undertaking that is classified for statistical purposes under section D or section E of NACE Rev. 2.1 set out in Annex I to Regulation (EC) No. 1893/2006 to provide, for the purposes of the survey, the information specified in subparagraphs (b), (d), (e), (f) and (g) of paragraph 1 and paragraph 2 of the Schedule, is hereby prescribed.”,

• (e) by the substitution of the following Article for Article 6:

“6. A requirement on an undertaking that is classified for statistical purposes in group 38.2 of section E of NACE Rev. 2.1 set out in Annex I to Regulation (EC) No. 1893/2006 to provide, for the purposes of the survey, the information specified in subparagraphs (d), (e), (f) and (g) of paragraph 1 and paragraph 2 of the Schedule, is hereby prescribed.”,

• (f) in Article 7, by the substitution of “NACE Rev. 2.1” for “NACE Rev. 2”,

• (g) by the substitution of the following Article for Article 8:

“8. The undertakings in relation to which a requirement to provide information is prescribed in Articles 3, 4, 5, 6 and 7 shall provide the information referred to in the Article concerned monthly and in relation to the immediately preceding month in the period commencing from 1 July 2026 and ending on 28 February 2029.”,

and

• (h) in paragraph 1 of the Schedule, by the deletion of subparagraph (c).
