I, JENNIFER CARROLL MACNEILL, Minister for Health, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving full effect to Commission Delegated Regulation (EU) 2026/743 of 30 March 2026¹ , hereby make the following regulations:

Citation

1.

These Regulations may be cited as the European Union (Food Intended for Infants and Young Children, Food for Special Medical Purposes, and Total Diet Replacement for Weight Control) (Amendment) Regulations 2026.

Definitions

In these Regulations—

“Principal Regulations” means the European Union (Food Intended for Infants and Young Children, Food for Special Medical Purposes, and Total Diet Replacement for Weight Control) Regulations 2019 ( S.I. No. 425 of 2019 );

“Regulations of 2025” means the European Union (Food Intended for Infants and Young Children, Food for Special Medical Purposes, and Total Diet Replacement for Weight Control) (Amendment) Regulations 2025 ( S.I. No. 128 of 2025 ).

Amendment of Regulation 2 of Principal Regulations

Regulation 2(1) (amended by Regulation 3 of the Regulations of 2025) of the Principal Regulations is amended—

(a) by the substitution of the following definition for the definition of “Annex I to EU Regulation 2016/127”:

“ ‘Annex I to EU Regulation 2016/127’ means Annex I to EU Regulation 2016/127 as amended by—

(a) paragraph (1) of the Annex to Commission Delegated Regulation (EU) 2019/828 of 14 March 2019² , and

(b) paragraph (1) of the Annex to Commission Delegated Regulation (EU) 2026/743 of 30 March 2026¹ ;”,

(b) by the substitution of the following definition for the definition of “Annex II to EU Regulation 2016/127”:

“ ‘Annex II to EU Regulation 2016/127’ means Annex II to EU Regulation 2016/127 as amended by—

(a) the Annex to Commission Delegated Regulation (EU) 2018/561 of 29 January 2018³ ,

(b) paragraph (2) of the Annex to Commission Delegated Regulation (EU) 2019/828 of 14 March 2019² , and

(c) paragraph (2) of the Annex to Commission Delegated Regulation (EU) 2026/743 of 30 March 2026¹ ;”,

“ ‘Annex III to EU Regulation 2016/127’ means Annex III to EU Regulation 2016/127 as amended by—

(a) paragraph (3) of the Annex to Commission Delegated Regulation (EU) 2022/519 of 14 January 2022⁴ , and

(b) paragraph (3) of the Annex to Commission Delegated Regulation (EU) 2026/743 of 30 March 2026¹ ;”,

(d) by the substitution of the following definition for the definition of “Annex IV to EU Regulation 2016/127”:

“ ‘Annex IV to EU Regulation 2016/127’ means Annex IV (inserted by paragraph (1) of the Annex to Commission Delegated Regulation (EU) 2021/1041 of 16 April 2021⁵ ) to Commission Delegated Regulation (EU) 2016/127;”, and

(e) by the substitution of the following definition for the definition of “Annex V to EU Regulation 2016/127”:

“ ‘Annex V to EU Regulation 2016/127’ means Annex V (inserted by paragraph (2) of the Annex to Commission Delegated Regulation (EU) 2021/1041 of 16 April 2021⁵ ) to Commission Delegated Regulation (EU) 2016/127”, and

(f) by the substitution of the following definition for the definition of “EU Regulation 2016/127”:

“ ‘EU Regulation 2016/127’ means Commission Delegated Regulation (EU) 2016/127 of 25 September 2015⁶ as amended by Commission Delegated Regulation (EU) 2018/561 of 29 January 2018³ , Commission Delegated Regulation (EU) 2019/828 of 14 March 2019² , Commission Delegated Regulation (EU) 2021/572 of 20 January 2021⁷ , Commission Delegated Regulation (EU) 2021/1041 of 16 April 2021⁵ , Commission Delegated Regulation (EU) 2022/519 of 14 January 2022⁴ and Commission Delegated Regulation (EU) 2026/743 of 30 March 2026¹ ;”.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations give effect to Commission Delegated Regulation (EU) 2026/743 of 30 March 2026 amending Delegated Regulation (EU) 2016/127 as regards the protein-related requirements for infant and follow-on formula manufactured from protein hydrolysates.

These Regulations amend the European Union (Food Intended for Infants and Young Children, Food for Special Medical Purposes, and Total Diet Replacement for Weight Control) Regulations 2019 ( S.I. No. 425 of 2019 ) in the manner specified in these Regulations.
