Art. 1
1.Piena ed intera esecuzione e' data all'accordo sulle norme europee di telecomunicazioni per i terminali (NET), adottato a Copenaghen il 15 novembre 1985 dalla Conferenza europea delle amministrazioni delle poste e telecomunicazioni, a decorrere dalla sua entrata in vigore in conformita' a quanto disposto dall'art. 6 dell'accordo stesso.

Memorandum
Memorandum of understanding on European telecommunication standards (normes Europeennes de telecommunications, net's) for terminal equipment. Agreed at the meeting of Directors-General of CEPT Administrations (Copenhagen, 15 November 1985) convened in accordance with the decision of the meeting of the CEPT Telecommunications Commission (Nice, June 1985). This Memorandum of Understanding, the existence of which has been recognised by the European Conference of Postal and Telecommunications Administrations (CEPT), is open for adhesion to any member of CEPT in whose country legislation exists directly or via international treaty permitting European Telecommunication Standards (NET's) selected from CEPT technical recommendations on terminal equipments to be given legal force, such that a terminal equipment approved as conforming to a NET in accordance with the appropriate national or multilateral procedures is permitted access to the market and connection to the appropriate public telecommunication network in the country of that CEPT member. The signatories, Recognising: that the quickening pace of technological change and the emergence of new services require, in order to maintain the quality of the information exchange system in Europe, an improvement of harmonised specifications for telecommunications equipment; that the conditions of access of terminal equipment to the networks are laid down on one hand in the legal provisions in force in each country, and on the other hand in the technical and administrative procedures set up by the Administrations; that, therefore, the improvement of harmonisation must also be channelled through both the legal provisions and the technical and administrative procedures, with the effect of giving CEPT Administrations a central role in the establishment of a telecommunications standards policy at the European level; that the governments of the EC have expressed for their part their determination to take the necessary steps to harmonise, within the Community, the legal provisions regarding access to the market, and to the networks, of telecommunication terminal equipment, and that a Council Directive, concerning the initial stage of implementation of the mutual recognition of type approval for telecommunication terminal equipment to be approved at the same time as the coming into force of this MOU allows in particular all CEPT Administrations whose countries are members of the EC to enter into this MOU; that there is a need to seek a wider application of CEPT technical recommendations by CEPT Administrations, and a need to distinguish between the creation and adoption of a technical recommendation on the one hand and its application on the other hand; that CEPT work schedule for new technical recommendations must respond amongst other things to the needs generated by the implementation of the EC Directive mentioned in the Annex, Article 2 (iii) and the EFTA guidelines for standardisation, see EFTA/CJC.SR. 7/84 with appropriate complements; that the procedures set up by the present MOU, to improve the conditions of application of CEPT technical recommendations, do not affect the normal functioning of CEPT; Resolve: to support the present method of working within CEPT for the creation and adoption of technical recommendations. In particular, that these activities should be pursued by all CEPT Administrations on an equal basis and that adoption of technical recommendations shall be by consensus with the very minimum of alternatives being permitted in the technical recommendations in order to secure timely adoption by consensus and to aim for recommendations free of ambiguity and scope for differing interpretations; to establish, out of CEPT technical recommendations for terminal equipment, European Telecommunication Standards (NET's) (1), and initiate the means of giving them sufficient mandatory force through the procedure given in the Annex to this MOU; to use European Telecommunication Standards (NET's) or part or parts thereoff applying in a country for type approval purposes in the purchasing specifications of terminal equipment by Public Telecommunication Operators (2); to permit the parties entitled by national regulation to own the relevant telecommunication terminal equipments to connect to any of its relevant telecommunications networks telecommunication terminal equipment approved in accordance with national or multilateral procedures (eg EC) as conforming to the appropriate European Telecommunication Standard (NET); to form within CEPT, an autonomous Technical Recommendations Application Committee, in which each signatory of the present MOU shall be represented to constitute the body which will be responsible for the implementation of the MOU. The appropriate authorities ensure in countries where private telecommunication operators exist that no distortion of competition would be introduced because of the application of European Telecommunication Standards (NET's) either through the Directive mentioned in the Annex, Article 2 (iii) or in countries where the Directive does not apply through appropriate national regulations.
Annex
ANNEX Procedures to be adopted within the European conference of postal and telecommunications administrations (CEPT) by the MOU signatories for turning CEPT terminal equipment technical recommendations or part or parts thereoff into mandatory European telecommunications standards. Article 1. The signatories of this Memorandum of Understanding who are either Administrations of the CEPT whose countries are members of the EC or Administrations of the CEPT who have appropriate domestic legal instrument which would have the effect of giving comparable legal force to CEPT technical recommendations as would result within EC Member States from the application of an EC Directive shall establish a committee to be referred to as the Technical Recommendations Application Committee. Article 2. The functions of this Committee shall be: (i) deciding which terminal equipment technical recommendations or part or parts thereoff are candidate for mandatory application from existing CEPT studies and from then on, at the outset of any new proposed studies; (ii) deciding whether a terminal equipment technical recommendation (already adopted by the appropriate CEPT procedures) or part or parts thereoff shall become a European Telecommunication Standard (NET); (iii) sending all such European Telecommunication Standards (NET's) to the Commission of the European Community and other relevant competent authorities to be referred to in the frame of appropriate legislation (in the case of the EC the Directive on the first phase of the establishment of the mutual recognition of type approval for telecommunication terminal equipment (cross reference to be added) and to provide the conduit of communications for any specific needs arising from the aforementioned Directive between CEPT and the EC Commission not catered for in the more general EC Commission /CEPT dialogue; (iv) providing the signatories of the MOU with a forum for discussion on problems related to the implementation of the MOU and possible extension of the scope of the MOU to other telecommunication equipment areas. Any proposals for such extensions shall be notified to all signatories 3 months in advance of being considered by the Technical Recommendations Application Committee and shall be incorporated into the Memorandum of Understanding providing no member of the Committee votes against the proposal. Article 3. 3.1. The Technical Recommendations Application Committee shall appoint its own Chairman. The Secretariat for the Committee shall be provided by the Administration of the Chairman. The same Administration shall act as repository for the Memorandum of Understanding. 3.2. A decision of the Committee: 3.2.1. on matters falling under Article 2 (i)) shall be valid when no member of the Committee votes against a proposal; 3.2.2. on matters falling under Article 2 (ii) shall be valid when a majority of votes are cast in favour of a proposal the votes being in accordance with the specific weightings and the majority given in the Addendum to this Annex and providing a quorum exists at the time the vote is taken equivalent to 50% of the possible number of weighted votes of all signatories. 3.3 A decision by the Committee to accept a technical recommendation or part or parts thereoff shall lead to it being re-termed a European Telecommunication Standard (NET) and at the same time be designated as applicable for the purpose of the Directive mentioned in Article 2 (iii). It shall then be sent by the Committee Secretariat to the Commission for the European Community for action under the EC Directive mentioned in Article 2 (iii) and other authorities for non-EC signatories for appropriate action. Article 4. European Telecommunication Standards (NET's) shall be published through the same procedures as may exist for the publication of CEPT technical recommendations. NET documentation shall be available without restriction to any party seeking them through whatever arrangements are in place for distributing CEPT technical recommendations. Article 5. Proposals for suppression of European Telecommunication Standards (NET's) which have become superceded or obsolete shall be considered by the Committee and decisions taken as set out in Article 3.2.2. Any referral to the Committee concerning defects of an established European Telecommunication Standard (NET) shall be considered as a matter of urgency from the viewpoint of whether to suspend or not the NET. However, any studies on the alleged defects and if appropriate, remedial action shall take place through the normal CEPT procedures and the Committee shall consider any revised technical recommendation for possible adoption as a revised NET. Article 6. The coming into force of this Memorandum of Understanding shall take place at the same time the Council Directive on the initial stage of implementation of the mutual recognition of type approval for telecommunication terminal equipment is approved by the European Community providing at least ten Administrations have signed the MOU or at such later time as ten Administrations have signed the MOU. Article 7. Where at least half of the signatories so agree in writing and not less than two years after the coming into force date of this MOU, a meeting of signatories shall be convened to review the effectiveness of the MOU. At such meetings any changes to the MOU which have shown themselves to be necessary in the light of experience shall be incorporated where no signatories vote against the proposal except Article 3.2.1., where a change of wording to that used in Article 3.2.2. (appropriately changing the reference from Article 2 (ii) to Article 2 (i)) shall be incorporated when a majority of votes are cast in favour of that proposal, the votes being in accordance with the specific weightings and the majority given in the Addendum to this Annex. Article 8. The MOU shall be open for signature as from 15th November 1985 until the coming into force of the MOU. Thereafter it shall be open for adhesion to any CEPT Administrations whose countries are members of the EC or Administrations of CEPT who have appropriate domestic legal instruments which would have the effect of giving comparable legal force to CEPT technical recommendations as would result within EC Member States from the application of an EC Directive. The first meeting of the Technical Recommendations Application Committee shall be convened not later than four weeks after the coming into force of the MOU. Article 9. A signatory may withdraw from the MOU at any time after two years from the coming into force date of the MOU by giving six months notice in writing to all the other signatories.
Addendum
ADDENDUM TO THE ANNEX OF THE MEMORANDUM OF UNDERSTANDING 1. The percentage of votes needed to approve a proposal shall be 71% of the total votes cast (rounded up to the nearest whole number of votes). 2. Allocations of weightings shall be as given below in order to determine the result: France 10 Germany 10 Italy 10 United Kingdom 10 Spain 8 Belgium 5 Greece 5 Netherlands 5 Portugal 5 Denmark 3 Ireland 3 Luxembourg 2 Sweden 5 Switzerland 5 Austria 3 Finland 3 Norway 3 3. The weightings for CEPT Administrations not listed in paragraph 2 above shall be decided unanimously by the Technical Recommendations Application Committee. 4. CEPT Administrations may raise questions on weightings within the Technical Recommendations Application Committee. Accordo
Accordo sulle norme Europee di telecomunicazioni (NET) per i terminali. Adottato alla riunione dei Direttori generali delle Amministrazioni membri della CEPT (Copenaghen, 15 novembre 1985), convocata conformemente alla decisione presa alla riunione della Commissione telecomunicazioni della CEPT (Nizza, giugno 1985). Il presente accordo la cui esistenza e' stata convalidata dalla Conferenza europea delle Amministrazioni delle poste e delle telecomunicazioni (CEPT), e' aperto all'adesione di ogni membro della CEPT la legislazione del cui Paese, in base a leggi proprie o in base ad un trattato internazionale, consente di dare carattere regolamentare e costrittivo alle Norme europee di telecomunicazioni (NET) tratte dalle raccomandazioni tecniche della CEPT sui terminali, in modo tale che un terminale approvato, secondo le procedure nazionali o multinazionali applicabili, in quanto conforme alle Norme europee di telecomunicazioni, possa aver accesso al mercato e essere collegato alla rete pubblica di telecomunicazioni sul territorio del Paese in questione. I firmatari, Riconoscendo: che l'accelerazione dei mutamenti tecnologici e l'apparizione di nuovi servizi richiedono una migliore armonizzazione delle specifiche relative alle apparecchiature di telecomunicazione, in modo da mantenere la qualita' del sistema di scambio di informazioni in Europa; che le condizioni d'accesso dei terminali alle reti sono stabilite da una parte dalla legislazione in vigore in ciascun Paese e dall'altra parte in virtu' delle procedure tecniche e amministrative stabilite dalle Amministrazioni; che, conseguentemente, il miglioramento dell'armonizzazione passa attraverso il rispetto della normativa e delle procedure tecniche ed amministrative, la qual cosa viene ad assegnare alle Amministrazioni della CEPT un ruolo centrale nella definizione di una politica di normalizzazione delle telecomunicazioni a livello europeo; che gli Stati della Comunita' europea hanno espresso, per quanto li riguarda, la loro volonta' di intraprendere le azioni necessarie per armonizzare, in seno alla Comunita', le norme che regolano l'accesso al mercato e alle reti dei terminali di telecomunicazioni e che una direttiva del Consiglio, relativa alla fase iniziale di riconoscimento reciproco delle omologazioni dei terminali di telecomunicazione, la cui approvazione interverra' nello stesso momento dell'entrata in vigore del presente accordo, permette, segnatamente a tutte le Amministrazioni della CEPT (i cui Paesi sono membri della CEE), di divenire parte nel presente accordo; che si rende indispensabile ricercare una piu' ampia applicazione delle raccomandazioni tecniche della CEPT da parte delle Amministrazioni membri della stessa CEPT, cosi' come e' indispensabile operare una distinzione tra l'elaborazione e l'adozione di una raccomandazione tecnica da un lato e la sua applicazione dall'altro lato; che il calendario di lavoro della CEPT concernente le nuove raccomandazioni tecniche, deve, tra l'altro, soddisfare le necessita' che scaturiscono dall'applicazione della direttiva della Comunita' europea di cui all'articolo 2 (iii) dell'allegato e delle direttive AELE per la normalizzazione, cfr. AELE/CJC. SR. 7/84 con i relativi complementi; che l'insieme delle regole stabilite con il presente accordo per migliorare le condizioni di applicazione delle raccomandazioni tecniche della CEPT non influiscono sul normale funzionamento della CEPT. Decidono: di fornire il loro sostegno al metodo di lavoro attualmente in vigore in seno alla CEPT per l'elaborazione e l'adozione di raccomandazioni tecniche. I firmatari decidono in pari tempo di fare in modo che dette attivita' siano poste in essere da tutte le Amministrazioni membri della CEPT, rispettando l'uguaglianza tra di esse e che le raccomandazioni tecniche siano adottate per consenso con il minimo indispensabile di alternative necessarie perche' il consenso possa essere ottenuto in tempo utile e sforzandosi di pervenire a raccomandazioni non ambigue e non suscettibili di interpretazioni divergenti; di stabilire, a partire dalle raccomandazioni tecniche della CEPT per i terminali, delle Norme europee di telecomunicazioni (NET) (1) e di darsi i mezzi per conferire loro carattere di obbligatorieta' sufficiente, utilizzando la procedura di cui all'allegato a questo accordo; di usare le Norme europee di telecomunicazioni (NET) o parti di esse o delle opzioni contenute in esse, applicabili in un Paese, per le procedure di omologazione che figureranno nelle specifiche di acquisto dei terminali da parte dei gestori delle reti di telecomunicazioni (2); di consentire alle parti, autorizzate dalla normativa nazionale ad essere proprietarie dei terminali di telecomunicazioni, di collegare, a tutte le reti di telecomunicazione cui essi sono destinati, i terminali approvati secondo le procedure nazionali o multilaterali (ad esempio quelle della Comunita' europea), come conformi alle Norme europee di telecomunicazioni (NET) considerate; di formare, in seno alla CEPT, un Comitato autonomo per l'applicazione delle raccomandazioni tecniche, in cui ciascun firmatario del presente accordo avra' un rappresentante, allo scopo di costituire l'Organismo incaricato di applicare le disposizioni dell'accordo stesso. Nei Paesi in cui esistono gestori privati di reti di telecomunicazioni, le autorita' competenti assicurano che non venga introdotta alcuna distorsione di concorrenza in conseguenza dell'applicazione delle Norme europee di telecomunicazioni (NET), sia per mezzo della direttiva menzionata all'art. 2 (iii) dell'allegato, sia, nei Paesi in cui la direttiva non e' applicabile, per mezzo di una normativa nazionale adeguata.
