Overeenkomst tussen het Koninkrijk der Nederlanden en Jamaica inzake technische samenwerking

The Government of the Kingdom of the Netherlands and the Government of Jamaica;

Reaffirming the friendly relations between the two States and their peoples;

Desiring to promote technical cooperation, and to create for that purpose the necessary legal and administrative framework;

Have agreed as follows:

Article I

The aim of this Agreement shall be to promote technical cooperation and to create to that effect the legal and administrative framework for technical cooperation projects upon which the competent administrative authorities of the two Parties may decide for the purpose of implementing this Agreement.

A decision to cooperate as referred to in paragraph 1 above, the contributions to a project and the manner in which that project is to be implemented shall in each case be laid down in an administrative arrangement to be established by the two competent administrative authorities.

Article II

In connection with a project, the Government of Jamaica shall:

a). exempt the Netherlands personnel from all taxes and other fiscal charges in respect of all remunerations paid to them by the Netherlands Government;

b). exempt the Netherlands personnel from paying import and customs duties and other fiscal charges including VAT on new or used household and personal effects, imported into Jamaica within six months of the experts' arrival - except in special circumstances when that period may be extended - provided such goods are re-exported from Jamaica at the time of departure or within such period as may be agreed upon by the Government of Jamaica; this re-exportation shall also be exempted from duties and other fiscal charges;

c). exempt the Netherlands personnel from paying import and customs duties and other fiscal charges including VAT on professional equipment to be used for technical cooperation projects and imported into Jamaica during the whole period of their assignment;

d). make provisions for duty-free importation or purchase from bond of one motor-vehicle by the Netherlands personnel staying for a longer period than one year within six months of first arrival in Jamaica, except in special circumstances when that period might be extended or renewed, provided that such vehicle if sold to a person not likewise privileged, shall be subject to payment of an appropriate import duty based on the estimated value of the vehicle at the time of its sale; In case a motor vehicle is damaged beyond economical repair, provisions will be made on a case by case basis, similar to those ruling the importation/purchase of the original vehicle;

e). grant the Netherlands personnel immunity from legal action in respect of any words spoken or written and in respect of any acts performed by that personnel in their official capacity;

f). exempt the Netherlands personnel and their dependants from national service obligations;

g). offer the Netherlands personnel and their families in Jamaica repatriation facilities in time of national or international crises;

h). make provisions for the issue of entry-visas, free of charge, to the Netherlands personnel and their families, employed or to be employed by the Netherlands Government. An expert who has been formally accepted by the Jamaican Government will be provided with a visa either before his departure from the Netherlands or on his arrival in Jamaica;

i). upon acceptance by the Jamaican Government, the Netherlands experts will be exempted from registration, examination and other such requirements relative to their respective professional capacity; except in cases where Jamaican registration is a statutory or regulatory obligation. In such cases, any costs for registration shall be the responsibility of the Government of Jamaica;

j). provide the Netherlands personnel with identity documents to assure them of the full assistance of the appropriate authorities of Jamaica in the performance of their duties;

k). without prejudice to the foreign exchange regulations prevailing on any point at any time in Jamaica, impose no currency or foreign exchange restriction on funds introduced into Jamaica from external sources by the Netherlands personnel and their families for their personal use; external accounts opened in Jamaica, by the Netherlands personnel and their families shall remain at their exclusive disposal, and balances of such accounts shall be freely transferable, provided that such accounts have been fed exclusively from external sources; otherwise the account shall be subject to the usual exchange control provisions.

1. The Government of Jamaica shall ensure that the Netherlands personnel as well as their families are accorded treatment of a manner no less favourable than that accorded to technical assistance personnel assigned to Jamaica by any other country or international organization.

Article III

The Government of Jamaica shall indemnify and hold harmless the Netherlands Government and the Netherlands personnel against any extra-contractual civil liability arising from any act or omission on the part of one or more of the said individuals during the operations governed by or undertaken in virtue of this Agreement causing the death of or physical injury to a third party or damage to the property of a third party, in so far as such liability is not covered by insurance, and shall abstain from making any claim or instituting any action for extra-contractual civil liability unless such liabiliy derives from wilful misconduct or from gross negligence on the part of one or more of the said individuals.

In the event that the Government of Jamaica holds harmless the Government of the Netherlands or one or more of the said individuals against any claim or action from extra-contractual civil liability in accordance with paragraph 1 of this Article, the Government of Jamaica shall be entitled to exercise all rights to which the Government of the Netherlands or the individuals are entitled.

If the Government of Jamaica so requests, the Government of the Netherlands shall provide the competent authorities of Jamaica with the administrative or legal assistance needed for satisfactory solution of any problems that may arise in connection with the application of the paragraphs 1 and 2 of this Article.

Article IV

The Government of Jamaica, after consulting with the Netherlands Government, will have the right to request the recall of any Netherlands personnel whose work or conduct is unsatisfactory; the Netherlands Government, after similar consultations with the Jamaican Government, will have the right to recall any Netherlands personnel at any time; in case of recall, the Netherlands Government will make every effort to obtain an adequate replacement for the recalled Netherlands personnel if the Government of Jamaica so requests.

All Netherlands personnel will carry out their assignment to be agreed upon by the respective competant authorities. As far as the daily operations of a project are concerned they will act in close consultation with the Jamaican authorities responsible for the execution of the project, and they shall respect the operational instructions given by those authorities. The Netherlands personnel shall respect the laws in force in Jamaica.

Article V

The provisions in this Agreement concerning Netherlands personnel shall apply equally to persons employed by the Netherlands Government and to persons employed by business enterprises or other organizations with which the Netherlands Government has concluded an agreement for the execution of a project on which both competent authorities have decided to cooperate.

The Netherlands personnel made available may perform operational or advisory duties.

Article VI

The provisions of Article II, III, IV, paragraph 1, of this Agreement are also applicable to the topping-up experts made available by the Netherlands. However, those experts would be required to pay local income tax on emoluments paid to them by the Government of Jamaica.

The experts, mentioned under paragraph 1 of this Article, shall be under the exclusive direction of the relevant Jamaican authorities. The experts will have to comply with such orders and regulations as are in force in Jamaica at any given time, provided such orders and regulations do not conflict with any provision of this Agreement or any other arrangement between the two Contracting Parties applicable to the experts concerned.

Article VII

The Government of Jamaica shall exempt from all import and export duties and other official charges including VAT the equipment (including motor vehicles) and other supplies provided by the Netherlands Government in connection with a project.

Article VIII

The provisions of this Agreement shall apply equally to the Netherlands personnel already working in the field of technical cooperation projects in Jamaica before the date on which this Agreement becomes effective.

Article IX

This Agreement will be applied provisionally from the date of its signature and shall enter into force on the date on which the two Governments have given each other written notification that the procedures constitutionally required in their respective countries have been complied with.

This Agreement shall remain in force for an initial period of two years. If neither Government declares its intention to terminate the Agreement three months before it expires, the Agreement shall each time be tacitly renewed for a further period of one year. Such termination should be communicated in writing.

In respect of the projects started before the date of termination of this Agreement the foregoing articles shall continue to be effective until the project has been terminated.

With respect to the Kingdom of the Netherlands this Agreement shall apply to the European part of the Kingdom only.

De Regering van het Koninkrijk der Nederlanden en de Regering van Jamaica;

Opnieuw de vriendschappelijke betrekkingen bevestigend die tussen beide Staten en hun volken bestaan;

Geleid door de wens de technische samenwerking te bevorderen en hiertoe het noodzakelijke juridische en administratieve kader te scheppen;

Zijn het volgende overeengekomen:

Artikel I

Het doel van deze Overeenkomst is de technische samenwerking te bevorderen en hiertoe het juridische en administratieve kader te scheppen voor projecten inzake technische samenwerking waartoe de bevoegde bestuurlijke autoriteiten van beide Partijen ter uitvoering van deze Overeenkomst besluiten.

Een besluit tot samenwerking als bedoeld in het eerste lid hierboven, de bijdragen aan een project en de wijze waarop dat project wordt uitgevoerd, worden per geval vastgelegd in een administratief akkoord, te sluiten door de twee bevoegde bestuurlijke autoriteiten.

Artikel II

In verband met een project verbindt de Regering van Jamaica zich ertoe:

a. het Nederlandse personeel vrij te stellen van alle belastingen en andere fiscale heffingen ten aanzien van alle door de Nederlandse Regering aan hen betaalde vergoedingen;

b. het Nederlandse personeel vrij te stellen van invoer- en douanerechten en andere fiscale heffingen, met inbegrip van BTW, op nieuwe of gebruikte huishoudelijke artikelen en persoonlijke bezittingen die in Jamaica worden ingevoerd binnen zes maanden na de aankomst van de deskundigen - behalve in bijzondere omstandigheden, waarin deze termijn kan worden verlengd - op voorwaarde dat deze goederen weer uit Jamaica worden uitgevoerd op het tijdstip van vertrek of binnen een termijn waarmee de Regering van Jamaica instemt; deze wederuitvoer wordt eveneens vrijgesteld van rechten en andere fiscale heffingen;

c. de Nederlandse personeelsleden gedurende de gehele periode van hun aanstelling vrij te stellen van invoer- en douanerechten en andere fiscale heffingen, met inbegrip van BTW, op beroepsuitrusting die wordt gebruikt voor projecten inzake technische samenwerking en in Jamaica wordt ingevoerd;

d. de invoer te regelen, vrij van rechten, of de aankoop uit entrepot, van een motorvoertuig per Nederlands personeelslid dat voor een langere periode dan een jaar in Jamaica blijft, binnen zes maanden na de eerste aankomst in Jamaica, behalve in bijzondere omstandigheden, waarin deze termijn kan worden verlengd of hernieuwd, op voorwaarde dat over dat voertuig, indien het wordt verkocht aan een persoon die niet soortgelijke voorrechten geniet, passende invoerrechten worden betaald op basis van de geschatte waarde van het voertuig op het tijdstip van verkoop. Ingeval een motorvoertuig zodanig beschadigd is dat reparatie op economische gronden niet mogelijk is, wordt er per geval een regeling getroffen die vergelijkbaar is met die welke van toepassing is op de invoer/aankoop van het oorspronkelijke voertuig;

e. de Nederlandse personeelsleden te vrijwaren van rechtsvervolging op grond van in hun officiële hoedanigheid gesproken of geschreven uitingen of verrichte handelingen;

f. de Nederlandse personeelsleden en hun gezinsleden vrij te stellen van nationale dienstplicht;

g. de Nederlandse personeelsleden en hun gezinnen in Jamaica repatriëringsfaciliteiten te bieden in tijden van nationale of internationale crises;

h. regelingen te treffen voor de kosteloze verstrekking van inreisvisa aan de Nederlandse personeelsleden die door de Nederlandse Regering zijn of zullen worden aangesteld en hun gezinnen. Aan een deskundige die door de Jamaicaanse Regering officieel is aanvaard, wordt hetzij voor zijn vertrek uit Nederland, hetzij bij zijn aankomst in Jamaica, een visum verstrekt;

i. de Nederlandse deskundigen, nadat zij door de Jamaicaanse Regering zijn aanvaard, vrij te stellen van registratie, toetsing en andere zodanige vereisten met betrekking tot hun onderscheiden professionele capaciteiten; behalve in gevallen waarin Jamaicaanse registratie is verplicht volgens wettelijke of andere voorschriften. In die gevallen komen de kosten van de registratie voor rekening van de Regering van Jamaica;

j. het Nederlandse personeel identiteitspapieren te verschaffen, zodat zij bij de uitoefening van hun werkzaamheden verzekerd zijn van de volledige steun van de desbetreffende autoriteiten in Jamaica;

k. onverminderd de regelingen voor het wisselen van buitenlands geld die ten aanzien van enig punt op enig tijdstip in Jamaica gelden, geen beperkingen op te leggen voor het wisselen van buitenlands geld dat door de Nederlandse personeelsleden en hun gezinnen uit het buitenland in Jamaica wordt binnengebracht voor persoonlijk gebruik; rekeningen voor niet-ingezetenen die in Jamaica worden geopend door Nederlandse personeelsleden en hun gezinnen, blijven uitsluitend tot hun eigen beschikking en saldi van die rekeningen kunnen vrijelijk worden overgemaakt, mits op die rekeningen uitsluitend uit het buitenland afkomstig geld wordt gestort. Mocht dit niet het geval zijn, dan wordt de rekening onderworpen aan de gebruikelijke bepalingen inzake deviezencontrole.

1. De Regering van Jamaica verzekert dat de Nederlandse personeelsleden en hun gezinnen op niet minder gunstige wijze worden behandeld dan personeel dat ten behoeve van technische bijstand naar Jamaica wordt uitgezonden door andere landen of internationale organisaties.

Artikel III

De Regering van Jamaica stelt de Nederlandse Regering en het Nederlandse personeel schadeloos en vrijwaart ze ter zake van elke extra-contractuele wettelijke aansprakelijkheid die voortvloeit uit het verrichten of nalaten van enige handeling door een of meer van de bedoelde personen tijdens hun werkzaamheden uit hoofde van deze Overeenkomst die de dood van of letsel aan derden of schade aan het eigendom van derden veroorzaken, voorzover deze aansprakelijkheid niet door een verzekering is gedekt, en onthoudt zich van het instellen van vorderingen of het nemen van gerechtelijke stappen vanwege extra-contractuele wettelijke aansprakelijkheid, tenzij de wettelijke aansprakelijkheid het gevolg is van opzettelijk onjuist handelen of grove nalatigheid van een of meer van de bedoelde personen.

Ingeval de Regering van Jamaica de Regering van Nederland of een of meer van de bedoelde personen vrijwaart tegen een vordering of gerechtelijke stappen ter zake van extra-contractuele wettelijke aansprakelijkheid in overeenstemming met het eerste lid van dit artikel, is de Regering van Jamaica gerechtigd alle rechten te doen gelden die de Regering van Nederland of de bedoelde personen kunnen doen gelden.

Indien de Regering van Jamaica zulks verzoekt, verschaft de Regering van Nederland de bevoegde autoriteiten van Jamaica de administratieve of juridische bijstand die nodig is voor een bevredigende regeling van eventuele problemen die kunnen ontstaan in verband met de toepassing van het eerste en tweede lid van dit artikel.

Artikel IV

De raadpleging van dit document komt niet in de plaats van het lezen van het oorspronkelijke Staatsblad of de Staatscourant. Wij aanvaarden geen aansprakelijkheid voor eventuele onnauwkeurigheden die voortvloeien uit de omzetting van het origineel naar dit formaat.
