Oświadczenie rządowe z dnia 15 lutego 2013 r. w sprawie mocy obowiązującej Zmian z Manili do załącznika do Międzynarodowej konwencji o wymaganiach w zakresie wyszkolenia marynarzy, wydawania im świadectw oraz pełnienia wacht, 1978, sporządzonych w Manili dnia 25 czerwca 2010 r

Treść oświadczenia

Podaje się niniejszym do wiadomości, że Prezydent Rzeczypospolitej Polskiej dnia 18 grudnia 2012 r. ratyfikował Zmiany z Manili do załącznika do Międzynarodowej konwencji o wymaganiach w zakresie wyszkolenia marynarzy, wydawania im świadectw oraz pełnienia wacht, 1978 , sporządzone w Manili dnia 25 czerwca 2010 r.

Zgodnie z art. XII ust. 1 lit. a) pkt ix) zdanie pierwsze Międzynarodowej konwencji o wymaganiach w zakresie wyszkolenia marynarzy, wydawania im świadectw oraz pełnienia wacht, 1978, Zmiany z Manili do załącznika do konwencji weszły w życie dnia 1 stycznia 2012 r. w stosunku do Rzeczypospolitej Polskiej oraz pozostałych stron konwencji, które nie zgłosiły sprzeciwu co do Zmian z Manili do załącznika do konwencji oraz nie zawiadomiły Sekretarza Generalnego Międzynarodowej Organizacji Morskiej o uznaniu się za zwolnione z obowiązku stosowania Zmian z Manili do załącznika do konwencji przez okres nie dłuższy niż jeden rok.

Jednocześnie podaje się do wiadomości, co następuje:

1) sprzeciw co do Zmian z Manili do załącznika do konwencji zgłosiła wymieniona poniżej strona konwencji, składając zawiadomienie o następującej treści:

Zawiadomienie otrzymane przez Sekretarza Generalnego dnia 13 czerwca 2011 r.

Ambasada Republiki Finlandii niniejszym informuje, w związku z art. XII ust. 1 lit. a) pkt vii) oraz art. XII ust. 1 lit. a) pkt ix) Konwencji, że z powodu krajowych wymogów proceduralnych Republika Finlandii zobowiązana jest zgłosić sprzeciw wobec powyższych zmian. Ambasada Republiki Finlandii ma zaszczyt poinformować Sekretarza Generalnego, że rząd Republiki Finlandii zamierza przyjąć zmiany, gdy wprowadzone zostaną stosowne zmiany legislacyjne niezbędne do takiego przyjęcia, i że będzie informował Sekretarza Generalnego o postępach w tym zakresie.

The Embassy hereby informs, with reference to article XII(1)(a)(vii) and to article XII(1)(a)(ix) that, due to national procedural requirements, Finland is obliged to object to the above-mentioned amendments. The Embassy has the honour to inform the Secretary-General that the Government of Finland intends to accept the amendments as soon as the legislative amendments necessary to such acceptance have been carried out and that it will not fail to inform the Secretary-General of any developments in this respect.

Zmiany do załącznika do Konwencji i do Kodeksu wejdą w życie dnia 1 stycznia 2012 r. Jednakże, zgodnie z art. XII ust. 1 lit. a) pkt ix) Konwencji STCW, przed ustaloną datą wejścia w życie, strona może poinformować Sekretarza Generalnego o wyłączeniu się ze stosowania zmian przyjętych zgodnie z procedurą określoną w art. XII ust. 2 tej Konwencji, przez okres nie dłuższy niż rok. Minister Spraw Zagranicznych Królestwa Danii niniejszym informuje, że w odniesieniu do prawidła VIII/1 (Zdolność do pełnienia służby) załącznika do Konwencji STCW i sekcji A-VIII/1 Kodeksu STCW, z powodu krajowych wymogów proceduralnych, Królestwo Danii nie jest w stanie stosować zmian z Manili przed dniem 1 stycznia 2013 r. Minister Spraw Zagranicznych Królestwa Danii ma jednakże zaszczyt poinformować Sekretarza Generalnego, że rząd Królestwa Danii będzie informował Sekretarza Generalnego o postępach w tym zakresie.

The amendments to the Annex to the Convention and to the Code will enter into force on 1 January 2012. However, under article XII(1)(a)(ix) of the STCW Convention, before the date set for entry into force, any Party may give notice to the Secretary-General that it exempts itself from giving effect to an amendment adopted under the procedure laid down in article XII(2) of the same Convention, for a period not longer than one year. The Minister for Foreign Affairs of the Kingdom of Denmark hereby informs that, with reference to Regulation VIII/1 (Fitness for duty) of the Annex to the STCW Convention and Section A-VIII/1 of the STCW Code, due to national procedural requirements, the Kingdom of Denmark is not able to give effect to the Manila amendments before 1 January 2013. The Minister for Foreign Affairs of the Kingdom of Denmark has, however, the honour to inform the Secretary-General that the Government of the Kingdom of Denmark will not fail to inform the Secretary-General of any developments in this respect.

Ambasada Irlandii niniejszym informuje Międzynarodową Organizację Morską, że z powodu krajowych wymogów prawnych i administracyjnych Irlandia nie jest w stanie stosować prawidła VIII/1 (Zdolność do pełnienia służby) załącznika do Konwencji STCW i sekcji A VIII/1 Kodeksu STCW przed dniem 1 stycznia 2013 r. Rząd Irlandii poinformuje Sekretarza Generalnego o postępach w tym zakresie.

The Embassy of Ireland hereby informs IMO that, due to national regulatory and administrative requirements, Ireland is not in a position to be able to give effect to Regulation VIII/1 (Fitness for duty) of the Annex to the STCW Convention and Section A VIII/1 of the STCW Code before 1st January 2013. The Government of Ireland will not fail to inform the Secretary-General of any developments in this respect.

Ambasada Republiki Łotewskiej niniejszym informuje, że w odniesieniu do każdej zmiany Rozdziału I i VIII załącznika do Konwencji STCW, która nie wiąże się bezpośrednio z wydawaniem, uznawaniem i potwierdzaniem dyplomów marynarzy, zgodnie z prawidłem I/15, z powodu krajowych wymogów proceduralnych, Republika Łotewska nie jest w stanie stosować Zmian z Manili przed dniem 1 stycznia 2013 r. Ambasada Republiki Łotewskiej ma jednakże zaszczyt poinformować Sekretarza Generalnego, że rząd Republiki Łotewskiej będzie informował Sekretarza Generalnego o postępach w tym zakresie.

The Embassy of the Republic of Latvia hereby informs that, with reference to any amendments to Chapters I and VIII of the Annex to the STCW Convention that do not directly involve certification of seafarers, under regulation I/15, due to national procedural requirements, the Republic of Latvia is not able to give effect to the Manila amendments before 1 January 2013. The Embassy of the Republic of Latvia has however, the honour to inform the Secretary-General that the Government of the Republic of Latvia will not fail to inform the Secretary-General of any developments in this respect.

Zawiadomienie otrzymane przez Sekretarza Generalnego dnia 19 grudnia 2011 r.

Zgodnie z art. XII ust. 1 lit. a) pkt ix) Konwencji rząd Nowej Zelandii wyłącza się ze stosowania Zmian z Manili przez okres jednego roku od czasu ich wejścia w życie, to jest od dnia 1 stycznia 2012 r. Odpowiednio rząd Nowej Zelandii pragnie zaznaczyć, że będzie stosował Zmiany z Manili od dnia 1 stycznia 2013 r.

In accordance with article XII(1)(a)(ix) of the Convention, the Government of New Zealand exempts itself from giving effect to the Manila Amendments for a period of one year from the date of their entry into force, namely 1 January 2012. Accordingly, the Government of New Zealand records its understanding that it will give effect to the Manila Amendments from 1 January 2013.

Ambasada Republiki Portugalskiej niniejszym informuje Międzynarodową Organizację Morską, że z powodu krajowych wymogów prawnych i administracyjnych Republika Portugalska nie jest w stanie stosować prawidła VIII/1 (Zdolność do pełnienia służby) załącznika do Konwencji STCW i sekcji A VIII/1 Kodeksu STCW przed dniem 1 stycznia 2013 r. Władze Republiki Portugalskiej poinformują Sekretarza Generalnego o postępach w tym zakresie.

The Embassy of the Republic of Portugal hereby informs IMO that, due to national regulatory and administrative requirements, the Republic of Portugal is not in a position to be able to give effect to Regulation VIII/1 (Fitness for duty) of the Annex to the STCW Convention and Section A VIII/1 of the STCW Code before 1st January 2013. The Portuguese authorities will not fail to inform the Secretary-General of any developments in this respect.
