Revocation of Article 71

In the Fair Employment and Treatment (Northern Ireland) Order 1998 (“the 1998 Order”), omit Article 71 (school teachers).

Consequential amendments

The Schedule to this Act has effect.

Commencement

• (1) The preceding provisions of this Act come into operation on such day as the Executive Office may by order appoint (but this is subject to subsection (2)).

• (2) Those provisions come into operation at the end of the period of 2 years beginning with the day of Royal Assent if by the end of that period no order has been made under subsection (1) bringing them into operation.

• (3) An order under subsection (1) may include such transitional, transitory or saving provision as the Executive Office considers appropriate.

Short title

This Act may be cited as the Fair Employment (School Teachers) Act (Northern Ireland) 2022.

Fair Employment and Treatment (Northern Ireland) Order 1998

The 1998 Order is amended as follows.

In Article 18 (restriction on disclosure of information)—

• (a) in paragraph (3)(a) omit “or 71”; and

• (b) in paragraph (4)(a) omit “or 71(4)”.

In Article 70 (excepted employments, etc.) omit paragraph (5).

In Article 104(1) (regulations and orders) omit “, 71(6)”.

In paragraph 1 of Schedule 2 (conduct of investigations by the Commission) omit “or 71”.
