Explanatory note

(This note is not part of the Rules but is intended to indicate their general purport.)

EXPLANATORY NOTE

These Rules represent the final stage of the complete revision of the Rules of the Supreme Court (Northern Ireland) 1936, which began with the Rules of the Supreme Court (Transitional Rules) 1979.

The aim of the Rules Committee has been to assimilate the revised Rules to the Rules of the Supreme Court 1965, which regulate the procedure in the High Court and Court of Appeal in England and Wales, while taking account of the differences in the law and practice in Northern Ireland. The numeration and subject matter generally correspond and the note in square brackets at the end of a rule in the several Orders refers to a rule in the equivalent Order of the 1965 Rules (except in Order 97 (non-contentious probate) where the reference is to a rule in the Non-Contentious Probate Rules 1954).

The more important differences are:

• Order 1. (interpretation etc.) Part II of this Order provides for the distribution of business amongst Chancery, Queen’s Bench and Family Divisions of the High Court and the assignment of business to the various Departments of the Supreme Court.

• Order 18. (pleadings). The times for service of pleadings remain longer in Northern Ireland than in England and Wales. The rule that pleadings may be served in the Long Vacation is preserved.

• Order 24. (discovery). In the absence of agreement, discovery in Northern Ireland is subject to an order of the Court.

• Order 25. No order corresponding to Order 25 of RSC 1965 (summons for directions) has been made, as this procedure has never been adopted in Northern Ireland.

• Orders 45–50. (Enforcement of judgments and orders) in RSC 1965 have been considerably modified to take account of the existence in Northern Ireland of the Enforcement of Judgments Office. No Order 49 (which in England and Wales deals with garnishee proceedings) has been made.

• Order 91. (non-contentious probate). In England the corresponding rules are not made by the Supreme Court Rules Committee.

The existing Orders of the 1936 Rules relating to Adoption (Order 73), Company Winding-Up (Order 74), Land Purchase (Order 87) and Bankruptcy (Order 88) are preserved.

• (1) Where a writ or notice of a writ has been served out of the jurisdiction under Order 11 rule 1(2)(a) or has been served within the jurisdiction on a defendant domiciled in England and Wales or Scotland ... the plaintiff shall not be entitled to enter judgment under this Order except with the leave of the Court.

• (2) An application for leave to enter judgment may be made ex parte and shall be supported by an affidavit stating that in the deponent’s belief—

• (a) each claim made by the writ is one which by virtue of the Civil Jurisdiction and Judgments Act 1982 the Court has power to hear and determine,

• (b) no other court has exclusive jurisdiction ... under Schedule 4 to that Act to hear and determine such claim, and

• (c) where the writ or notice thereof is served out of the jurisdiction under Order 11 rule 1(2)(a), such service satisfied the requirements ... of Schedule 4 to that Act,

and giving in each case the sources and grounds of such belief.

Judgment shall not be entered against a defendant under this Order if notice has been given under Order 126 of a person’s intention to make an application for a declaration under section 6 of the Justice and Security Act 2013 in relation to the proceedings, and that application has not been disposed of.]

and giving in each case the sources and grounds of such belief.

• (1) An application for a grant may be made—

• (a) using the online portal;

• (b) by post; or

• (c) in person at the Office or any branch office.

• (2) An application using the online portal shall be made in accordance with instructions given through the online portal by—

• (a) completing and sending the online application form provided through the online portal; and

• (b) electronically paying the appropriate fee.

• (3) Where original documents are required to be lodged separately in support of an application made using the online portal, these shall be lodged in the Office or branch office in accordance with instructions given through the online portal.

• (a) The Master may require that an application for a grant is made in a specified form.

• (b) Any such form may include the statement of truth and any matters required by these rules to be included in the statement of truth.
