The Food Safety (1991 Order) (Commencement) Order (Northern Ireland) 1991
Made: 29th April 1991
The Department of Health and Social Services, in exercise of the powers conferred on it by Article 1(2) of the Food Safety (Northern Ireland) Order 1991[^f00001] and paragraph 2(1) of Schedule 1 to the Northern Ireland Act 1974[^f00002] and of all other powers enabling it in that behalf and after consultation in accordance with Article 47(3) of the said Order with such organisations as appear to it to be representative of interests likely to be substantially affected by this order, hereby makes the following order:
Citation and interpretation

- (1) This order may be cited as the Food Safety (1991 Order) (Commencement) Order (Northern Ireland) 1991.
- (2) In this order, “the Order” means the Food Safety (Northern Ireland) Order 1991.
Commencement of provisions

- (1) Subject to paragraphs (2) to (4), the day appointed for the coming into operation of the provisions of the Order shall be 21st May 1991.
- (2) The day appointed for the coming into operation of the repeal in Schedule 4 of—
- (a) sections 4(5), 5(5), 7(3), 13(10), 74(4), 93(4), 95(7), 97(5), 118(7), 120(5), 135 and 136(3) of the Food Act 1984[^f00003]; and
- (b) Articles 38(4)(a) and (5) to (7), 40(2)(d) and (5) and 44 of, and Schedule 2 to, the Food (Northern Ireland) Order 1989[^f00004],
and Article 51(4) in so far as it relates to those repeals, shall be 4th November 1991.
- (3) The day appointed for the coming into operation of Article 49, and the repeal in Schedule 4 of section 133(3) of the Food Act 1984, and Article 51(4) in so far as it relates to that repeal, shall be 1st April 1992.
- (4) The day appointed for the coming into operation of the repeal in Schedule 4 of Articles 2(2) and 15 of the Food (Northern Ireland) Order 1989, and Article 51(4) in so far as it relates to those repeals, shall be 1st April 1992, immediately after the coming into operation of regulation 2(6) of, and Schedule 2 to, the Food Hygiene (General) (Amendment) Regulations (Northern Ireland) 1990[^f00005], in so far as the said regulation 2(6) and the said Schedule 2 have effect for the purposes of paragraph (6) of regulation 26A of the Food Hygiene (General) Regulations (Northern Ireland) 1964[^f00006].

Explanatory note
(This note is not part of the order.)
This order provides for the coming into operation on 21st May 1991 of all of the provisions of the Food Safety (Northern Ireland) Order 1991 except for—
- the repeal in Schedule 4 of those provisions of the Food Act 1984 and the Food (Northern Ireland) Order 1989, which are required for the continued existence, and enforcement and execution, of orders and regulations made under the Food Act 1984, which shall come into operation on 4th November 1991;
- Article 49, and the repeal in Schedule 4 of section 133(3) of the Food Act 1984, which shall come into operation on 1st April 1992; and
- the repeal in Schedule 4 of Articles 2(2) and 15 of the Food (Northern Ireland) Order 1989, which shall come into operation on 1st April 1992, immediately after the coming into operation of certain provisions of the Food Hygiene (General) (Amendment) Regulations (Northern Ireland) 1990.
