Companies (1990 Order) (Commencement No. 5) Order (Northern Ireland) 1994

The Department of Economic Development, in exercise of the powers conferred on it by Article 1 of the Companies (Northern Ireland) Order 1990[^f00001] and paragraph 2(1) of Schedule 1 to the Northern Ireland Act 1974[^f00002] and of every other power enabling it in that behalf, hereby makes the following Order:
Citation and interpretation

- (1) This Order may be cited as the Companies (1990 Order) (Commencement No. 5) Order (Northern Ireland) 1994.
- (2) In this Order “the 1986 Order” means the Companies (Northern Ireland) Order 1986[^f00003] and “the 1990 Order” means the Companies (Northern Ireland) Order 1990.
Provisions of the 1990 Order brought into operation

Subject to Article 3, Articles 3 and 13 of the 1990 Order shall come into operation on 7th April 1994 for the purpose of inserting the new provision Article 250A into Part VIII of the 1986 Order.
Transitional provision

- (1) This Article applies where—
- (a) the requirements of Article 250 of the 1986 Order as to the delivering of accounts and reports before the end of the period allowed for so doing have not been complied with before 7th April 1994, and
- (b) those requirements have still not been complied with on that date.
- (2) In such a case, the period by reference to the length of which the amount of the penalty is determined under Article 250A(2) of the 1986 Order shall be deemed to commence on 7th April 1994.

Explanatory note
(This note is not part of the Order)
This Order brings into operation on 7th April 1994 Articles 3 and 13 of the Companies (Northern Ireland) Order 1990 for the purpose of inserting a new Article 250A (liability to civil penalty for failure to deliver accounts and reports under Article 250) into Part VIII of the Companies (Northern Ireland) Order 1986 (“the 1986 Order”).
Article 3 makes transitional provision in cases where the requirements of Article 250 of the 1986 Order as to the delivery of accounts and reports have not been complied with before 7th April 1994, and have still not been complied with on that date. In such cases the period by reference to which the amount of the civil penalty is calculated under Article 250A(2) is deemed to commence on 7th April 1994.
