Registration of Deeds (Fees) Order (Northern Ireland) 1996
Made: 27th June 1996
To be laid before Parliament under paragraph 3(3) of Schedule 1 to the Northern Ireland Act 1974
Coming into operation: 8th August 1996
The Department of the Environment, in exercise of the powers conferred by section 16(1) of the Registration of Deeds Act (Northern Ireland) 1970[^f00001] and now vested in it[^f00002] and of every other power enabling it in that behalf, hereby makes the following Order:
Citation and commencement

This Order may be cited as the Registration of Deeds (Fees) Order (Northern Ireland) 1996 and shall come into operation on 8th August 1996.
Interpretation

In this Order—
- “Matrimonial Charges Index” has the same meaning as in regulation 3(2) of the Matrimonial Charges Regulations (Northern Ireland) 1989[^f00003];
- “order charging land” has the same meaning as in Article 46(1) of the Judgements Enforcement (Northern Ireland) Order 1981[^f00004].
Fees

The fees to be taken in the registry of deeds in respect of the matters set out in column 1 of the Schedule shall be those set out opposite thereto in column 2 of that Schedule.
Revocation

The Registration of Deeds (Fees) Order (Northern Ireland) 1995[^f00005] is hereby revoked.
SCHEDULE 1
Registration
1
- (a) Upon every memorial received for the registration of a document other than a document specified in paragraph 7 of this Schedule
Certificates of Registration

For every special certificate of registration
Common Search or Negative Search made by Office under a Requisition

By time taken to produce each finished search for each half-hour or part thereof
Search by Members of the Public

Search by every person each half-hour or part thereof
Copies made in Registry of Deeds
5
- (a) For every copy of a memorial or affidavit of judgement (including the search for such memorial or affidavit of judgement and certificate of the office on the copy)
Entry of Satisfaction of Mortgage or Charge

- (a) Entry of satisfaction of mortgage
Vacation of Registration by Court Order or Certificate
7
Entry of vacation of registration by judgment, decree or order of a Court, Court certificate or other certificate
Vacation of Registration of Bankrupt’s Rights of Occupation
8
Entry of vacation of registration of a charge in respect of a bankrupt’s rights of occupation where the vacate is made pursuant to regulation 8(5)(c) of the Insolvency (Registration of Deeds) Regulations (Northern Ireland) 1991[^f00006]

Explanatory note
(This note is not part of the Order.)
This Order which revokes the Registration of Deeds (Fees) Order (Northern Ireland) 1995, specifies the fees to be taken in respect of documents lodged for Registration in the Registry of Deeds and for other work carried out by that registry.
The main changes effected by the Order are:—
- (a) A fee of £4·00 has been provided for the entry of the vacation of a registration by the judgment, decree or order of a Court, Court Certificate or other certificate; and
- (b) A fee of £4·00 has been provided for the entry of the vacation of a bankrupt’s rights of occupation where such rights have been vacated as a result of an affidavit made by the bankrupt under regulation 8(5)(c) of the Insolvency (Registration of Deeds) Regulations (Northern Ireland) 1991.
