Diseases of Animals (Modification) Order (Northern Ireland) 1997

Made: 24th March 1997

Coming into operation: 14th April 1997

The Department of Agriculture, being satisfied that the modifications of Schedule 2 to the Diseases of Animals (Northern Ireland) Order 1981[^f00001] set out in Article 2 are necessary or expedient for the purposes of that Order, in exercise of the powers conferred on it by Article 16(2) of that Order and of every other power enabling it in that behalf, hereby makes the following Order:

Citation and commencement

This Order may be cited as the Diseases of Animals (Modification) Order (Northern Ireland) 1997 and shall come into operation on 14th April 1997.

Modification of the Diseases of Animals (Northern Ireland) Order 1981

In paragraph 12A(4) of Part II of Schedule 2 to the Diseases of Animals (Northern Ireland) Order 1981[^f00002], for the definition of “herd” there shall be substituted the following definition—

• “herd” means— all female bovine animals, which are in milk or in calf; and all male bovine animals which are or have been used for breeding purposes, which are kept on the same holding and managed as a separate production unit at the time of service of a notice in the form set out in Schedule 2 to the Bovine Spongiform Encephalopathy Order (Northern Ireland) 1995[^f00003] in relation to that holding;

Explanatory note

(This note is not part of the Order.)

This Order further modifies Part II of Schedule 2 to the Diseases of Animals (Northern Ireland) Order 1981 by substituting the definition of “herd” in that Part.

Where the animals slaughtered as a result of being exposed to the infection of Bovine Spongiform Encephalopathy represent more than 10% of a herd, enhanced compensation is payable.
