The Secretary of State, in pursuance of paragraph 1 of Part II of Schedule 1 to the Proceeds of Crime (Northern Ireland) Order 1996[^f00001], hereby makes the following Order:—

Citation and commencement

(1) This Order may be cited as the Proceeds of Crime (Northern Ireland) Order 1996 (Amendment) Order 1997.

(2) This Order shall come into operation on 12th March 1997, but shall not apply in relation to offences committed before that date.

Addition of offence

(1) Part I of Schedule 1 to the Proceeds of Crime (Northern Ireland) Order 1996 (offences in respect of which a court of summary jurisdiction may make confiscation orders) shall be amended by the addition to the offences there listed of the following offence, namely, an offence under section 108(1) of the Social Security Administration (Northern Ireland) Act 1992[^f00002].

(2) Accordingly, the table of offences set out in Part I of Schedule 1 to the Proceeds of Crime (Northern Ireland) Order 1996 is amended by the addition, after the entry in respect of the Copyright, Designs and Patents Act 1988[^f00003], of the following—

Explanatory note

(This note is not part of the Order.)

This Order amends the Proceeds of Crime (Northern Ireland) Order 1996 by adding an offence under section 108(1) of the Social Security Administration (Northern Ireland) Act 1992 to the offences listed in Part I of Schedule 1 in respect of which a court of summary jurisdiction may make confiscation orders under that Order. By virtue of Article 1(2), a court of summary jurisdiction may only make a confiscation order in relation to the added offence where that offence is committed on or after the day on which this Order comes into operation.
