The Road Traffic Offenders (1996 Order) (Commencement No. 2) Order (Northern Ireland) 1997

The Department of the Environment, in exercise of the powers conferred on it by Article 1 of the Road Traffic Offenders (Northern Ireland) Order 1996[^f00001] and paragraph 2(1) of Schedule 1 to the Northern Ireland Act 1974[^f00002] and of every other power enabling it in that behalf, hereby makes the following Order:

Citation

This Order may be cited as the Road Traffic Offenders (1996 Order) (Commencement No. 2) Order (Northern Ireland) 1997.

Commencement

The day appointed for the coming into operation of Articles 16(5) and 76(4), (5) and (6) of the Road Traffic Offenders (Northern Ireland) Order 1996 shall be 18th July 1997.

Explanatory note

(This note is not part of the Order.)

This Order brings into operation on 18th July 1997 Articles 16(5) and 76(4) to (6) of the Road Traffic Offenders (Northern Ireland) Order 1996. Article 16(5) provides that nothing in Article 16 (Admissibility of records as evidence) shall enable evidence to be given with respect to any matter other than a matter of description prescribed by magistrates courts rules. Articles 76(4) to (6) enable the Lord Chancellor to make regulations with regard to the enforcement of payment of sums registered under that Article (including modifications of certain provisions of the Magistrates' Courts (Northern Ireland) Order 1981 and incidental, supplementary and consequential provision).
