Carriage of Dangerous Goods (Classification, Packaging and Labelling) and Use of Transportable Pressure Receptacles (Amendment) Regulations (Northern Ireland) 1997

Coming into operation: 8th September 1997

The Department of Economic Development, being the Department concerned[^f00001], in exercise of the powers conferred by Articles 17(1) to (6), 20(2), 40(2) to (4), 54(1) and (2) and 55(2) of, and paragraphs 1(1) to (4), 2, 3(1), 5 and 15 of Schedule 3 to, the Health and Safety at Work (Northern Ireland) Order 1978[^f00002] and of every other power enabling it in that behalf, after consultation in accordance with Articles 46(1) and 54(5) of that Order with the Health and Safety Agency for Northern Ireland and such other bodies as appeared to the Department to be appropriate, hereby makes the following Regulations:—

Citation and commencement

• (1) These Regulations may be cited as the Carriage of Dangerous Goods (Classification, Packaging and Labelling) and Use of Transportable Pressure Receptacles (Amendment) Regulations (Northern Ireland) 1997 and shall come into operation on 8th September 1997.

Amendment of the Carriage of Dangerous Goods (Classification, Packaging and Labelling) and Use of Transportable Pressure Receptacles Regulations (Northern Ireland) 1997

The Carriage of Dangerous Goods (Classification, Packaging and Labelling) and Use of Transportable Pressure Receptacles Regulations (Northern Ireland) 1997[^f00003] shall be amended by substituting:

• (a) for Part I (Table of classifications and other particulars) of Schedule 1 (Classification and ascertainment of other particulars of dangerous goods) the Part I set out in Schedule 1 to these Regulations; and

• (b) for Part I (Ascertainment) of Schedule 2 (Subsidiary Hazard Signs) the Part I set out in Schedule 2 to these Regulations.

Explanatory note

(This note is not part of the Regulations.)

These Regulations amend the Carriage of Dangerous Goods (Classification, Packaging and Labelling) and Use of Transportable Pressure Receptacles Regulations (Northern Ireland) 1997 (“the principal Regulations”) in order to correct defects in the principal Regulations.

Regulation 2(a) substitutes a new Part I in Schedule 1 to the principal Regulations. The new Part I includes—

• (a) danger signs; and

• (b) in the entry for “Flammable Solid”, in column 2 (hazardous properties) another category (desensitised explosive where the explosive properties have been suppressed),

which were omitted from the principal Regulations.

• Regulation 2(b) substitutes a new Part I in Schedule 2 to the principal Regulations. The new Part I includes subsidiary hazard signs which were omitted from the principal Regulations.
