Education (Assessment Arrangements for Key Stages 1 and 2) (Amendment) Order (Northern Ireland) 1997

Coming into operation: 30th September 1997

The Department of Education in exercise of the powers conferred on it by Article 7(1)(b), (2)(a)(ii) and (6) of the Education Reform (Northern Ireland) Order 1989[^f00001] and of every other power enabling it in that behalf, hereby makes the following Order:

Citation and commencement

This Order may be cited as the Education (Assessment Arrangements for Key Stages 1 and 2) (Amendment) Order (Northern Ireland) 1997, and shall come into operation on 30th September 1997.

Amendment of the Education (Assessment Arrangements for Key Stages 1 and 2) Order (Northern Ireland) 1996

The Education (Assessment Arrangements for Key Stages 1 and 2) Order (Northern Ireland) 1996[^f00002] shall be amended as provided in regulations 3 and 4.

In Article 2 (Application) for paragraph (2) there shall be substituted the following paragraph—

(2) This Order shall not have effect in relation to a pupil in respect of whom a board is maintaining a statement of special educational needs under Article 16 of the Education (Northern Ireland) Order 1996[^f00003] and who, on the making of an assessment of his special educational needs, has been assessed by that board under Article 15 of that Order as having severe learning difficulties.

In Article 3 (Interpretation) for the definition of “Assessment Document” there shall be substituted—

• “Assessment Document” means the document published by the Stationery Office entitled “Assessment Arrangements in Key Stages 1 and 2”[^f00004];

Explanatory note

(This note is not part of the Order.)

This Order amends the Education (Assessment Arrangements for Key Stages 1 and 2) Order (Northern Ireland) 1996 (“the principal Order”).

The Order makes the following changes—

Article 3 amends Article 2(2) of the principal Order to take account of the making of the Education (Northern Ireland) Order 1996.

Article 4 amends the definition of “the Assessment Document” to take account of the publication of a revised document.
