Coming into operation: 8th December 1997

The Department of Agriculture being a Department designated[^f00001] for the purposes of section 2(2) of the European Communities Act 1972[^f00002] in relation to the common agricultural policy of the European Community, in exercise of the powers conferred on it by the said section 2(2) and of every other power enabling it in that behalf, hereby makes the following Regulations:—

Citation and commencement

These Regulations may be cited as the The Sheep Annual Premium (Amendment) Regulations (Northern Ireland) 1997 and shall come into operation on 8th December 1997.

(2) A producer who applies for a premium in respect of a given marketing year shall deliver his application to the competent authority— (a) on or after the 8th December in the preceding calendar year; and (b) not later than 9th January in that marketing year (both dates inclusive) or if 9th January is a Saturday, Sunday or public holiday the next following working day.

(3) In order to benefit from the specific aid provided for by Article 1 of Council Regulations 1323/90 in respect of a given marketing year a producer such as is specified in paragraph 1(a) (1)(b) of Commission Regulation 2700/93 shall submit the specific declaration referred to therein in respect of that marketing year by submitting to the competent authority an area aid application for the calender year corresponding with the said marketing year under Article 6 of Council Regulation 3508/92 as if Article 4(5) of Commission Regulation 3887/92 did not apply to his case. (4) In paragraph (3)— (a) “Commission Regulation 3887/92” means Commission Regulation (EEC) No. 3887/92 laying down detailed rules for applying the integrated administration and control system for certain Community aid schemes[^f00005], as last amended by Commission Regulation (EC) No. 2015/95[^f00006]; (b) “Commission Regulation 2700/93” means Commission Regulation (EEC) No. 2700/93 on detailed rules for the application of the premium in favour of sheepmeat and goatmeat producers [^f00007], as last amended by Commission Regulation (EC) No.1526/96 [^f00008]; (c) “Council Regulation 1323/90” means Council Regulation (EEC) No. 1323/90 instituting specific aid for sheep and goat farming in certain less-favoured areas of the Community[^f00009], as last amended by Commission Regulation (EC) 40/96[^f00010]; (d) “Council Regulation 3508/92” means Council Regulation (EEC) No. 3508/92 establishing an integrated administration system for certain Community aid schemes[^f00011], as last amended by Council Regulation (EC) No. 2466/96[^f00012].

Explanatory note

(This note is not part of the Regulations.)

These Regulations further amend the Sheep Annual Premium Regulations (Northern Ireland) 1992 as amended to implement, as respects Northern Ireland, new paragraph 1(a)(3) of Commission Regulation (EEC) No. 2700/93 (O.J. No. L245 , 1.10. 93, p. 99), inserted by Article 1 of Commission Regulation (EC) No. 1526/96 (O.J. No. L190, 31.7.96, p. 21). The Regulations require sheep producers to demonstrate the location of the holdings on which these sheep are kept by submitting the area aid application required by Article 6 of Council Regulation (EEC) No. 3508/92).

The Regulations also provide that a producer making an application for Sheep Annual Premium in respect of a particular marketing year as defined by Article 3(3) of Council Regulations (EEC) No. 3013/89 (O.J. No. L289, 7.10.89, p. 1) shall deliver his application on or after 8th December in the preceding calendar year and not later than 9th January in the Marketing year concerned.
